CED ADOPTION OF A RESOLUTION APPROVING AN AMENDMENT TO THE VILLAGE MASTER PLAN (MP 12-01(6)) AND DESIGN MANUAL TO ALLOW WINERIES AS A PROVISIONAL USE WITHIN DISTRICTS 5 & 6 AND TO ADD SPECIAL PROVISIONAL USE STANDARDS FOR WINERIES CITY MANAGER RECOMMENDED ACTION: That the City Council hold a public hearing and adopt Resolution No. 2014-195 approving an amendment to the Village Master Plan and Design Manual (MP 12-01(B)) to allow wineries as a provisional use within Districts 5 and 6 and to add special provisional use standards for wineries. ITEM EXPLANATION: Project Planning Commission City Council MP 12-01(B) RA X RA = Recommended approval X = Final city decision-mal<ing authority This is an applicant-proposed amendment to the Village Master Plan and Design Manual that would allow wineries as a provisional use within Districts 5 and 6 of the Village Review zone. If approved by City Council, revisions would be effective immediately. In January of 2013, a Village Master Plan amendment allowed wineries as a permitted use in Districts 1 through 3. Currently, alcohol sales with wine tasting are allowed as a permitted use in District 5, and as a provisional use in District 6. Approval of the proposed amendment would allow for the production on wine on site. On June 18, 2014, the Planning Commission recommended approval, voting 3-1 (Commissioner Anderson voting no; Commissioners Black and Scully absent). Six speakers gave public testimony. Four speakers spoke in opposition to the amendment, and two speakers spoke in support ofthe amendment. The speakers in opposition raised concerns regarding potential odor, traffic, parking, and land use compatibility impacts associated with allowing alcohol uses in a residential area (District 5), and that District 6 is more appropriate for wineries. Those speaking in support of the amendments discussed how wineries could help establish a connection between the core of the Village and the residential Barrio neighborhood and that traffic in the area can be attributed to growth in the surrounding areas, not just the commercial uses in District 5 of the Village Review zone. In response to the resident concerns, the Planning Commission added two items to the provisional use "Location and Development Criteria," shown in Attachment "B" to Planning Commission Resolution No. 7060. FISCAL IMPACT: Processing the proposed changes has involved normal costs associated with staff time, public noticing, and hearing which will be offset by fees charged to the applicant. If approved, the Master Plan revisions may stimulate economic activity in the Village through new development and uses and increased foot traffic. ENVIRONMENTAL IMPACT: Carlsbad Municipal Code Section 19.04.070 A.(c)(l) states "minor zone or municipal code amendments that do not involve physical modifications, lead to physical improvements beyond those typically exempt, or which refine or clarify existing land use standards" are specific actions considered not to have a significant effect on the environment. The proposed revisions to the Master Plan are similar to minor Zoning Ordinance amendments and therefore are exempt from environmental analysis. The proposed changes would lead to development typically found exempt from environmental review. Wineries would typically be exempt from environmental analysis because in most cases, they locate within an existing building that is repurposed where minor improvements to the interior and exterior of the building are made. Such projects are exempt pursuant to CEQA Guidelines Section 15301 "Existing Facilities." A Notice of Exemption will be filed by the City Planner upon final project approval. EXHIBITS: 1. Districts 5 and 6 are within walking distance to the core of the Village, visitor serving uses such as hotels and restaurants, and residential neighborhoods. 2. The proposed amendment satisfies the goals and objectives of the Village Master Plan and Design Manual, including those listed below. The proposed amendment implements Master Plan policies by encouraging new commercial uses. 11 a. Goal 1 - Establish Carlsbad Village as a quality shopping, working, and living environment, b. Objective 1.3 - Attract additional tourist-serving uses. 12 c. Objective 1.9 - Provide a variety of commercial, tourism, and recreation activity, especially close to the beach, in conjunction with special entertainment facilities, restaurants and 13 other uses which will foster a village concept and not detrimentally impact residential usage. 14 Allowing wineries as a provisional use in Districts 5 and 6 will further improve the Village as a 15 shopping and tourist destination for both residents and visitors. The wineries will complement the existing restaurants and hotels by providing a unique wine tasting experience that 1^ otherwise occurs in more rural settings. The potential impacts to residential uses can be avoided in that special provisional use standards for wineries are proposed to ensure compatibility with surrounding residential uses and by allowing wineries as a provisional use where they can be conditioned to be compatible with nearby residential uses or denied because they are not located or designed to be compatible 17 18 19 3. Consideration 1. Wineries could have the potential of creating noise, odor or aesthetic problems for nearby residential uses during the production process. Location and Devetopment Criteria 1. Wineries shall not be located where they are likely to adversely impact residential uses. 2. Deliveries of grapes should not occur during hours that would negatively impact residents within the vicinity of the winery's location. 