RECOMMENDED ACTION:
Adopt Resolution No. 2014-261 authorizing the public works director to execute a cooperative work
agreement to maintain federal funding for Encinas discharge bridge railing improvements. Project No. 6014.
ITEM EXPLANATION:
Bridge railing improvements are needed for a bridge located over the Encinas discharge channel (warm
water jetty), approximately half-mile north of Cannon Road on Carlsbad Boulevard. Currently, no railings
exist on either side of the roadway. The bridge railing will increase the safety along the bridge and it will
complement the aesthetic characteristics of the existing sea wall.
On April 22, 2010, the Federal Highway Administration (FHWA) authorized, via CalTrans Local Assistance,
funds for the preliminary engineering of the bridge railing improvements for the bridge located on Carlsbad
Boulevard over the Encinas discharge channel. This project has had a long design period due to permitting
through the California Coastal Commission, determining ownership of the bridge, coordination with
Poseidon on bridge improvement responsibility, and uncertainty on bridge integrity with the possibility of
replacement. Since the authorized funds will not be fully invoiced by December 13, 2014, the local agency
is required to apply for a Cooperative Work Agreement (CWA) and request an extension. Plans are
anticipated to be completed by December 2015. Then federal funds for construction will be requested.
FISCAL IMPACT:
Unspent Federal funds are subject to disencumberment or de-obligation if a CWA is not implemented.
Submitting the form will initiate the process and there is no guarantee the state will authorize the extension.
The city will risk losing all or a portion of the unliquidated balance of $91,250 if the form is not submitted.

ENVIRONMENTAL IMPACT;
The project is exempt from California Environmental Quality Act (CEQA) per State CEQA Guidelines Section
15301(d) - Existing Facilities - restoration or rehabilitation of existing facilities that re deteriorated or
damaged and are required to meet current standards of public health and safety involving negligible or no
expansion of use. A notice of exemption was filed with the San Diego County Clerk on June 4, 2012.
Additionally, the city is in the process of applying for a Notice of Categorical Exclusion from CalTrans.

WHEREAS, the City Council ofthe City of Cartsbad, California, has determined it necessary,
desirable, and in the public interest to provide bridge railing over the Encinas discharge; and
WHEREAS, on April 22, 2010, the Federal Highway Administration (FHWA) authorized, via
CalTrans Local Assistance, preliminary engineering funds for the Encinas discharge bridge railing
improvements; and
WHEREAS, the federal funds in the amount of $91,250 need to be fully invoiced by
December 13, 2014 or they are subject to disencumberment or de-obligation; and
WHEREAS, the public works director may sign the Cooperative Work Agreement and
request an extension.
15 NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Cartsbad, California,
16 as follows:
17 1. That the above recitations are true and correct.
18 2. That the public works director is authorized to sign the Cooperative Work Agreement
19 for the Encinas discharge bridge railing improvements. Project No. 6014.
