DIREaOR CITY ATTORNEY CITY MANAGER RECOMMENDED ACTION: Adopt Resolution No. 2014-117 . denying sign application No. PS 13-110, and declining the offer to fabricate, install, and donate to the City of Carlsbad a community "archway sign" across Carlsbad Boulevard at Carlsbad Village Drive. ITEM EXPLANATION: Background: On August 13, 2013, the applicant, Mike Howes, on behalf of the Carlsbad Chamber of Commerce ("Chamber") submitted a preliminary review application (PRE 13-25) for staff review and comment on the proposed donation of a community archway sign that would be installed in the Village across Carlsbad Boulevard just north ofthe intersection at Carlsbad Village Drive. The purpose ofthe preliminary review was to advise the donor/applicant regarding technical and processing requirements, and to provide some initial feedback regarding aspects ofthe sign's design. Staff comments on the preliminary design included the following (Exhibit 2): • consider removing elements that give the sign a "busy" and distracting appearance; consider a simpler design that reflects the character and history ofthe Village; • integrate accents and art elements into the sign; and • consider incorporating design elements for the support poles, such as commemorative plaques, historical information, or public art elements, especially at the pedestrian scale. On October 23, 2013, the applicant submitted a sign permit application (PS 13-110) for the archway sign. Carlsbad Municipal Code Chapter 11.44.100 (C.M.C.) allows for way-finding signs designed as archway signs located over major roads to be approved by resolution ofthe City Council. The design ofthe sign faces is an interpretation of a roadway sign that was installed in 1938 (Exhibit 3). The historic sign was originally erected in approximately the same location to direct traffic from the highway into the business district. The materials and colors of the original sign are unknown, but according to a news account at the time, the sign was illuminated at night. The replica sign would be constructed with durable metal and painted navy blue. The channel letters would have white acrylic faces and be internally illuminated with LED lighting. The sign cabinet would also feature a sand-colored open channel border accent, illuminated with exposed neon. The sign also was proposed to incorporate two five-foot diameter bronze castings of back-to-back dolphins in faux portholes, designed by the artist Robert Wyland ("Wyland"). The truss would be painted a sand color and attached to two 14-inch X 14-inch square tube support posts on either side ofthe road. The sign posts would be topped with an acorn-style globe and be internally illuminated with LEDs at night. The support bases would be clad in sheet metal painted navy blue, and the upper portion ofthe sign posts would be painted black. Each base would include a bronze donor plaque and the city's seal. The acorn-style globes reach the sign's approximately 30-foot maximum height. Details ofthe proposed sign are provided in Exhibit 4. The Chamber of Commerce would own and manage the project through design, permitting, fabrication, and installation, at which time the sign would be donated to the city. The cost ofthe sign, structures, and installation is estimated to be approximately $165,000 to $175,000. TaylorMade Golf Company ("TaylorMade") has offered to fund the design, fabrication and installation ofthe sign. Arts Commission Review: Since the sign incorporated artwork when the application was submitted (the dolphin castings by Wyland), and was proposed to be donated to the city once installed, the sign was subject to the Arts Commission review (Chapter 2.18 of the Carlsbad Municipal Code). Therefore, the sign proposal was forwarded to the Cultural Arts Office. The work was first reviewed by the public art advisory committee, whose primary role was to comment on the artistic and aesthetic elements, design ofthe sign, location, construction materials and historical significance. On November 14,2013, the Carlsbad Arts Commission's advisory panel voted unanimously to recommend to the Arts Commission that the artwork donation offer be declined. In explaining their recommendation, the advisory committee expressed concerns about the commercial nature of the artwork, its lack of originality and appropriateness to Carlsbad, and its maintainability (leaching of bronze exposed to the elements, etc.). The committee also considered, and unanimously rejected, a second motion regarding the proposed sign without the Wyland dolphin element, based on the merits ofthe sign's design and proposed location. Further, the committee suggested whether the donor would consider funding a redesign of the sign and an open call for an artist to create a sign unique to Carlsbad, and also consider a more appropriate location for the sign where it could function more as way-finding for the Village (see Exhibit 5 with additional comments expressed by the advisory committee). Following a unanimous recommendation of denial by the advisory committee, the item was brought forward for a final decision to the Arts Commission. At its December 5, 2013 meeting, the Arts Commission voted unanimously (6-0) to reject the donation ofthe sign into the city's Art in Public Places collection. In the event the Arts Commission rejects a donation offer, the artwork is not recommended to the City Council for consideration (see Exhibit 6 forthe minutes ofthe December 5, 2013 meeting). Please see Exhibit 7 for more detailed information on the Arts Commission's action regarding the Carlsbad sign donation proposal (memo to Kevin Crawford, Interim City Manager from Vincent E. Kitch, Cultural Arts Manager, dated December 5, 2013). Corporate Marketing Partnerships: On February 11, 2014 the City Council adopted Council Policy No. 79 - Policy for Corporate Marketing Partnerships Utilizing City-Owned Assets. The Policy provides guidelines for allowing certain marketing opportunities on city owned property (e.g. sponsorship recognition and/or commercial advertising) provided under Corporate Partnership Agreements that will enable the city to generate revenue to enhance services and facilities. Although the policy is geared towards generating revenue that can be Z