D—Z.^—1 Library & CITY'S PUBLIC ART COLLECTION CITY MGR. m Cultural Arts RECOMMENDED ACTION: Adopt Resolution 2014-143 to deaccession Raul Guerrero's artwork entitled "Message in a Bottle" from the City's Public Art Collection. ITEM EXPLANATION; The artwork by Raul Guerrero entitled "Message in a Bottle" is a site specific piece located on Carlsbad Blvd. between Sycamore and Chestnut. The artwork is a concrete bench with mosaic tiles. The bench was a component ofthe third annual temporary art exhibition of 1990, identified by the Arts Commission and was purchased for $2,500.00 as a permanent work for the city's public art collection August 28,1990 (Resolution 90-329). In 2008, the city's public art collection was documented and reviewed by professional art conservators who noted needed repairs to the bench, estimated at that time at $4,800.00. For several years the piece has deteriorated despite repair efforts by city staff. The overall structural integrity ofthe bench is now such that repairs are not sustainable. Staff received a recent estimate from the artist of $7,000.00 for needed repairs/replacement. Following the Arts Commission's public art program guidelines, staff has recommended that the work be deaccessioned - that is, permanently removed from display and from the city's public art collection - for the following reasons: 1. The artwork in its current condition no longer represents the artist's originally intended work as it was accessioned into the collection. 2. The cost to repair and restore the work, coupled with the cost of its ongoing maintenance, is excessive in relation to the original cost ofthe work. 3. The structural integrity of the bench is no longer viable and poses a safety risk to the public. On May 1, 2014, the Arts Commission voted unanimously, 5-0, to accept the staff recommendation to deaccession Raul Guerrero's artwork entitled "Message in the Bottle" from the city's public art collection and to send its recommendation forward to the City Council. Removal of the artwork will be coordinated by staff of the Parks & Recreation Department. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review.
