RECOMMENDED ACTION:
Adopt Resolution No. 2014-153 awarding the contract for the Northwest Quadrant Storm Drain
Improvement Program and Concrete Repair Program in the amount of $327,999.90 (Basswood Avenue and
James Drive), Project Nos. 6608 and 6013.
ITEM EXPLANATION:
The Northwest Quadrant Storm Drain improvement Program is a multi-year program to address non-
master drainage plan needs within the northwest quadrant of the city. City of Carlsbad Operations and
Maintenance staff was interviewed regarding their field observations and knowledge of drainage issues
throughout the northwest quadrant. Site locations were identified and prioritized based on
recommendations from field observations. The projects in the program and their status are listed on
Exhibit 3 for reference.
The improvements included in this segment are construction of curb inlets, storm drain cleanouts, storm
drain pipeline, cross-gutter, and sidewalk repairs. The improvements also include overlay of one half of
Basswood Avenue and a portion of James Drive.
On February 25, 2014, the City Council adopted Resolution No. 2014-029, which approved the plans and
specifications and authorized the advertisement for bids for the Northwest Quadrant Storm Drain
Program and Concrete Repair Program (Basswood Avenue and James Drive), Project Nos. 6608 and
6013. Plans and specifications are on file in the Public Works Department of the City of Carlsbad. On
April 17, 2014, eleven (11) sealed bids were received, opened and witnessed forthe construction of this
project as shown in the following Table 1.

The apparent low bidder at the bid opening was Vailston Company Inc. with a bid total of $304,132.78.
Vailston Company Inc. made a material error within the bid documents by incorrectly filling out the
Designation of Subcontractor Form. Contractors are allowed 24 hours after the bid opening to submit the
form. A properly completed form was not submitted during that time. Burtech Pipeline is the confirmed
low bidder and their bid documents are responsive.
Staff recommends awarding the contract to the lowest responsive bidder, Burtech Pipeline for the
construction of Northwest Quadrant Storm Drain Program and Concrete Repair Program (Basswood
Avenue and James Drive), Project Nos. 6608 and 6013.
FISCAL IMPACT:
Table 2 shows the current status of the Northwest Quadrant Storm Drain Improvement Program and
Concrete Repair Program. More specifically, the current status ofthe programs shows the expenditures
of previously completed storm drain improvements and the funds available to complete the projects in
Basswood Avenue and James Drive.

The project is funded by Gas Tax Funds which require payment of prevailing wages. Sufficient funds are
available for the project. No additional appropriation is required.
Staff recommends to Council awarding the contract to Burtech Pipeline for the construction of
Northwest Quadrant Storm Drain Improvement Program and Concrete Repair Program (Basswood
Avenue and James Drive), Project Nos. 6608 and 6013.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15301(b), concerning operation, repair and maintenance of existing facilities of both investor
and publicly owned utilities used to provide public utility services.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
8 necessary, desirable, and in the public interest to construct the Northwest Quadrant Storm
^ Drain Improvement Program and Concrete Repair Program (Basswood Avenue and James
Drive), Project Nos. 6608 and 6013; and

WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
12
equipment, transportation, and other expenses necessary or incidental of said project have
14 been prepared and are on file in the City of Carlsbad and are incorporated by reference herein;
15 and
16 WHEREAS, this project is exempt from environmental review per CEQA Section
17
15301(b), concerning operation repair and maintenance for existing facilities of both investor
and publicly owned utilities used provide public utility services; and
WHEREAS, on February 25, 2014, the City Council adopted Resolution No. 2014-029,
21 which approved the plans and specifications and authorized the advertisement for bids for the
22 Northwest Quadrant Storm Drain Program and Concrete Repair Program (Basswood Avenue
and james Drive), Project Nos. 6608 and 6013; and
WHEREAS, on April 17, 2014, 11 sealed bids were received, opened and witnessed for
the construction of this project; and
1 WHEREAS, the lowest responsive and responsible bid to construct said project was
2 submitted by Burtech Pipeline in the total amount of $327,999.90; and
WHEREAS, Section 3.28.040 (c)(5) of the Carlsbad Municipal Code authorizes the city

manager to approve change orders in the amount up to $50,000 for Project No. 6608 and
5
$2,000 for Project No. 6013.

7 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
8 California, as follows:
^ 1. That the above recitations are true and correct.
2. That the bid in the amount of $327,999.90 submitted by Burtech Pipeline for the
construction of Northwest Quadrant Storm Drain Program and Concrete Repair Program
(Basswood Avenue and James Drive), Project Nos. 6608 and 6013 is accepted and the Mayor is
14 hereby authorized to execute the contract with Burtech Pipeline.
15 3. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
17
insurance policies, as described in the contract, within twenty (20) days of adoption of this
18
resolution. The City Manager may grant reasonable extensions of time.
