DIRECTOR CITYATTORNEY CITY MANAGER RECOMMENDED ACTION: That the City Council introduce Ordinance No. CS-261 approving an amendment to the City's Sign Ordinance (ZCA 11-03(A)), thereby accepting and administering the Coastal Commission's suggested modifications to the City ofCarlsbad Local Coastal Program (LCPA 11-04(A)). ITEM EXPLANATION: On August 27,2013 the City Council approved a City-initiated Zone Code Amendment and Local Coastal Program Amendment (ZCA 11-03/LCPA11-04) to repeal and reenact the city's Sign Ordinance (Chapter 21.41 ofthe Carlsbad Municipal Code) to: (1) incorporate revisions to address first amendment issues associated with the permitted regulation of non-commercial signage, (2) provide more flexible sign development standards, (3) allow electronic message board signs or digital displays at regional commercial centers (Plaza Camino Real and Car Country Carlsbad) that are designated Regional Commercial by the General Plan, are located within a Master or Specific Plan and have frontage on a freeway (1-5 or SR 78) and (4) clarify the ordinance to make it more user friendly. Since the Sign Ordinance is an implementing ordinance ofthe Carlsbad Local Coastal Program, approval of the amendment required the review and approval of the California Coastal Commission before it could become effective. On June 12, 2014, the Coastal Commission certified the amendments conditioned upon the city making changes, or "suggested modifications." This certification, and thus the amended Sign Ordinance, will not become effective until (1) the City Council accepts and administers the suggested modifications and (2) the city's approval ofthe modifications is reported to the Coastal Commission and confirmed by its Executive Director. The six (6) suggested modifications, shown in bold strike-out/underline format on Exhibit No. 2 and summarized below, include one (1) Coastal Commission suggested modification and five (5) city staff requested modifications 1. The one (1) Coastal Commission suggested modification adds a new provision to Section 21.41.050 - Application and Permit Procedures to clarify that non-exempt signage in the coastal zone (which would include all freestanding signs but would not include wall signs) requires the DEPARTMENT CONTACT: Chris DeCerbo 760-602-4611 chris.decerbo@carisbadca.gov FOR CITY CLERK'S USE ONLY. The requirement to process a minor (administrative) coastal development permit for freestanding signage in the coastal zone has never been in the city's sign ordinance, but has always been required underthe Coastal Act in that a freestanding sign is a "structure", which qualifies as "development in the coastal zone." For a minor coastal development permit (Minor CDP) to be issued for a freestanding sign in the coastal zone, findings are required to be made that the sign is consistent with the applicable policies ofthe LCP including those associated with the protection of public views and community character. The city application fees for a sign permit and Minor CDP are $60 and $843 respectively. However, to help ameliorate this potential increase in fee costs to an applicant for a freestanding sign in the coastal zone, the city will amend its application requirements for project coastal development permits (i.e.; for a residential or non-residential use) to require that any freestanding signage that would normally be processed as a separate subsequent Minor CDP, be included on the plans for the project development permit, therefore not requiring the applicant to pay for and process a subsequent Minor CDP for the freestanding sign(s). The costs to an applicant to apply exclusively for a Minor CDP for a freestanding sign in the coastal zone will increase from, $60 to $903 ($60 -i- $843). The five (5) city staff requested modifications include: 2/3. Correcting two ordinance provisions (located in Section 21.41 020 - Definitions and Section 21.41.090 - Coastal Zone Sign Standards) regarding the maximum permitted height of a "tall freestanding sign" and "directory sign" in the coastal zone from 14' tall to 15' tall to be consistent with Signage Policy 8.5 ofthe Mello II Local Coastal Program land use plan. 4. Revising the ordinance provisions (located in Section 21.41.070(A)) regarding the methodology for computing sign area back to what existed in the Sign Ordinance prior to this proposed amendment. Specifically, the existing Sign Ordinance reads that, "Sign area shall be computed by measuring the smallest square, rectangle, triangle, circle or combination thereof, that will encompass the extreme limits ofthe graphic image, writing, representation, emblem or other display, together with any material or color forming an integral part ofthe backRround ofthe message or display or otherwise used to differentiate the sign from the backdrop or structure against which it is placed." As originally proposed, the underlined language shown above was deleted from the existing Sign Ordinance, whereby sign area could be calculated based upon the area of the sign image and text only, and not the borders, framing etc. For example, monument signs are limited to a sign area of 60 square feet; in this scenario the 60 square feet would be computed by measuring only the area of the sign image and text, and thus the total sign size could be much larger. Given that through this Sign Ordinance Amendment, sign areas for monument signs and many other signs have been increased, this originally recommended Sign Ordinance revision is not necessary. Accordingly, staff, in concurrence with the California Coastal Commission is recommending that the provision that clarifies that sign area be computed to include borders, framing, background effects and coloring be reinserted back into the Sign Ordinance. Deleting two ordinance provisions (located in Section 21.41.030 - Prohibited Signs and Section 21.45.095 - Permitted Permanent Signs) that would allow digital display signage at regional commercial centers that are designated Regional Commercial bythe General Plan, are located within a Master or Specific Plan and have frontage on a freeway (1-5 or SR 78), based upon the City Council's decision to not allow digital display signage in the city after the city submitted its Sign Ordinance LCP Amendment (LCPA 11-04) to the California Coastal Commission. FISCAL IMPACT: The fiscal impact to the city is negligible to implement the suggested modifications to the city's Sign Ordinance. ENVIRONMENTAL IMPACT: On August 27, 2013, the City Council adopted