3. Facades shall be treated in a similar manner to other storefronts and should be designed with a Village character. 4. Surrounding grounds, including parking areas, shall be maintained in a neat and orderly condition at all times. 5. Any equipment associated with wine production shall be screened from public view and adequately buffered from adjacent residential uses to mitigate noise, odor or aesthetic impacts. 6. Refuse, including grape stems, shall be removed from the winery site within 24 hours of the de- stemming process. 7. Outdoor wine fermentation tanks shall be installed with a filter to reduce the odor emanating from the winery site. Findings - In order for this use to receive a Village Review Permit, it should be consistent with the following findings: 1. The winery will not have a negative impact on Village residents. 2. The exterior design of the facility and signage are appropriate to the Village and compatible with adjacent uses. AGENDA OF: June 18, 2014 Application complete date: April 1, 2014 Project Planner: Austin Silva Project Engineer: N/A SUBJECT: MP 12-01(B) - VILLAGE MASTER PLAN CHANGES - A request to recommend approval of an applicant-proposed amendment to the Village Master Plan and Design Manual. The amendment is proposed to allow wineries as a provisional use within Districts 5 and 6 of the Master Plan and to add special provisional use standards for wineries to the plan. The City Planner has determined that the proposed amendments do not have a significant impact on the environment pursuant to Carlsbad Municipal Code Section 19.04.070 A.c.(l), which states "minor zone or municipal code amendments that do not involve physical modifications, lead to physical improvements beyond those typically exempt, or which refine or clarify existing land use standards" are specific actions considered not to have a significant effect on the environment. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 7060 RECOMMENDING APPROVAL of MP 12-01(B) based on the findings contained therein. II. PROJECT DESCRIPTION A Village business owner is proposing revisions to the Village Master Plan and Design Manual; a document that regulates land uses in the city's downtown, or "Village." The proposed revisions consist of modifying the land use matrix, so that wineries would be classified as a provisional use within Districts 5 and 6 and that special provisional use standards for wineries are added to the plan. Provisional uses are those which are permitted subject to discretionary approval (by either the City Planner or the appropriate decision making authority). They are approved based upon the findings that the use is consistent with the Village vision and goals under specific conditions imposed by the permit. Uses in this category require special scrutiny concerning location, size, and anticipated impact on adjacent uses. Forthe purposes of land use policy within the Village, the term "provisional use" replaces the term "conditional use" which is used within the Carlsbad Municipal Code. Currently, wineries are not permitted in Districts 5 and 6. However, they are permitted in Districts 1 through 3 as a result of a staff proposed Master Plan Amendment (MP 12-OlA) that was approved in January of 2013. Wineries have become a trend in urban areas and can be defined as a business where a wine producer grows grapes in a rural location or buys grapes from a vineyard and then transports them to an urban facility for crushing, fermentation, aging, bottling and tasting by patrons. According to the applicant, who currently operates a winery in Solana Beach, the wine production process occurs as described below: • Grapes are received at an urban site from an outside grower, six to eight days each year in September or October. • Grapes are processed through a de-stemmer/crusher/press six to eight days each year on the days in September and October that the grapes are received. This step could potentially occur outside if there isn't ample room inside of a building. n MP 12-01(B)-VILLAGE MASTER PLAN CHANGES June 18, 2014 Page 2 ^ • The juice is placed in fermentation bins for eight to ten days. The bins are stored inside the building in a temperature controlled area. • The fermented juice is placed in a stainless steel aging tank(s) if it is white wine, or in oak barrels for red wine to be aged and become wine. Depending on the size ofthe building where a winery is located, the aging tanks may need to be located outside. • Depending on the grape varietal, the wine is aged from six to twenty-four months before bottling. III. ANALYSIS Although wineries are permitted uses in Districts 1-3, the applicant has expressed interest in opening a winery in District 5. Most of the existing buildings in Districts 1 - 3 are not conducive to the production of wine because of their low ceiling heights and minimal outdoor space do not allow for fermentation tanks to be located on-site. There are more buildings in Districts 5 and 6 that were built to accommodate industrial uses and auto repair shops that have tall ceilings and outdoor space to allow for wine production on-site. Although, when the Village Master Plan was amended in January of 2013, wineries were allowed as permitted uses in Districts 1-3 because those districts had either previously allowed or had existing non-conforming uses that serve alcohol such as restaurants, bars, and nightclubs. Wineries were not proposed in District 6 because of the district's distance from the Village's primary commercial corridors and its adjacency to District 5. District 5 contains some existing residences and has a land use plan emphasizing residential and neighborhood serving commercial uses. Wineries are being proposed as a provisional, rather than a permitted use in Districts 5 and 6 because there are more residential uses in those districts that the wineries could potentially have impacts on. Clearly, there would be more impacts from wineries that have their production occurring outside rather than inside. Potential issues associated with outdoor production are noise, odor, and the visual impacts of stainless steel tanks in neighborhoods with residential uses. If wineries were to be allowed as a provisional use, an Administrative Review Permit would be required in order for one to start producing wine. An Administrative Review Permit is approved at staff level (unless appealed to a higher decision making authority) with any necessary conditions placed on it. Property owners who are within 300 feet of a property where an application to operate a winery has been submitted, would be notified of the pending application and would have an opportunity to raise their concerns about the proposed winery. In summary, as a provisional use wineries could either be approved with conditions of approval to ensure compatibility with nearby residential uses or they could be denied by the City Planner because they are not located or designed to be compatible with residential uses. Selected provisional uses have their own Viilage Master Plan standards that are provided to identify special considerations, findings and conditions which will be used to determine whether or not the identified use will be permitted at a particular site. Staff is proposing special standards for wineries (see Attachment 2). It is intended that these standards in association with project specific conditions of approval will ensure that wineries that are approved in Districts 5 and 6 will be compatible with the surrounding residential uses. A. General Plan The General Plan contains a framework of land use goals, objectives, policies and programs. Table A below summarizes how the proposed amendment complies with relevant parts ofthis policy framework. Village Master Plan and Design Manual Table B below summarizes how the proposed amendment complies with relevant goals and objectives of the Village Master Plan and Design Manual. PROJECT Allowing wineries as a provisional use in Districts 5 and 6 will further improve the Village as a shopping and tourist destination for both residents and visitors. The wineries will complement the existing restaurantsand hotels by providing a unique wine tasting experience that otherwise occurs in more rural settings. The potential impacts to residential uses can be avoided in that special provisional use standards for wineries are proposed to ensure compatibility with surrounding residential uses and by allowing wineries as a provisional use, where they can be conditioned to be compatible with nearby residential uses or denied because they are not located or deigned to be compatible with residential uses. COMPLY Yes Yes Yes MP 12-01(B)-VILLAGE MASTER PLAN CHANGES June 18, 2014 Page 4 The Village Master Plan and Design Manual identifies District 5 as a district that "will continue as a mixed- use area related to the District 1 Village Center while also serving the special needs of the adjacent Barrio Neighborhood." As wineries are already a permitted use in District 1, it would be appropriate to allow them as a provisional use to allow for a unique commercial use in this district, while still being cognizant ofthe residential uses in the area. Regarding District 6, The Village Master Plan and Design Manual states that: District 6 has traditionally functioned as a light industrial area with an emphasis upon automotive towing, repair and detailing uses. Other building services and light industrial activities have also occupied large parcels in the area. Land uses of this type will be allowed to continue in the area with some limitations to better integrate them into the surrounding Village environment. However, as economics begin to play its role in the area, this area may begin to transition into a more commercial retail and business area much different from the industrial land uses. The land use plan within this document allows forthe gradual transition ofthe area into uses which will be more compatible with the residential character of the Barrio neighborhood. Allowing wineries as a provisional use in District 6 would assist in the transition ofthe district into more of a commercial retail area. As a provisional use, a consideration to approving a winery would include reviewing the compatibility with adjacent and surrounding uses, and placing conditions on the permit to limit the impacts of the use on residential uses in the neighborhood. C. Zoning Ordinance Changes are not proposed to the Zoning Ordinance, including Chapter 21.35, which contains regulations for the Village Review (V-R) Zone, the zone that applies to the area of the Master Plan. Zoning Ordinance Section 21.35.150 deems amendments to the Master Plan as amendments to Chapter21.35; however, an accompanying Zoning Ordinance amendment is not required. D. Local Coastal Program The proposed amendment affects only properties outside of the Coastal Zone and particularly those outside of the Village segment of the city's Local Coastal Program (LCP). Therefore, an analysis of compliance with or an amendment to the LCP is not necessary. IV. ENVIRONMENTAL REVIEW Carlsbad Municipal Code Section 19.04.070 A.c.(l) states "minor zone or municipal code amendments that do not involve physical modifications, lead to physical improvements beyond those typically exempt, or which refine or clarify existing land use standards" are specific actions considered not to have a significant effect on the environment. The proposed revisions to the Master Plan are similar to minor Zoning Ordinance amendments and therefore are exempt from environmental analysis. The proposed changes would lead to development typically found exempt from environmental review. Wineries would typically be exempt from environmental analysis because in most cases, they locate within an existing building that is repurposed where minor improvements to the interior and exterior of the building are made. Mr. Neu introduced Agenda Item 3 and stated Assistant Planner Austin Silva would make the Staff presentation. 00 Planning Commission Minutes June 18, 2014 Page 3 Mr. Silva noted there is an errata sheet for this item, gave a detailed presentation and stated he would be available to answer any questions. Commissioner L'Heureux asked if there were any questions of Staff. Commissioner Segall requested clarification of the errata. Mr. Silva explained that District 6 currently allows wine retail sales and tasting as a provisional use, but not production. District 5 currently allows wine retail sales and tasting by right. Commissioner Segall asked for the definition of wine tasting versus wine drinking. Mr. Silva explained that it is a matter of sample size and it is regulated by an ABC license. Commissioner Segall also wanted clarification on the location of fermentation tanks. Mr. Silva stated that the type of wine being produced would dictate whether a fermentation tank would be located inside or outside the building. Commissioner Siekmann requested information related to any odors, noise and for information related to the time of year and length of time production takes. Mr. Silva explained the applicant would be best suited to answer those questions. Commissioner Siekmann asked if there are noise limitations that are similar to residential limitations. Mr. Silva stated there is an entertainment ordinance, but he did not think that would apply to a production facility, particularly as they would be operating during daytime hours and that ordinance applies after 10:00 p.m. Commissioner Siekmann was also interested in the height limit of the fermentation tanks. Mr. Silva stated they would be subject to the same height restrictions as any other structure in that district. Commissioner Anderson asked Mr. Silva if he knew how noisy the machines are that are crushing the grapes. Mr. Silva stated he did not. Commissioner Anderson asked if Mr. Silva knew if a property on Roosevelt with barrels in the yard is actively producing wine right now. Mr. Silva stated that, if it is the property he thinks she is referencing, it is a wine retail sales operation and those barrels are likely empty, but the applicant could confirm that. Commissioner Anderson asked for confirmation that the barrels would be screened from view and with what type of materials. Mr. Silva explained screening would be imposed on a case-by-case basis and could be included as a condition of approval. Commissioner Anderson asked for clarification of the imposition of "village character" upon the frontage of buildings. Mr. Silva explained it had more to do with any renovations and ensuring they would be compatible with the surrounding area. Commissioner Segall asked if the reason this is being examined as an allowable use is because there already are a number of more industrial type usages in District 6 that are much noisier than what the applicant is proposing. Mr. Silva confirmed this and stated where the applicant is located at now was formerly an auto repair shop with both noise and visual blight. Commissioner L'Heureux asked if there were any further questions of Staff; seeing none, asked if the applicant wished to come forward to address the commission. Adam Carruth, 3359 Tyler Street, Carlsbad, came forward and stated he would be happy to answer any questions and gave a brief presentation addressing the concerns expressed by the commissioners during their discussion. Commissioner Siekmann asked Mr. Carruth to confirm the odor is generally coming from the stems. Mr. Carruth explained that any off odor would be the stems, they are picked up within 24 hours, and he has never received any complaints from neighbors in his Solana Beach location. Commissioner Siekmann also wanted confirmation that one of the stainless steel tanks would be outside the building. Mr. Carruth confirmed that is their request. Commissioner Segall requested confirmation wine would be fermented in the stainless steel tank outside the building. Mr. Carruth explained that white wine would ferment in the tank and the red wine open ferments inside. Mr. Carruth stated there is very little odor produced by either method and in his Solana Beach location they have installed a carbon filter on their HVAC system as part of the approval there. Commissioner Anderson wanted confirmation that there would be approximately 10 days of odor per pressing and there are six to eight pressings per year. Mr. Carruth stated the pressings overlap from approximately September 1^' through Halloween and vary due to Mother Nature and when the grapes are ripe. Mr. Carruth stated that the location they are currently in is surrounded by other like uses and very Ol Planning Commission Minutes June 18, 2014 Page 4 little residential. Commissioner Anderson expressed concern with parking for their customers as the lots are very narrow and not close to the public parking areas. Mr. Carruth stated that they will provide the required amount of parking space, but as a resident of the area himself, he often walks to his destinations. Commissioner Anderson also mentioned the aesthetics of a stainless steel tank and Mr. Carruth stated he would be open to some sort of screening. Commissioner Siekmann wanted confirmation there is public parking by Fish House Vera Cruz and asked what carbon filters cost. Mr. Carruth confirmed there is public parking there, but did not consider it very close to his winery and estimated the cost of the filters at $30-35 each. Ashley Westman of Urban Place Consulting, 3138 Roosevelt Street, Suite H, supports these types of uses in Districts 5 & 6. Commissioner Segall asked Ms. Westman if the changes to the Village Master Plan would ultimately include breweries in Districts 5 & 6. Ms. Westman stated that with the new consulting firm coming in would in all likelihood address these issues during their studies and outreach. Susan Marie Smith, 3320 Roosevelt Street, Carlsbad, expressed her concern with potentially more traffic, including the delivery trucks, forklifts that will be necessary for the business. Ms. Smith felt that the neighborhood does not need more businesses, especially those serving alcohol, and that these types of uses should remain restricted to Districts 1-3. Ms. Smith believes there will be an increase parking problems, noise, odors, and trash over what they are already dealing with in the area. Theresa J. Childs, 3331 Madison Street, Carlsbad, feels there is another building on State Street for lease that would be much better suited for a winery. Overall Ms. Childs does not support any of the processing activities taking place outside. She feels District 5 should remain primarily residential and not allow any industrial businesses and felt these types of uses were more appropriate for District 6. Virginia H. Martinez, 3367 Madison Street, Carlsbad, believes the odor will be much worse than what is being reported. She feels these uses are more appropriate for Districts 1-3 and her neighborhood should continue to remain mostly residential. She does not believe there would be a good way to screen a stainless steel tank outside and would worsen the parking and traffic problems already created by Lola's market. Socorro Anderson, 3420 Don Juan, Carlsbad, is very familiar with the area and is concerned with any increased traffic around the senior apartments on Tyler Street. Ms. Anderson feels traffic is bad enough due to all of the auto repair shops and their test driving vehicles through the neighborhood. She believes the fermentation process will produce much more odor than the applicant stated and these types of businesses should remain in Districts 1-3. Javier Ureta, 3280 & 3293 Roosevelt Street, Carlsbad, resident and business owner. Mr. Ureta states that out of respect for the neighborhood he does not do any painting or repairing of automobiles at his business location on Roosevelt Street. He believes the main traffic issue in the neighborhood is just because of the growth in the area and does not believe this will create any major issues and supports the project. Mr. Carruth responded to the neighborhood concerns with respect to traffic and stated that he understands there are already plans for traffic calming measures in the area. He also addressed the issue of odors during processing by stating his other location is in a mixed-use neighborhood and the only complaint they had was with respect to the trash can over four years ago and was solved by ensuring the stems not sit for more than 24 hours. He believes his business is more of a boutique operation rather than industrial in part because the fermentation process is only occurring about six weeks out of the year. Mr. Carruth stated he believes his type of business represents a positive trend for the neighborhood by moving away from the more industrial type uses. Commissioner L'Heureux closed public testimony and reminded the audience that they are not approving Mr. Carruth's project at this time, but rather considering amending the master plan to allow wineries in Districts 5 & 6. DISCUSSION Planning Commission Minutes June 18, 2014 Page 5 Commissioner Segall wanted confirmation that there is an appeal process for any administrative approvals for wineries in the future. Assistant City Attorney, Jane Mobaldi, confirmed it could be appealed first to the Planning Commission and, if the appellant was dissatisfied with that decision, it could then be appealed to City Council. Commissioner Segall wanted to know if we checked with other cities to see what issues there may be with these types of uses before we approve a winery. Mr. Silva stated that he did check with the city of Solana Beach and found there were no complaints with his business other than the one Mr. Carruth had discussed earlier concerning the odor. Mr. Silva also contacted the city of Encinitas concerning Solterra winery and they, too, reported no issues. Commissioner Segall was also curious as to whether issues of odor and traffic and their mitigation would be part of the approval process. Mr. Neu stated all factors of compatibility would be looked into when considering a use permit and suggested the commission look over the attachment and see if there were some criteria they would like to add to that list as consideration in the approval process. Commissioner Segall requested information with respect to Peder Norby's role for the city. Mr. Neu stated he will be assisting in some of the outreach activities in updating the Village Master Plan, but that the reason that this amendment is being considered now is that an amendment application was submitted by Mr. Carruth. The Village Master Plan update is expected to be completed by March of 2015. Commissioner Segall asked what would happen if this amendment were approved, a winery located in District 5 or 6, and the updated master plan did not allow the use. Mr. Neu stated as an existing business they would be allowed to continue to operate as a legal nonconforming use, but no new wineries would be allowed. Commissioner Siekmann believes that sometimes it's a good idea to allow one as an example to give you an idea of what you would like to allow more of or none in the future for a given area. Commissioner Anderson has concerns about the outside tanks, noise, and odor as we don't have the experience with wineries and believes District 6 is much more conducive to manufacturing than District 5 and it should be postponed until further evaluation. Commissioner L'Heureux suggested focusing on Attachment 2 of the Staff Report stating where wineries should be located and perhaps adding language concerning odors and how to control them. Commissioner Siekmann agrees and thinks requiring refuse to be collected within 24 hours should also be added. Commissioner L'Heureux also suggests limiting outside tanks in residential areas. Commissioner Anderson stated there seems to be a great deal of contradiction in the way the amendment is worded. Mr. Neu stated that there is a great deal of subjectivity so that individual permits can be considered along with any other controls and characteristics ofthe operation. Mr. Silva pointed out that we do have a comparison in Witch Creek Winery on Carlsbad Boulevard, directly across the street from a retirement community, and there have been no complaints in the seven years he worked in the village. Commissioner L'Heureux suggested approving but having staff redraft Attachment 2 to include additional criteria. Commissioner Segall wanted to know if there is a smell-o-meter to measure odor in the same way a decibel meter measures sound. Mr. Neu stated they would have to do further research and consult with air quality or pollution experts as he was not aware of such a device. Commissioner Segall suggested adding the carbon filters to the criteria unless staff finds there is a better system of testing odors and mitigating them and definitely by not allowing stems to sit out longer than 24 hours. He cannot support categorically denying all outside tanks. Commissioner Siekmann agreed with Commissioner Segall. Commissioner Anderson is not comfortable with approving the amendment tonight and would prefer to have more information. Planning Commission Minutes June 18, 2014 Page 6 Commissioner L'Heureux has been around wineries a fair amount and believes some of the concerns of the public are overblown and staff understands and can address our concerns. Commissioner L'Heureux is willing to approve this application with recommendations incorporated into Attachment 2 for council. Commissioner Segall agrees with Commissioner L'Heureux and can support the project, but feels it still makes more sense to wait for it to be researched in the update process to the master plan. Commissioner Siekmann complimented Mr. Silva on his research for this project. Commissioner Anderson would support the project in District 6, but cannot in District 5. COMMISSION COMMENTS Commissioner L'Heureux clarified the additional criteria will address odor and stem removal within 24 hours. Jane Mobaldi stated the only two conditions she heard were to be added and that were agreed to had to do with refuse and filters on the tanks to mitigate smells. Commissioner L'Heureux closed the public hearing on Agenda Item 3 and thanked Staff for their presentations. The amendment is proposed to allow wineries as a provisional use within Districts 5 and 6 ofthe Master Plan and to add special provisional use standards for wineries to the plan. Whereas, on June 18, 2014 the City of Carlsbad Planning Commission voted 3-1 (Anderson; Black and Scully absent) to recommend approval of an applicant-proposed amendment to the Village Master Plan and Design Manual. The amendment is proposed to allow wineries as a provisional use within Districts 5 and 6 of the Master Plan and to add special provisional use standards for wineries to the plan. The City Planner has determined that the proposed amendments do not have a significant impact on the environment pursuant to Carlsbad Municipal Code Section 19.04.070 A.c.(1), which states "minor zone or municipal code amendments that do not involve physical modifications, lead to physical improvements beyond those typically exempt, or which refine or clarify existing land use standards" are specific actions considered not to have a significant effect on the environment. What is an urbanwinery?An urban winery sources grapes and produces wine in an industrial and/or commercial setting.Essentially, an urban winery is a winery without a vineyard.Carruth Cellars, an urban winery, uses the tagline “Bringing grapes to the people” to describe what they do. Urban Winery ProductionIn 4 easy steps Step 1 : “CRUSH” grapes“CRUSH” is an industry term used to describe the season in which wineries are making wine. CRUSH typically lasts about 6 weeks of the year. (4‐8 weeks, pending mother nature, during the fall)The first step is to receive and de‐stem the grapes. •Grapes are received on trucks once a week during crush season. •Grapes get dumped into a de‐stemmer and as grapes fall out of one end into a square bin (known as a macro bin), the stems fall out the other and are set aside.Stems are considered green waste and are removed within 24 hours to avoid odors, which would be harmful to the wine. Step 2 : FermentationOnce the grapes are de‐stemmed, they are ready for fermentation. All fermenting occurs in the macro bins located inside the winery and lasts 8‐10days per varietal.During fermentation, winemakers add yeast, measure sugar levels, and conduct what is called “punch downs”. What is a “Punch down”? It is the same process as stomping grapes, except we do not stomp on grapes with our feet anymore, we use a punch down tool. Step 3 : Press and BarrelAfter fermentation, the wine gets pressed.This is the process that removes the skins, seeds, and pulp.A piece of equipment, known as a Press, is filled with the fermenting grapes and juice. A bladder fills up inside the press and squeezes out all the new wine, which is then pumped directly into barrels. The skins and seeds are pressed until dry, dumped into bins, and removed. Carruth Cellars is just one of many urban wineries that donate this waste to local farmers to be used as compost. Step 4 : BottlingBottling occurs twice a year (1 day in the spring and 2 days in the summer)Pallets with cases of empty bottles are staged on one side of the winery and all of the barrels full of wine on the other.A mobile bottling truck arrives and is parked on‐site. The truck is stocked with the empty bottles and pumped with the wine and proceeds to bottle, cork, and label and box the wine with the help of 6 people.The cases of wine are placed on pallets, and the pallets are forklifted into the winery for storage. Are urban wineries loud? And do they smell?A winery is not a loud or smelly environment. In fact, bad smells are harmful to winemaking.The wine making process does entail some equipment to be used during CRUSH season (below), but everything sounds like an idling car or quieter.De‐StemmerPressTruck (delivery)Forklift (used all year round)There is little to no smell caused by an urban winery.–Any smell of wine in oak is only noticeable within the winery and most people find it pleasant. –Any smell cause during fermentation is faint, also contained within the winery, and also is considered pleasant by most people who come during crush season. What does an urban winery look like?An urban winery is simply a warehouse with barrels, stainless steel tanks, cases of wine, and macro bins. Most urban wineries include a tasting room bar and retail space.Although the barrels and stainless steel tanks may be visible outside the winery, everything else is contained within the winery walls.Stainless steel tanks are thought to be beautiful within the industry and are frequently used for visual impact in breweries and brew pubs throughout San Diego.Barrels are a hot commodity these days and frequently used for aesthetic enhancement, not only at wineries, but in people’s gardens.