Page 3 used to enhance city services and facilities to benefit residents, visitors and businesses, donation ofthe sign by TaylorMade is considered an "in-kind" contribution, and therefore subject to the policy. Under this policy, if the sign is accepted by the City Council with the TaylorMade donation plaque, as shown on the drawings, then TaylorMade will be required to enter into a Corporate Marketing Partnership Agreement with the city. Among other things, the Agreement would specify design criteria such as wording, size, placement/location and aesthetic limitations for the donation plaque. The Agreement, which would be a condition of approval, would be subject to the approval of the City Council at a future meeting. Public Outreach Efforts: Staff encouraged the applicant to conduct public outreach with the community and downtown merchants to receive feedback on the design and location ofthe sign. As a result, the applicant contacted several local print media, such as the Union Tribune, Coast News, Carlsbad Business Journal and the Carlsbad magazine, which all ran articles on the proposed sign. On January 30, 2014, the applicant also held a public outreach meeting at the Carlsbad Inn to get feedback from the public. Reaction to the proposed sign was mixed, with some supportive of the sign, and others expressing concern with either the sign, the dolphin element, or both (see Exhibit 8 for news articles and public comments). Planning Staff Review: Concurrent with the referral ofthe proposed sign to the Arts Commission, staff conducted a review ofthe sign application. Staff allowed time for the Arts Commission to complete their review process as well as the applicant's public outreach efforts to conclude before bringing the sign application forward to the City Council. Since the Sign Ordinance does not have any development or design guidelines for an archway sign, staff reviewed the sign proposal for consistency with the basic design principles stated in the Carlsbad Village Master Plan and Design Manual (June 2013), in particular Chapter 5 - Signage. Per Chapter 5, signs for businesses, in general, should be consistent with the general design theme for the related building and should be architecturally integrated with that building in both color and style. Although, the archway sign is not integrated with an adjacent building, staff believes the sign should be compatible with the identity and character of the Village. Notwithstanding the concerns expressed by the Arts Commission over the dolphin element (which has since been removed by the applicant). Planning staff has concerns that the sign, truss and structure lack aesthetic elements that reflect the unique Village and cultural identity of Carlsbad (a number of the sign elements are similar to the 'Encinitas' community sign, for example). Furthermore, the city recently approved placement of artwork in the center ofthe roundabout at the northern entry into the Village at State Street/Carlsbad Boulevard, and relocated the existing Hubbell entry sign to mark the southerly approach to the Village. The need for, and impact of, an archway sign at Carlsbad Village Drive may be diminished as a result. Currently the city has undertaken a number of initiatives intended to revitalize and bring an identity, or branding, to the Village, such as: • improving the Village streetscape by installing a set of street furnishings (i.e. trash and recycling receptacles, benches and hanging baskets) that will provide a cohesive feel, sense of continuity and visual identity to the Village; • installing parking, biking and pedestrian way-finding signs throughout the Village that will also have a consistent color, material and theme; and Page 4 • installing a roundabout at the northern entrance to the city, including an art component, and landscaping that will continue south on State Street for a consistent landscape palette into the Village. In addition, the city recently began the process to comprehensively update the Village Master Plan and Design Manual to spur renewal in the Village. Rather than considering this proposal in isolation at this time, staff believes a better opportunity to explore support for, and consider design ofthe community sign exists within the broader 'placemaking' efforts - such as the Village Master Plan update - currently underway. Doing so would give community members a chance to express their needs and desires about the Village area in a more holistic, structured fashion. PERMIT ALTERNATIVES: The following are alternatives to the recommended action for the City Council's consideration. 1. Approve the sign application as submitted and as shown on Exhibit 4 of this Agenda Bill. 2. Approve the sign application with Council-directed modifications (i.e., color, material, design, etc.). 3. Defer action on the sign application, with the consensus ofthe applicant, pending completion of the Village Master Plan process. The first two alternatives would require staff to prepare a new resolution that reflects the City Council's approval and incorporates conditions; this resolution would require consideration at a future meeting. FISCAL IMPAa: There would be no cost to the city for the construction and installation ofthe sign. However, should the sign be approved and accepted, the city would be responsible for its maintenance. A breakdown of the anticipated maintenance costs and schedule is listed below. • Average annual cost for installation and replacement of LED lights = $1,514 • Average annual cost for pressure washing sign and posts = $2,000 • Average annual cost for painting of sign and posts = $1,440 Total annual maintenance costs based on the above figures would be approximately = $4,954. If installed, cost of maintenance would be absorbed in the Streets Division budget. ENVIRONMENTAL IMPACT: If the sign application is approved it would be exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) - minor alteration of existing facilities, including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion and Section 15304(f) - minor trenching and backfilling where the surface is restored. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. This preliminarv review does not represent an in-depth analysis of vour proiect. It is intended to give vou feedback on critical issues based upon the information provided in vour submittal. This review is based upon the plans, policies, and standards in effect as ofthe date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards mav be in effect and additional Issues of concern mav be raised through a more specific and detailed review. Planning: 1. Currently, archway signs within the public rights-of-way are not allowed per the City Council's Policy No. 65 (Signs on Public Property) and the city's Sign Ordinance (Chapter 21.41 of the Carlsbad Municipal Code). However, an Ordinance (CS-227) for an amendment to Title 11 of the Carlsbad Municipal Code is before the City Council now. The amendment will add Chapter 11.44 (Private Party Signs on City Property), which will allow archway signs in the public rights-of-way. The Ordinance was introduced at the City Council's August 27, 2013 meeting. The Ordinance adoption is scheduled for the City Council's September 10, 2013 meeting. The Ordinance will go into effect 30 days afterthe adoption ofthe Ordinance. 2. The city does not have a Corporate Sponsorship policy, which would regulate private entity logos on city property. Therefore, the Chamber of Commerce logo would not be allowed within the public right-of-way. 3. The project requires the following review, approval and permits: a. Although the sign must be approved by the City Council at a public meeting, staff encourages you to conduct additional public outreach with the community and downtown merchants. Further, review of the sign may need to be coordinated with the city's special projects coordinator, Peder Norby. Prior to the sign permit application submittal; a representative of the city will need to sign the application as owner of the property. Please contact Skip Hammann, Public Works Director, at 760-602-2751. 6. Please consider a simpler sign design that reflects the character and history of the Village. For example, a design that more closely resembles the historical sign ofthe 1930's (as shown on the photo included with your application) would recognize the city's history and could be an iconic feature in the Village. The sign's multiple elements give it a "busy" and distracting appearance. The sign could be simplified by: eliminating extraneous information such as the "Welcome to" and "Village-by-the- Sea" text; integrating accents and art elements into the sign; and removing the city and chamber logos from the truss. If the sign is redesigned please submit a rendering to the Planning Division for city staff review and comment. 7. Like the sign itself, aesthetic treatment of the supporting structures (truss and poles) is important. The submitted plans lack information as to the pole design (materials, color, etc.). Please consider design elements for the poles themselves, especially at the pedestrian scale, as there will be many people walking by the poles on a daily basis. The supporting poles present a great opportunity tp incorporate interesting design elements such as commemorative plaques, historical information, or public art elements. Whatever their treatment, however, the pole materials must be durable and easily maintainable overtime. 8. Consider installing some type of bird deterrent on the sign, truss and art work to keep birds from sitting/roosting on the structures. 9. You indicted in your application that once installed, the sign would be donated to the city. Please provide a construction cost estimate and an itemized cost estimate to maintain the sign, as its future upkeep will become the city's responsibility. Land Development Engineering; 10. Complete a Storm Water Standards Questionnaire. A right-of-way permit will be required. Right-of-way permits are processed administratively through the Engineering Division. Submit a site plan with your application. Including structural calculations. Plot the foundation dimensions and show that a minimum sidewalk clearance of 4 feet will be maintained. 12. Plot trench and wire route for electrical connection. Plot the location of any needed pedestals, sidewalk repair, asphalt repair, etc. to accommodate the electrical connection. Library & Cultural Arts: 13. The artistic elements that are proposed on the sign must be reviewed by the Carlsbad Arts Commission. The Arts Commission makes recommendations to the City Councii for all works of art to be acquired by the city. The City Council makes the final decision whether to accept a proposed donation or not. Transportation; 14. The proposed height and location of the archway sign meets the vertical clearance and visibility of southbound traffic signal indications from approaching vehicles (see attached traffic signal visibility analysis dated 8/15/13). However, if there are any modifications of the sign size or location the minimum vertical clearance and visibility of traffic signal indications would have to be reviewed again. 15. ADA clearance around the foundation of the poles must be maintained. Urban Place; 16. While the sign does make a bold statement, we feel the placement of the sign would be more appropriate at an entry point to the Village, such as at Pine Avenue and Carlsbad Boulevard or on Carlsbad Village Drive near the freeway. 17. We feel the artwork is not representative of Carlsbad or the Village. 18. The proposed sign does not reflect the historic character of the original sign, though we feel it should say "Carlsbad Village." 