PW-TRAN ACCEPTANCE OF BIDS AND AWARD OF CONTRACT FOR CONSTRUCTION OF EL CAMINO REAL WIDENING, MEDIAN IMPROVEMENTS, UNDERGROUNDING UTILITIES, AND UPGRADING TRAFFIC SIGNALS, PROJECT NOS. 3957, 3643, 6302, 6303 CITY MGR. lir RECOMMENDED ACTION: Adopt Resolution No. 2014-205 accepting bids and awarding a contract for the construction of El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals. Project Nos. 3957, 3643, 6302, and 6303. ITEM EXPLANATION: The subject project will widen El Camino Real from Tamarack Avenue to Chestnut Avenue and provide three lanes of travel in each direction, bike lanes, a new raised median, curb, gutter and sidewalk providing operational improvements, enhanced mobility and connectivity for all modes of travel. Additionally, this widening project will remove the existing utility poles and place the facilities underground as part of the Underground Utility District No. 19 which was formed by City Council on April 27, 2010. Also, both traffic signals along El Camino Real at the intersections of Tamarack Avenue and Chestnut Avenue will be upgraded. This project has obtained easements from adjacent property owners, environmental clearance, and regulatory agency permits to construct these improvements. On May 6, 2014, City Council approved Resolution No. 2014-078, authorizing the advertisement for bids for the construction of El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals. Project Nos. 3957, 3643, 6302, and 6303. Five sealed bids were received on July 10, 2014, which are summarized as follows: CONTRACTOR BID TOTAL 1. Sierra Pacific West, Inc. $7,774,086.00 2. In accordance with Public Contract Code 5101 (b) and 5103, City Council can provide relief to the bidder if a mistake was made and written notification is received within five working days. Sierra Pacific West, Inc. made a clerical error and failed to include a portion of the work in the bid while compiling their bid numbers. As specified in the Public Contract Code, they provided a satisfactory level of detail in a letter within five working days of how the mistake occurred to support relief of bid. Staff has completed its review of the contract documents and determined that Los Angeles Engineering, Inc. is responsive and responsible with a bid of $8,930,590. Staff recommends that the City Council grant relief of bid to Sierra Pacific West, Inc. and award the project to the next lowest responsive and responsible bidder Los Angeles Engineering, Inc. FISCAL IMPACT: Four funding sources will be utilized for the El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals. The Project Nos. and funding sources include: • 3957 - El Camino Real Widening Tamarack Avenue to Chestnut Avenue - Traffic Impact Fees, TransNet- Local, and TransNet-Miscellaneous 3643 - El Camino Real Median Improvements - Public Facilities Fees and Gas Tax 6302 - Traffic signal upgrades at El Camino Real and Chestnut Avenue - Infrastructure Replacement 6303 - Traffic signal upgrades at El Camino Real and Tamarack Avenue - Infrastructure Replacement Table 1 shows the current status of El Camino Real Widening Project. These funding sources are subject to State and Federal restrictions and the payment of prevailing wages is required for this project. ENVIRONMENTAL IMPACT: A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program were prepared for the El Camino Real Road Widening project (CDP 07-22 / HDP 07-02 / SUP 07-04 / HMP 07-08) and this project is within the scope ofthe MND. The Notice of Intent (NOI) to adopt a Mitigated Negative Declaration was published in the newspaper November 1, 2007, and sent to the County Clerk's Office for a 30-day public review (October 30, 2007 - November 30, 2007). One comment letter was received during the 30-day review period. The MND was approved by the Planning Commission on June 3, 2009 in compliance with the California Environmental Quality Act (CEQA) Guidelines Section 15074. EXHIBITS: 1. Location map EXHIBIT 1 1 RESOLUTION NO. 2014-205 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING OF CONTRACT FOR CONSTRUCTION OF EL CAMINO REAL WIDENING, MEDIAN 4 IMPROVEMENTS, UNDERGROUNDING UTILITIES, AND UPGRADING TRAFFIC SIGNALS, PROJECT NOS. 3957, 3643, 6302, 6303. 5 " ^ WHEREAS, the City Council ofthe City ofCarlsbad, California, has determined it necessary, ^ desirable, and in the public interest to improve operations, enhance mobility and provide 8 connectivity for all modes of travel with the construction of El Camino Real widening, median 9 improvements, undergrounding utilities, and upgrading traffic signals from Tamarack Avenue to 10 Chestnut Avenue; and \\ WHEREAS, on May 6, 2014, the City Council approved contract documents and 12 specifications for furnishing of all labor, materials, tools, equipment, transportation, and other ^2 expenses necessary or incidental to the El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals. Project Nos. 3957, 3643, 6302, 6303; and WHEREAS, Five sealed bids were received on July 10, 2014 for the project; and WHEREAS, within five working days, a letter from the apparent lowest bidder. Sierra Pacific West, Inc. stating a clerical error was made during bid assembly in which information critical to the amount of the bid was inadvertently omitted. The bidder requested a relief of bid that complied with Public Contract Code Section 5101 (b) and 5103; and WHEREAS, the next lowest responsive and responsible bid for the project was submitted by Los Angeles Engineering, Inc. in the amount of $8,930,590; and WHEREAS, funding for said project has been appropriated from the Traffic Impact Fee 22 (TIF), Public Facilities Fees and Gas Tax, TransNet (Local and Miscellaneous) and Infrastructure 23 Replacement funds and are sufficient. 24 NOW, THEREFORE, BE IT RESOLVED bythe CityCouncil ofthe City of Carlsbad, California, 25 as follows: 26 1. That the above recitations are true and correct. 27 2. That the City Manager is hereby authorized to approve construction change orders up to the contingency amount of $1,339,589 to Los Angeles Engineering, Inc. for the of El Camino Real widening, median improvements, undergrounding utilities, and upgrading traffic signals. That the award ofthis contract is contingent upon Los Angeles Engineering, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution.
