RECOMMENDED ACTION
Adopt Resolution No. 2014-192 authorizing the City Manager to negotiate and execute a
temporary parking agreement with the Aviara Residence Club Owner's Association to use the
Hawthorne site (2065 Camino Vida Roble) for a period not to exceed one year.
ITEM EXPLANATION:
The Aviara Residence Club Owner's Association (Aviara) is in need of temporary parking for
its employees. The employees are currently parking on city streets which has caused
concerns in the impacted neighborhood. The city owns property at 2065 Camino Vida Roble
(commonly known as the Hawthorne Property) that can be utilized for temporary purposes.
City staff is currently negotiating a lease agreement with Aviara for a monthly rental with a
term not to exceed one year. The lease will be for the market rate for a property of similar
size and put to a similar use. Negotiations have not been completed at the time of the
publication of this Agenda Bill. As time is of the essence for Aviara, the City Manager
requests authorization to complete the negotiations and sign the lease with the City
Attorney's approval as to form. Aviara is concurrently pursuing a permanent parking solution
for the site.
Prior to use of the property, the applicant will be required to meet the City's insurance
requirements and obtain a Minor Conditional Use Permit.
FISCAL IMPACT:
It is anticipated that the city will receive revenue at the market rate for the temporary use of
the property.

ENVIRONMENTAL IMPACT:
The proposed action is exempt from the California Environmental Quality Act (CEQA) per
State CEQA guidelines 15301 - Existing Facilities. Section 15301 exempts the leasing of
property involving negligible or no expansion of use beyond that existing at the time of the
lead agency's determination.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A TEMPORARY
PARKING AGREEMENT WITH AVIARA RESIDENCE CLUB
OWNER'S ASSOCIATION TO USE THE HAWTHORNE SITE
(2065 CAMINO VIDA ROBLE) FOR A PERIOD NOT TO EXCEED
ONE YEAR
WHEREAS, the Aviara Residence Club Owner's Association (Aviara) is in need of
temporary parking for its employees; and
WHEREAS, its employees are currently parking on residential streets and
impacting neighborhoods; and
WHEREAS, city staff has identified city owned property located at 2065 Camino
Vida Roble as being appropriate for such use; and
WHEREAS, city staff is currently in negotiations for a lease for said property at fair
market value for temporary parking; and
WHEREAS, negotiations may not be concluded prior to the City Council meeting of
July 22; and
WHEREAS, Aviara has an immediate need for the temporary parking; and
WHEREAS, the City Manager seeks approval from the council to execute the lease
agreement on behalf of the city provided the term does not exceed one year, the lease payment
will be at fair market value for such use and the City Attorney approves the lease agreement as to
form; and
WHEREAS, Aviara is concurrently seeking a permanent parking plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. The City Manager is hereby authorized to execute the lease agreement with the
Aviara Residence Club Owner's Association for a term not to exceed one year