19. Other gateway signs in the region do not feature advertising of organizations or companies. The committee was made up of stakeholders, residents, public art professionals, arts commissioners and city staff. The committee included: Tina Schmidt - Chair,Carlsbad Arts Commission; Sherman Deforest, Carlsbad Arts Commissioner; Dana Springs, Interim Executive Director San Diego Commission for Arts & Culture; Michael Stutz, Public Artist; Marty Volla, Village Association Co-chair/ Village Resident; Susan Gutierrez, Carlsbad Historian. City staff supporting the committee included: Vincent Kitch, Cultural Arts Manager; Karen McGuire, Cannon Art Gallery Curator; Bryan Jones, Engineering Manager; Peder Norby, Special Project Consultant; and Pam Drew, City Planner. The committee was given background on the sign donation proposal and instructions regarding the artwork donation process and their role. The committee was provided with plans and large scale images ofthe proposal. The committee discussion included artistic and aesthetic elements, design of the sign, construction materials, and historical significance. They acknowledged the generous donation of funding by TaylorMade Golf and noted the support of Chamber of Commerce for their pride in the city and their continued efforts to highlight the great aspects of Carlsbad. The committee appreciated the idea of a sign to highlight the Village and act as a potential way-finding for city residents and visitors. Recommendation: The Public Art Advisory Committee recommended the city thank the Carlsbad Chamber of Commerce and TaylorMade Golf, and see if they would consider funding a redesign of the sign and an open call for an artist to create a sign unique to the City of Carlsbad and consider relocating the sign to a more appropriate location where it could function more as way-finding for the Village. Action Taken: The committee voted unanimously not to recommend the sign design proposal as submitted. In addition, the committee considered a second motion related to the Carlsbad sign proposal without inclusion of the bronze Wyland dolphin element and that motion was also unanimously rejected. It is part of a series of portholes available. One committee member reported seeing this design available on the Home Shopping Network. • The committee is also concerned that Wyland would not be willing to give up copyright to the work which could cause legal issues in the future should the city want to move or decommission the sign. • The dolphin is done in bas-relief or low relief sculpture which is a very difficult process to get a correct rendering of an animal, face-forward, like this dolphin is depicted. • The rendering of the dolphin looks incorrect and inaccurate and may not look good from a distance. • Other comments regarding the dolphin included: parrot-like, comical, cartoonish, not sophisticated enough for Carlsbad, not representative of a real dolphin, tacky. Appropriateness to Carlsbad- • The work is not specific to Carlsbad. Artwork in the city should be unique to the city. • Carlsbad has no port or shipyard so a porthole is irrelevant. • The work is not site specific to Carlsbad or the proposed location. • Members of committee believe that the city should accept unique works, not reproductions or works from a series of commercial works. • This type of sign has a tendency to be photographed extensively and may become iconic for Carlsbad. They are concemed that the dolphin would become the ad hoc mascot of the city. • A corporate commercial symbol would not be a good identifier for the City. Materials- • Bronze is a poor choice for this application. Bronze in this location may need to be cleaned and waxed every six months. Access to the bronze elements of the sign would be very difficult and costiy to maintain. • Bronze leaches as it patinas. The bronze dolphin would bleed onto the other parts ofthe sign leaving unsightly streaks and stains. The design of the sign- • The design of the overall signs fails on aesthetic quality. It has little or no artistic merit. • The metal cross bars seem to be out of scale. It is too big and across too large of a roadway. • The design ofthe sign is somewhat retro. Members of the committee think of Carlsbad as forward thinking. • It is unoriginal; just copying other cities. • The seals for the chamber and city on the poles are out of scale and much too large. The appropriateness of the location- • As proposed the sign does not act as a way-finder into the city or the village. • Carlsbad Village is moving away fi-om the automotive focus and embracing pedestrians and bicycles but this sign is more appropriate for motorists. • Members did not like the visual clutter this sign causes in this intersection. Mike Howes, a member of the Executive Board of Directors ofthe Carlsbad Chamber of Commerce, read a letter prepared for the commission by Ted Owen, President and CEO of the Carlsbad Chamber of Commerce thanking the commission and the advisory panel for their work on the project arid indicating the Chamber was evaluating its options before making a decision on how to proceed. CULTURAL ARTS MANAGER'S REPORT Cultural Arts Manager Vincent Kitch updated the Commission on the following items: « Nearly 400 people attended the Opening-Reception for the "2013 Invitational Exhibition" at the William D. Cannon Art Gallery. 48 works of art by five diffei-ent artists are on display. Family Open Studios was held Saturday, November 23^'' with over 200 people attending. • Fire Station #3 public art renderings were presented and approved by City Council. • The RFOfor the Round-About/Coastal Rail Trail public art projiect closed and 86 responses were received. The artist will be chosen next week from fjve finalists. • Kevin Kelso is working on details of his donation proposal for Fire Station ttl and hopes to bring it back for consideration at the January meeting. • The Arts Education Advisory Committee has been suspended. Attendance by arts education teachers has decreased recently and the Arts Office is looking at other areas of focus in arts education. o Manager Kitch attended the SO Regional Arts and Culture Coalition meeting with Commissioner Johnson. • A new exhibition is open in the Sculpture Garden and a new partnership established with Carlsbad OCeanside Arts League to show local artists' works in the Cultural Arts Office. The Arts Office will partner with other local artist organizations in future months. • New Arts Commissioner Scott White was introduced, FRIENDS OF THE ARTS REPORT • The Meet and Greet event at the Museum of Making Music was well attended. • The Friends ofthe Arts leadership is preparing the budget and other details forthe annual meeting to be held in January, 2014. • The website has successfully accepted online payments for membership to the non- profit. S'^ meeting, the Carlsbad Arts Commission considered the Carlsbad sign proposed as a donation to the city by the Carlsbad Chamber of Commerce and TaylorMade Golf. The Commission voted unanimously to reject the proposed donation. This action was taken in accordance with the Arts Commission's established artwork donation policies and procedures. Background • The city received a proposal for a Carlsbad sign from the Carlsbad Chamber of Commerce to be located at the intersection of Carlsbad Blvd. and Carlsbad Village Drive. • The proposal incorporated artistic and aesthetic elements including an artwork by the artist Wyland. • The proposal was forwarded to the Cultural Arts Office for review by the Arts Commission. • Under Carlsbad Municipal Code 2.18.100 the Arts Commission's role is to ". . . (8) Recommend to City Council all works of art to be acquired by the city, either by purchase, gift or otherwise, and their proposed locations. (9) Recommend to City Council regarding the conservation, restoration, relocation or disposition of works of art in the city's possession". (Ord. No. CS-124, § 11, 4-5-2011) Artwork Donation Review and Approval • The process for the consideration of donated works of art is outlined in the Donation of Art Policies (rev 7/24/12) as adopted by the Arts Commission. • The policy outlines the review and approval of donated works of art which include: establishment of an advisory committee; review of the proposal by the advisory committee based on criteria including aesthetic quality, professional credentials, suitability, maintenance, feasibility, appropriateness of site and maintenance; and referral of the advisory committee findings and recommendations to the Arts Commission for review and determination. • In the event the Arts Commission rejects a donation offer, it is returned to the donor and not recommended to Council for consideration. Under the policies governing donated artworks, there is no process for appeal of the Arts Commission's action rejecting the current proposal. CMC 1.20.600 does provide an appeals process as follows: "Where no specific appeals procedure exists for any decision of a commission, committee or person which substantially affects the rights, duties or privileges of an aggrieved person, such decision may be appealed to the city council by filing a written notice of appeal with the city clerk within ten calendar days of the date of the decision." With a design rooted in the past and with a dear vision to the fulure, the sign, proposed near the intersection of Carlsbad Boulevard and Carlsbad Village Drive features a simple, clean design reminiscent of a historic welcome m3rl<er that stood near the location in the 1930s, That sign was erected by the Chamber (during a brief period immediately after the Great Depression in which it renamed itself as the Carisbad Community Improvement Club}. As an added feature, renowned maritime artist Wyland has created a 5-foot tall dolphin casting, a feature that will delight children and pay tribute to the important role that Carlsbad's seaside setting has played in its role as one of the jewels of San Diego County. "Oarlene the Dolphin," as the sea mammal has been affectionately named, is a nod to the era of the '20s and '50s, which are said to be the heyday of the historic U.S. Highway 101, along which Carlsbad Boulevard sits. During those times, the most iconic spots along the route were playful, such as Noah's Ark, a restaurant that was on Ponto Beach that featured several different animals cut of wood on the hillside wilh reflective eyes. The dolphin casting, which will be forged from a durable material, will be illuminated by LED lights al night. The welcome sign project is the brainchild of Carlton Lund, the chamber's chairman of the board. The project became possible when the City of Carlsbad amended its sign ordinance earlier this year. The design and construction of the sign is being paid for by a grant from the TaylorMade Golf Company. "Our proposed sign would recognize the symbiotic relationship that exists between the business community, the city, its residents and the tourists that grace us with their presence year after year," Lund said. "This is a space of historical significance to the city, and its deserves a top-of-the-line marker." The Chamber has submitted its plans to the city, and will make a presentation to the City Arts Committee, which serves as an advisory panel to the City Council, which is responsible for a final determination on the project. One last kudo for the road Since the i>lovember and Decem- ber editions of the Carlsbad Busi- ness Journal are combined in this issue, and my term as chairman ends at the end of the year, this is my last Kudos column. 1 just want to say that it* been great spotlighting all of the posi- tive accomplishments that our members have reached during my two-year tenure. When you pick up the next issue, in January of 2014, you'll get to hear from John Osborne, director of external affairs of ATST, who will step up to be -the chairman of the board. I look forward to hearing from him I This column has always been about focusing on the positive things that our chamber mem- bers are doing. I've always said that what I want to do B shine the spotlight on others. With this being the last of my columns, however, I'd like to take the opportunity to shine the spot-light on a prr^ect that is very dear to me — one that I've been work- ing on for nearly 13 years: putting up a welcome sign in Carlsbad — one that will add to all of the great landmarks that our betoved community already has. Wrth this being the 90th anni- vetsaiy of the Carbbad Chamber of Commerce, I think the time B right to pursue this project, a meaningful one that will have a lasting effect on the City of Carlsbad for years to come. Recently, I brought my vision to the board of the Carlsbad Cham- ber of Commerce and they've agreed to take it on as a project. The Chamber has submitted the plans to the City of Carlsbad for its consideration. In the months ahead, this proposal will make its way through the city* official pro- cess, and 1 hope that it has your support. In 1938, this Chamber (which briefly changed its name to the Carlsbad Community Improvement Club) was getting over the effects of the Qreat Depresskjn and some members got together to put up a sign along U.S. Route 101 on the southerrvpart of town. This lighted sign, WKhich could be seen for miles around, was located near the site where this proposal is — near the Intersection of Carlsbad Boulevard and Carlsbad Village Drive. My vision for this new project is for a design that pays tribute to that project and Its classy vibe and updates tt with a playful design that will add to the sign's appeal. I'm good friends with noted sealif e artist Wyland — 1 sit on the board of his foundation — and I approached him about aeat- ing a 5-foot porthole casting of a dolphin that will be on the top of the sign, lifted by the letters in the world "Carlsbad." Wyland has agreed to let us use the design, which I've named Darlene after Wyland's mother. Wyland Is well known for his love of marine life, his lifelike depk:- tions of whales, dolphins, sting- rays and other magnificent crea- tures. I know that Carlsbad, with its proximity to the great Pacific Ocean, has a strong Interest In the sea and in environmental conserva- tion. All of these combined inter- ests make Wyland's art a perfect symbol for our community. Thinking about the future, I've seen children — Including my own grandchildren — react to Darlene very positively, and I can tell you know that this is a veiy powerful image. My hope 'B that the sign one day becomes an icon of Carlsbad. 1 can pcture it on postcanjs, cn family vacation photos from those who come and visit our tovely c'rty every yearl I can picture our youngest of visitors begging their parents to stop and take a photo witti Oarlene, and Wyland aficionados coming to the area, the way that his most well-known series of whale murals drew fans from all over to the places where they were painted. It will be a distinguishing landmark of our city — broadcast on TV wtienever nationally-televised events take place in Carlsbad. When history books are written about our dty, the sign might be prominently displayedl It takes a lot of people to bring this to reality, so I want to give KUDOS to all of those who have helped witti this endeavor. In 2001, the project was denied because archways were not pemiitted downtown. Eventually when that hurdle was remedied, funds for the $225,000 sign were hard to come by. But Lund, the chairman of Carlsbad's Chamber of Commerce, believed in the sign. "When people come to town and actually see what (the city) is, it's incredible. The error was due to a miscalculation of the tax rate assessed for Proposition AA, according to the district. Last year, Proposition AA, a $449 million bond, barely passed. To pay for the measure, during the campaign, the district said property tax bills would go up by no more than $25 per $100,000 of assessed home value. However, 70,000 prop- erty owners in the district were charged $37 per $100,000 of assessed home value on their bills, result- ing in an average property tax bill $100 higher than it should be, according to Michael Workman, a spokesman with the coun- ty- On Monday, Workman noted that about 4 percent of the property owners have already paid their bill. The San Diego County Treasurer-Tax Collector is looking at options for refunding them. Officials are finalizing instructions for those who haven't paid. One option includes having property owners pay their inaccurate bill and the county reimburs-ing them later. Further instructions will be released online and mailed to those impacted by the error in the next week, Workman said. "We don't have a time- line for refunding them at this time," Workman said. In total the sign is pro- jected to cost $225,000, con- sisting of $175,000 for the design, construction, and installation of the sign and $50,000 for the raw material needed for the sculpture. Wyland has agreed to donate his time creating the piece for free, according to Limd. Lund aspires to build and install the sign at zero cost to the dty. After several slow years of fundraising, be was able to convince Carlsbad's TaylorMade Golf to sponsor the project and pay for the bulk of the costs. Then a few weeks ago, the Carlsbad Chamber of Commerce Board of Directors approved the sign as an official chamber initia- tive. "It's like it's meant to be. All of the stars are alj^ning," Ltmd said. The dty has coiifirmed that it has received a pro- posed Carlsbad sign dona- tion from the Chamber of Commerce. Eric Dill, associate superintendent of the school district, said he's unsure how exactly the error occurred, but added that it will be investigated. "We're focused on mak- ing this righC Bill said. And there has long been talk about building a new sign. Like all good projects some obstacles stood in the way, but come 2014, Carlsbad will once again have an archway sign over Historic Route 101 that will make us proud. "We're on the one-yard line," Chairman Carlton Limd says of the Chamber of Commerce's 13-year effort to erect a new sign. "It's a very classy design. We are a world-class city. We will have a world-class sign by a world-class artist." That artist is Wyland, whose marine-life murals, NOVEMBER/DECEMBER 2013 • CARLSBAD MAGAZINE paintings and sculptures grace so many places aroimd the world where the sea is cherished. He has donated his time and talent to create a dolphin, dubbed Darlene after his mother. "The letters in Carlsbad lift the dolphin," Lund says. There has been no cost to the citizens of Carlsbad except what they were willing to give. Councilman Mark Packard started with a dollar donation and more than $225,000 has been raised. TaylorMade Golf will undei-write the final construction. But if San Diego is "America's Finest City," per- haps Carlsbad could be "America's Kindest City." It is a dream Lund has and he thinks Darlene the Dolphin can help out. In the early 1900s, Coast High- way 101 was the only means to get from Los Angeles to San Diego. If you look closely at the old sign you can see an arrow encouraging motorists to turn left and visit Carlsbad's downtown. no paid parking on city property (the Tamarack Beach lot is state owned) but a solar-powered parking meter will be included with the sign. The parking meter would not be for parking, but to stop a moment and participate in giving back. If you "Feed Darlene," credit card donations go to charity and coins will go to kids through the Carlsbad Charitable Foundation. Lund would Kke to see Carlsbad on record as the kindest city in San Diego and give children in particular