a Negative Declaration for ZCA 11-03 and LCPA 11-04 Sign Ordinance Amendment (Resolution No. 2013-214). The proposed modifications do not create any new significant environmental effects that were not previously identified. No additional environmental review is required. EXHIBITS: 1. CASE NAME: SIGN ORDINANCE AMENDMENT SUGGESTED MODIFICATIONS CASE NO.: ZCA 11-03(A)/LCPA 11-04(A) WHEREAS, the Planning Commission did on November 21, 2012 and April 17, 2013, hold duly noticed public hearings as prescribed by law to consider Zone Code Amendment (ZCA 11-03) and Local Coastal Program Amendment (LCPA 11-04) to repeal and reenact the city's Sign Ordinance, Chapter 21.41 of the Zoning Ordinance; and WHEREAS, the Planning Commission adopted Resolutions No. 6927 and 6928, recommending to the City Council approval of ZCA 11-03 and LCPA 11-04; and WHEREAS, the City Council, on August 27, 2013, held a duly noticed public hearing as prescribed by law to consider ZCA 11-03 and LCPA 11-04, and introduced Ordinance No. CS-226 to approve ZCA 11-03, and adopted Resolution No. 2013-214, to approve LCPA 11-04; and WHEREAS, the City Council, on September 10, 2013, passed, approved and adopted Ordinance No. CS-226; and WHEREAS, the approval of both Ordinance No. CS-226 and Resolution No. 2013-214 is subject to Coastal Commission approval (certification) of LCPA 11-04; and WHEREAS, on June 12, 2014, the California Coastal Commission approved LCPA 11-04 conditioned upon the city making certain changes, or "suggested modifications"; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, accepting and administering the California Coastal Commission's suggested modifications, as set forth in this ordinance, is necessary to comply with the California Coastal Act and California Administrative Code; and WHEREAS, some of the California Coastal Commission suggested modifications are substantial modifications, however, as described in Zoning Ordinance Section 21.52.050 A.S. do not require further review by the city's Planning Commission. follows: NOW, THEREFORE, the City Council ofthe City of Carlsbad does ordain as SECTION I: That Section 21.41.020 (Definitions), Subsection 21.41.020 A.79. ofthe Carisbad Municipal Code, as previously approved pursuantto Ordinance No. CS-226, is modified to read as follows: 79. Sign area is computed as follows: a. Wall, Retaining Wall, Fascia, Awning, Window and Landscape/Hardscape Feature Signs. i. Sign area shall be computed by measuring the smallest square, rectangle, triangle, circle or combination thereof, that will encompass the extreme limits ofthe graphic image, writing, representation, emblem or other display, together with any material or color forming an integral part ofthe background ofthe message or display or otherwise used to differentiate the sign from the backdrop or structure against which it is placed. ii. Sign area does not include any supporting framework or bracing unless such is designed in a way as to function as a communicative element ofthe sign. b. Pole Signs. i. Sign area shall be computed as the area ofthe surface(s) upon which the sign message is placed including the supporting column(s) if decorated or displayed with advertising. c. Multi-Faced Signs. i. The sign area for a two-sided or multi-faced sign shall be computed by adding together the area of all sign faces visible from any one point. ii. When two sign faces are placed back to back, so that both faces cannot be viewed from any one point at the same time, and when such sign faces are part ofthe same structure, the sign area shall be computed by the measurement of one of the faces. iii. In the case of a sign of spherical or cylindrical shape, the area of the sign shall be one-half of the surface area. d. Flags, Banners, Pennants, etc. i. Sign area is the entire surface area, one side only. e. Monument, Freestanding and Suspended Signs. i. Sign area shall be computed by measuringthe entire area contained within the frame, cabinet, monument, monument base or fixture. SECTION V: That Section 21.41.090 (Coastal zone sign standards). Subsection 21.41.090 A.2. of the Carlsbad Municipal Code, as previously approved pursuant to Ordinance No. CS-226, is modified to read as follows: /// /// 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A. The following sign restrictions apply to properties in the coastal zone except the Agua Hedionda Lagoon and CaHsbad Village Review segments. If there is a conflict between the coastal zone sign standards of this section and any regulations of this chapter, the standards of this section shall prevail. Otherwise, within the coastal zone, the sign regulations ofthis chapter shall apply. 1. Each business or establishment shall be entitled to one fagade sign. 2. Each shopping complex shall have only one directory sign which shall not exceed fifteen feet in height, including mounding. 3. Monument sign height including mounding shall not exceed eight feet and shall apply where three or fewer commercial establishments exist on a parceL 4. Tall freestanding and roof signs shall not be allowed. 5. Off-premises signs shall not be allowed. The following signs, as defined in this chapter, are prohibited in all zones of the city, unless a more specific provision or city policy allows them at certain times and places: 8. ZCA 11‐03(A)/LCPA 11‐04(A)1. Address first amendment issues associated with the regulation of non‐commercial signage,2. Provide more flexible sign development standards, 3. Allow digital display signs at Plaza Camino Real and Car Country Carlsbad subject to the approval of a CUP by the City Council, and 4.  Clarify the Sign Ordinance to make it user friendly. ZCA 11‐03(A)/LCPA 11‐04(A)•The amended ordinance required certification by the California Coastal Commission before it is effective. •On June 12, 2014, the Coastal Commission certified the amendments conditioned upon the city making certain changes, or “suggested modifications”. SUGGESTED MODIFICATIONS1. Freestanding signs (i.e.; monument, pole, directory signs) in the coastal zone require a Minor Coastal Development Permit in addition to a Sign Permit.2. Revise the maximum permitted height of a “tall freestanding sign” and “directory sign” in the coastal zone from 14 ‘ to 15’.   SUGGESTED MODIFICATIONS3. Revise the methodology for calculating “Sign Area” from measuring the sign image and text only back to the existing methodology whereby in addition, sign borders, framing, background effects and coloring are also included in the “sign area”.  4.
