PERMIT FEES FOR SINGLE-FAMILY RESIDENCES CITY MANAGER
RECOMMENDED ACTION:
ADOPT Resolution No. 2014-112 APPROVING a waiver of building permit fees associated with
rebuilding or repairing single-family residential structures that were destroyed or damaged by the
Poinsettia Fire.
ITEM EXPLANATION:
On May 14, 2014, a wildfire broke out in the southeast quadrant ofthe City near Poinsettia Lane and
Alicante Road and spread westward, eventually encompassing an area of about 600 acres. The
Poinsettia Fire was finally fully contained after five days; severely damaging or destroying eight
residences, an 18-unit apartment building, and two commercial buildings; and causing varying degrees
of damage to several other structures and residences. Additional reports of fire damage continue to
surface.
Before the fire was even out, staff was already doing field assessments of the damage, researching
availability in rental units to house displaced residents, setting up a hotline for residents to call for
information, and pulling the building plans from archives for the destroyed structures. The Building
Division immediately began issuing over-the-counter demolition permits, allowing quick removal of
debris to preserve the health, safety and welfare of the community. Community & Economic
Development has committed to provide "pre-approved" copies of archived building plans, allowing
owners to quickly replicate destroyed structures. In addition, staff will expedite building plan checks
for modified structures, allow extended construction hours, and prioritize building inspections to
accommodate construction schedules.
In order to provide further assistance, staff recommends that the City Council consider waiving building
permit fees for rebuilding the damaged and destroyed single-family residential structures. Staff is not
recommending this fee waiver for the destroyed apartment building or commercial structures because
these properties are fully insured. The costs associated with rebuilding, including the cost for building
permits, would be reimbursable.
FISCAL IMPACT:
The costs associated with waiving building permit fees to repair and rebuild fire-damaged single-family
residential structures is estimated to be at least $23,250, based on the valuation for the existing square
footage. Building permit fees cover the cost of building plan check and staff time associated with
building inspections.

ENVIRONMENTAL IMPACT:
The City Planner has determined that the proposed fee waiver is exempt from the provisions of CEQA,
pursuant to CEQA Guidelines Section 15061(b)(3) (General Rule), where it can be seen with certainty
that there is no possibility that the activity in question may have a significant effect on the environment.

SINGLE-FAMILY RESIDENTIAL STRUCTURES THAT WERE
4 DESTROYED OR DAMAGED BY THE POINSETTIA FIRE

g The City Council of the City of Carlsbad, California, does hereby resolve as follows:
7 WHEREAS, a wildfire known as the Poinsettia Fire broke out in the City of Carlsbad
8 on May 14,2014 and severely damaged or destroyed eight residences and caused minor damage
to several other residences; and
WHEREAS, the City Council desires to help restore the community and remove the
blight caused by the fire as soon as possible; and
WHEREAS, the City Council desires to assist property owners whose uninsured
homes were destroyed or damaged by the Poinsettia Fire by waiving building permit fees for
15 single-family residences that will be reconstructed or repaired; and
16 WHEREAS, building permit fees are a municipal affair; and
WHEREAS, Carlsbad Municipal Code Section 18.04.040 authorizes the City Council
to establish building permit fees, by resolution, to cover the costs associated with the processing,
plan check review and inspections associated with the construction of buildings; and
WHEREAS, this fee waiver for uninsured single-family residential structures will
provide a public benefit to the community and accelerate repair of the damage in residential
23 communities that were affected by the Poinsettia Fire, thereby hastening the restoration of the
24 public health, safety and welfare of the community.
25 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of

Carlsbad, California, as follows:
