CITY MGR. 1^ RECOMMENDED ACTION: Adopt Resolution No. 2014-158 authorizing the settlement claim of Karl Kettler. ITEM EXPLANATION; The claimant was a Street Maintenance Worker II with the Public Works Department. Mr. Kettler sustained a work-related injury on August 22, 2012 resulting in a permanent disability. The terms and conditions ofthe proposed settlement are set forth in the Compromise and Release (on file in the Human Resources Department). The terms and conditions were agreed upon by the claimant and the City, and have been recommended by Keenan & Associates, the City's Third Party Administrator. FISCAL IMPACT: The cost ofthe settlement is $75,000. There are sufficient funds available in the Workers' Compensation Self-Insurance Fund to cover the cost of this settlement. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonable foreseeable indirect physical change in the environment; and therefore, does not require environmental review. That the above recitations are true and correct. 2. That the expenditure of $75,000 from the Workers' Compensation self-insurance fund is authorized for the settlement of said claim. 3.