an opportunity to be attentive citizens. "If we can teach our children to give back," he says, "we will always be a great America." The sign will be near the same place it was before. with one base on the east side near the historic Schutte Mansion (where the former Ocean House is now) and on the west side by Witt Rowlett's iconic surf shop, Carlsbad Pipelines. How can we be sure of where the old sign was when even some of our longest- living dtizens don't remem- ber it? While the rumors were still flying. Heather Pizzuto, Carlsbad dty library and cultural arts director, put then-History Librarian Susan Gutierrez on what seemed like a cold case. After a few Holmesian twists and turns, the photographic evidence was found and obtained from the dty of Pomona. They had the photographer's whole collection. With the what, the where, the why and the how finally answered, it is now just a matter of when. At liie sign's unveiling, a time capsule will be installed, to be opened by future Carlsbadians. Another thing that will be memorialized by this sign will be the thousands of hours put in by people who love Carlsbad and believed in this project. Carlton Lund on boil He's like a blustery Moses, leaning in like LBJ in full persuasion mode, leading a columnist to the Promised Sign. Imagine! Lund shouts. A cool Art Deco landmark that evokes the dolphins you see from the city's bluffs. Wow! i forgive him his rapture because I remember how unhappy he was 12, 13 years ago. Back in 2001, after Encinitas had erected its historically correct archway sign over 101, Lund was suffering from a near-fatal case of Civic Monument Envy. "Imitation is a sincere form of flattery," he wrote at the time, "and 1 applaud the Encinitas core group that made their sign a reality ! Being an active Carlsbad citizen, I intend to work with the Carlsbad council and propose a similar sign crossing Histonc Coast 101 at Carlsbad Boulevard and Carlsbad Village Drive." Lund was captivated by the notion of every coastal city welcoming visitors with archway signs, a string of pearls. "It's the most important marketing aspect you can have," he said of the landmarks. Back then, Lund thought he had three votes on the council for an Encinitas-style statement. But it was an era when signs of any kind were in bad odor. Lund's proposal ended up getting shot down. To honor its 90th anniversary, the Carlsbad Chamber of Commerce, of which Lund is the chairman, decided in February to resurrect, and Improve upon, Lund's discarded dream. A Chamber team got busy, enlisting potential contractors such as Oceanside-based Federal Heath Sign Company t° develop a CarlsbTd sign with a whimsical addition: Custom artwork by Wyland, the popular marine-theme art.st who^s ^ °f^-r;l^Lund Wyland created a grinning dolphin, named Darlene, popping out of a 5-foot-high porthole. (Some see an echo of Ponto s Noah s Ark, once famous for animal cutouts around the restaurant.) As the final hurdles, legal and political as well as engineering, were being negotiated, Peder Norby a longtime downtown Encinitas consultant, came back to work for his hometown Carlsbad. A Highway 101 champion of the first order, Norby °ved the co cept^ but he had one objection: Carlsbad's sign should reflect the design of the overhead sign that greeted motorists in the 1930s. The city's arts panel is considering the final design. Who knows what the aesthetes will say? But this time Lund is confident the council will be unanimously in favor. Councilman Mark Packard has donated a symbolic dollar. Over the phone. Mayor Matt Hall expressed enthusiastic support. Carlsbad has had its challenges with public art, the doomed "Split Pavilion" being the unforgettably expensive failure of taste. As it happens, Lund led the effort to cut the pipe that made up the detested oceanfront artwork, then selling sections as keepsakes to benefit an education foundation. That's wringing sweet juice out of a lemon. Lund's carbonated fervor is legendary. He long agitated for a Wyland whale mural on the northern wall of the Encina power plant For years the irrepressible Realtor took it upon himself to skate along the coast at dawn to pick up trash and dog poop. (A knee injury has slowed him down recently.) In his rhapsodic view, the archway sign will serve as an ethical as well as a geographical beacon. Grafted to the Chamber's proposal are two solar-powered "Kindness Meters," pretend parking meters in a city without them, that would be installed at the bases of the sign, one on the east and the other on the west side of 101. The idea is to encourage residents and tourists to "Feed Darlene," either with coins or a credit card. The proceeds would go to the Carlsbad Charitable Foundation. Goofy? Maybe. But Lund sees the meters as fountains ofthe milk of human kindness, especially healthy for kids. "If you're cynical," he says with a grin, "and think I'm an (expletive) because I'm kind, I'll kill you with kindness." Ten years ago, Lund was denied his dream by a council that couldn't see the value of recreating the 101's heritage in Carisbad. Today, a city that banks big bucks thanks to tourism would be insane to turn its back on this Chamber gift. It will take about six months to build the sign's components once approval is granted, Lund tells me. It was originally part ofthe Mexican land grant issued to Juan Maria Marron in 1842. The boundaries ofthe current City of Carlsbad were once almost entirely within the borders of this old rancho. My family has witnessed untold changes within the old rancho's bounds and we have seen amazing changes here just in our seven decades. We have, for the most part, been very proud of our developing city, our rich and resplendent history, and our continued sense of community. Unfortunately, we balk at this most recent proposal. While we don't object to the proposed signage welcoming people to the Village, we take umbrage at the cartoon dolphin, "Darlene". Ours is a city of great beauty, with wonderful sights to see, places to go, and things to do. We are blessed with abundant scenic charm. To embrace a carnival-like character to represent us is tasteless and tawdry. This kitschy cartoon version ofthe beautiful dolphin that abound in our coastal waters does a disservice to