KEVIN LYNDS FOR $59,110

RECOMMENDED ACTION:
Adopt Resolution No. 2014-218 authorizing settlement Workers' Compensation claim of Kevin Lynds
for $59,110.
ITEM EXPLANATION;
The claimant is a Fire Captain with the Carlsbad Fire Department. Captain Lynds sustained a work
related injury on August 29, 2013 resulting in a permanent disability.
The terms and conditions ofthe proposed settlement are set forth in the Compromise and Release (on
file in the Human Resources Department). The terms and conditions were agreed upon by the claimant
and the City, and have been recommended by Keenan & Associates, the City's Third Party
Administrator.
FISCAL IMPACT:
The cost ofthe settlement is $59,110. There are sufficient funds available in the Workers' Compensation
Self-Insurance Fund to cover the cost ofthis settlement.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment,
or a reasonable foreseeable indirect physical change in the environment; and therefore, does not
require environmental review.

y WHEREAS, Keenan & Associates, the City's Third Party Administrator, has recommended
8 a settlement of the Workers'Compensation claims of Kevin Lynds; and
9 WHEREAS, all parties have agreed to settle this claim before the Workers' Compensation
Appeals Board.

NOW, THEREFORE, BE IT RESOLVED bythe City Council ofthe City of Carlsbad, California,

as follows:

15 2. That the expenditure of $59,110 from the Workers' Compensation self-insurance
