RECOMMENDED ACTION;
Adopt Resolution No. 2014-184 accepting bids and authorizing the mayor to award a contract for
the construction of Fire Station No. 3, located at 3465 Trailblazer Way, Project No. 4003.
ITEM EXPLANATION:
The proposed Fire Station No. 3 is planned to replace an existing fire station on the northeast corner of
Chestnut Avenue and Catalina Drive at 3701 Catalina Drive. The new fire station will be located at
Cannon Road and Wind Trail Way at 3465 Trailblazer Way and will be 10,400 square feet including a
three bay, double deep, apparatus room, office and administrative spaces, dormitories, shower and
locker facilities (men's and women's), kitchen, dining room, shop and equipment support spaces. Site
features include perimeter fencing, an emergency generator, rolling security gate, landscaping and
concrete paving. Off-site work includes a new cul-de-sac street together with associated storm drain and
utility improvements.
On August 23, 2011, the Carisbad City Council approved an agreement with WLC Architects to perform
the preliminary design, final design, plan and specification preparation, and bid assistance services for
Fire Station No. 3. Plans and specifications have been completed and are on file in the Engineering
Department for the construction of Fire Station No. 3.
On July 8, 2014, the City received 3 sealed bids for the construction of Fire Station No. 3 which are
summarized in Table 1:

staff has completed their review of the bid documents submitted by the low bidder, Keeton, and found
them to be in order. Staff recommends that the Council award the contract for the construction of Fire
Station No. 3 to Keeton in the amount of $5,817,000, which is the total ofthe base bid and alternate bid
item. The architect's estimate for the combined base bid and alternate bid item for the construction of
the project was $6,600,000.
The second lowest bidder has issued a protest regarding the validity of the lowest bidder's Bid Bond.
The City Attorney's office reviewed the Bid Bond and has deemed the Bond to be enforceable.
ENVIRONMENTAL IMPACT:
On November 21, 2012, the Planning Commission adopted Resolution No. 6929 adopting a Negative
Declaration (ND) and approved Resolution No. 6930 approving Conditional Use Permit CUP 12-07 for
Carlsbad Fire Station No. 3. Furthermore, pursuant to Public Resources Code Section 21065, accepting
bids and authorizing the award of a contract for construction of the fire station does not constitute a
"project" within the meaning of the California Environmental Quality Act (CEQA) in that it has no
potential to cause either a direct physical change in the environment, or a reasonably foreseeable
indirect physical change in the environment, and therefore does not require environmental review.
FISCAL IMPACT:
Table 1 shows the project cost for Fire Station No. 3 with the understanding that payment of prevailing
wages is not required. Fire Station No. 3 is funded with $8,352,000 from the Public Facilities Fees Fund.
This project has been previously appropriated in full and no additional appropriation is required.

The preliminary estimated annual maintenance and operating budget for the new Fire Station No. 3 is
projected to cost an additional $8,000 per year when compared to the current annual operating costs of
the existing Fire Station No. 3. No additional salaries, benefits or training will be required to staff the
facility. This represents an $8,000 yearly net increase to the city's General Fund operating budget in
order to operate and maintain the new Fire Station No. 3.

CAUFORNIA, ACCEPTING BIDS AND EXECUTING A CONTRACT
FOR FIRE STATION NO. 3, LOCATED AT 3465 TRAILBLAZER WAY,
4 PROJECT NO. 4003.

^ WHEREAS, Fire Station No. 3 is necessary to meet the standards of coverage for fire
protection within the City of Carlsbad; and

WHEREAS, Public Contract Code ("PCC") §20101 authorizes cities to pre-qualify
9
contractors who wish to bid on public works contracts; and authorizes staff to release
11 invitations to bid to the qualified contractors; and
12 WHEREAS, city staff prequalified six contractors to submit bids for the Fire Station No. 3
project in accordance with PCC §20101; and
WHEREAS, on December 17, 2013, through Resolution No. 2013-291 the City Council of
the City of Carisbad approved the plans and specifications for furnishing of all labor, materials,
tools, equipment, transportation, and other expenses necessary or incidental to Fire Station No.
18 3, Project No. 4003, and
19 WHEREAS, three (3) sealed bids were received on July 8, 2014 by the City of Carlsbad for
the construction of Fire Station No. 3, Project 4003, and
WHEREAS, the lowest responsible bid for the project was submitted by Keeton, in the
amount of $5,817,000; and

24 WHEREAS, funding for said project has previously been appropriated from the Public
25 Facility Fees in the amount of $8,352,000 to cover remaining project costs and is sufficient; and
26 WHEREAS, payment of prevailing wages will not be required as part of the construction
contract.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad,
2 California, as follows:

1. That the above recitations are true and correct.

2. That the bid amount of $5,817,000 submitted by Keeton for the construction of

Fire Station No. 3, is accepted and the City Manager is hereby authorized to execute a contract
6
7 with Keeton.
8 3. That the City Manager is hereby authorized to approve construction change
orders up to $581,700 for Project 4003.
4. That the award of this contract is contingent upon Keeton executing the required
contract and submitting the required bonds and insurance policies, as described in the contract
within twenty (20) days of adoption of the resolution with the understanding that the City
