RECOMMENDED ACTION:
Adopt Resolution No. 2014-130 . for the approval of the City Council's June 3, 2014 approval of sign application
No. PS 13-110, and acceptance of the offer to fabricate, install, and donate to the City of Carlsbad a community
"archway sign" across Carlsbad Boulevard at Carlsbad Village Drive.
ITEM EXPLANATION:
Background:
On October 23, 2013, the applicant submitted a sign permit application (PS 13-110) for the community archway
sign. Carlsbad Municipal Code Chapter 11.44.100 (C.M.C.) allows for way-finding signs designed as archway signs
located over major roads to be approved by resolution of the City Council. TaylorMade Golf Company
("TaylorMade") has offered to donate funds to design, fabricate and install the sign. Upon installation of the sign
the Chamber of Commerce proposes to donate the sign to the City of Carlsbad.
At their June 3, 2014 meeting, the City Council considered the proposed community archway sign, received staffs
report and recommendation, and took public testimony. The City Council voted 4-0 (Mayor Hall recused) to
approve the Carlsbad Archway Sign application with conditions, and directed staff to return at the next available
meeting with a resolution to ratify said approval. The attached resolution of approval (Exhibit 1) reflects the City
Council's action on this item.
FISCAL IMPACT:
There will be no cost to the city for the construction and installation of the sign. Maintenance will be the city's
responsibility however, and is estimated at $5,000 annually. Maintenance costs would be absorbed in the Streets
Division budget.
ENVIRONMENTAL IMPACT:
This project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section
15301(c) - minor alteration of existing facilities, including streets, sidewalks, gutters, and similar facilities involving
negligible or no expansion and Section 15304(f) - minor trenching and backfilling where the surface is restored.

7 The City Council of the City of Carlsbad, California, does hereby resolve as follows:
8 WHEREAS, pursuant to Title 11, Chapter 11.44.100 B.3., way-finding signs
^ designed as archway signs located over major roads within the city may be allowed if approved
by resolution ofthe City Council; and
WHEREAS, the applicant, the Chamber of Commerce, submitted a sign permit
application on October 23, 2013 for an archway sign to be located within the public right-of-way
on Carlsbad Boulevard, just north ofthe intersection of Carlsbad Village Drive; and
15 WHEREAS, TaylorMade Golf Company ("TaylorMade") has offered to donate
16 funds to the Chamber of Commerce to design, fabricate and install the sign; and
1^ WHEREAS, upon installation of the sign the Chamber of Commerce proposes to
donate the sign to the City of Carlsbad; and
WHEREAS, the approval of a sign application and the donation of the Carlsbad
archway sign was heard at its June 3, 2014 meeting; and
WHEREAS staff recommended denying the sign application No. PS 13-110, and

23 declining the offer to fabricate, install, and donate to the City of Carlsbad a community "archway
24 sign" across Carlsbad Boulevard at Carlsbad Village Drive; and
25 WHEREAS, the City Council found the archway sign replicates a historical sign that
26
was installed on Carlsbad Boulevard in 1938, reflects the small town feel of the Village, and
27
represents a sense of place; and

WHEREAS, the City Council voted 4-0 (Mayor Hall recused) to approve the
Carlsbad Archway Sign application with modifications; and
NOW, THERFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
6 1. That the above recitations are true and correct.
1 2. That, on behalf of the City of Carlsbad, the City Council wishes to express
its appreciation to the Carlsbad Chamber of Commerce and TaylorMade Golf Company for their
generous offer of donation ofthe proposed Carlsbad Archway Sign.
3. That, for the reasons stated in the recitations above, sign application PS
13-110 is hereby approved and the offers of donation shall be deemed accepted by the city upon

23 installation of the sign.
14 Conditions
15 1. Prior to the installation ofthe donation plaque, TaylorMade Golf Company shall enter into
a Corporate Marketing Partnership Agreement with the city, per City Council Policy No.
79. The Agreement would be subject to the approval of the City Council at a futu-"^

18 2. All lighting shall be designed to avoid any impacts on adjacent residential homes

The time within which judicial review of this decision must be sought is governed
21 by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of
Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking review
22 must be filed in the appropriate court not later than the ninetieth day following the date on which
this decision becomes final; however, if within ten days afterthe decision becomes final a request
for the record is filed with a deposit in an amount sufficient to cover the estimated cost or
24 preparation of such record, the time within which such petition may be filed in court is extended
to not later than the thirtieth day following the date on which the record is either personally
25 delivered or mailed to the party, or his attorney of record, if he has one. A written request for
the preparation ofthe record ofthe proceedings shall be filed with the City Clerk, City of Carlsbad,