us and a disservice to these magnificent beasts ofthe sea. The Village Terrace above the Daily News Cafe in the Carlsbad Village filled promptly at 7:30 a.m. on Thursday, Jan. 30 with representatives from the City of Carlsbad, the Carlsbad Chamber of Commerce, local businesses and organizations, local artists and community enthusiasts. After a short introduction by Chamber member and application handler Mike Howes of Howe's Weiler & Associates, some attendees' hands raised high with discontent over what they referred to as a "cartoony" and "silly" image of a smiling dolphin named "Darlene." This image is planned to sit atop the sign. While many showed support for a sign in the Carlsbad Village, some disapproved ofthe image of the dolphin, as well as the "overpowering" size and the cultural significance ofthe sign, but the most interesting displeasure voiced during this community meeting regarded the definition of "art" and the validation of the chosen artist. Robert Wyland, a world-famous artist renowned for painting marine life, is planned to donate the artwork for the center ofthe sign, but many consider Wyland's image not exactly art. "Dolphin Smile Porthole" is a piece Wyland reproduces often. Some categorized it as merchandise — it has been made available on the Home Shopping Network — and upset attendees considered it more Wyland Galleries branding than a unique piece of art. The City of Carlsbad Arts Commission has already denied support for the same reasoning. Concerns immediately filled the room questioning the validation of Wyalnd as a representative of Carlsbad. He is not, nor has he ever been, a resident of Carlsbad. Just as many community members showed their excitement for the sign and their support for Darlene the Dolphin. If approved, the sign design, construction and installation, as well as the dolphin sculpture, will be financed by a generous donation of $225,000 by TaylorMade Golf Of that donation, $50,000 will cover the cost of supplies for the sculpture. The ultimate cost to the City of Carlsbad will be $0. If approved, this sign will become one of the city's most photographed landmarks. A question worth asking is why Wyland was awarded the opportunity to stamp his company branding on the sign? A group of local artists questioned why there was not an open invitation for other artists to submit designs? As a Wyland Foundation member of the board of directors, Lund has pushed for Wyland's artwork in the past. In the late 1990s Lund attempted to persuade the City of Carlsbad to allow Wyland to paint on the northem wall of the Encina Powerplant. The request was denied. Based on their review, the committee voted unanimously not to recommend the sign proposal. While this is an extremely generous offer by both the Chamber of Commerce and vested community business members, I feel that our city should finalize its Master Plan for the Village and Coastal areas before considering proposals for signage that will become an iconic representation of our city. In order to best reflect the direction the city envisions moving towards while truly representing its constituency, it would behoove us to have this collective vision before moving forward on a permanent fixture such as this sign. I do appreciate what I have to assume was Mr. Lund's original idea, that of proposing something that would give our community a stronger individual identity and honor or area's heritage. Both valid pursuits ones that I would like to see more of our citizens step forward with. That said, unfortunately I can not support this proposal and ask that you send it back for rework or just give it a thumbs down period. As a physical designer I like these signs, what I call "Boulevard Banner Signs" if the are done right, fit their setting and are located correctly. I can seethe possibility of an alternate design in otherlocationswithinthe Village where this type of sign may work well. However, the proposed location and design before you is ill-conceived. To the point of heritage, the original 30s sign in Carlsbad, I'm sure, hung over a two lane highway but that is not the case today. That is what these signs are, highway signs whose lettering is meant to be read starting from a distance of a quarter mile away. Due to this fact these signs work best in a linear corridor. This is not the case in our Viilage where the highway does an s-turn. Also we have done all we could to reduce the scale of a very wide highway street by adding a median island and street trees, all of which works well to counter the road's width. This streetscape also narrows a driver's cone of vision reducing the views fon/vard so you will only see this sign once you are right on it. At that point it will appear oversized viewing the superstructure that must now be used to hang the sign overtoday's highway/boulevard. We in Carlsbad are fortunate that our Village has proportion, width and depth, it is not like most other villages along our coast that are linear in form following the highway. Let us all respond correctly to this important fact. We need to reinforce the attributes and character of our Village. This means creating streetscape elements that are in keeping with the term "Village" . Lets do things that are understated not overstated, tasteful and artistic not gimmicky. We made the correct call on reusing the Hubbell sign and will soon have a fine piece of art in our new 'Circus' intel-section (I totally support). These two elements on the Boulevard make the right statement of identity in the Village. Please ask Mr. Lund to, as they say, "go back to the drawing board" on this idea. We the interested citizens and I am sure your new Village consultant will be willing to assist Mr. Lund should he continue to pursue the idea of a sign done well that respects the scale and character ofthe Village. While it is a generous offer by some mfluential local people, the residents of the city should be able to choose what it wants or needs, not just accept something that may not be appropriate. I am recommending that you WAIT until the entire Master Plan for the Village and the coastal areas are developed by the professionals you have hired, and give the commimity more tune to review any sign plans that will identify the Village.
