PW-UTIL APPROVAL OF RESOLUTION ACCEPTING BIDS AND AWARD OF COIMTRACT FOR CONSTRUCTION OF THE NORTH BATIQUITOS UFT STATION PUIVIP REPLACEMENT, PROJECT NO 5517 CITY MGR. ^t) 2014-275 accepting bids and awarding a contract for the RECOMMENDED ACTION: Approval to adopt Resolution No. construction ofthe North Batiquitos Lift Station Pump Replacement, Project No. 5517. ITEM EXPLANATION: The project includes the replacement of the station's three existing wastewater pumps and reconfiguration of the discharge manifold system including the replacement of miscellaneous valves and appurtenances for the station's pumps. The lower portion of the wet well will be modified to improve operation and access for maintenance. In addition, a bridge crane assembly will be installed in the pump room to allow for a safe and efficient removal and reinstallation of the heavy pumps and appurtenances during future maintenance procedures at the station. The improvements will enhance operational efficiency at the station, improve reliability and reduce the potential of a future station failure and sewer overflow. On November 13, 2014, nine sealed bids were received for the construction ofthis project as shown on the following table. The engineer's estimate was $616,000. CONTRACTOR TOTAL BID 1. The letter from Cora Constructors, Inc., dated November 18, 2014, stated objections by noting the apparent low bidder does not have the required experience. The letter further referenced language in the contract documents regarding the requirements of experience and technical ability ofthe apparent low bidder. The apparent low bidder, Atom Engineering Construction, Inc. (ABC Inc.), has not provided the required evidence of experience in similar size and disciplines of construction. Requirements under the notice inviting bids' statement of technical ability and experience, include a minimum of five (5) pump/lift station projects in the last seven (7) years of equal or greater size. ABC Inc. has listed two (2) contracts of equivalent size in the stated time period, neither specifically related to wastewater. Due to the project's proximity to the lagoon, the construction contractor's experience and ability is critical to minimize the risk of a wastewater spill. In consideration of this, staff recommends the ABC Inc. bid be determined non-responsive. Staff has reviewed Cora Constructors, Inc., bid and it has been determined responsive. Staff recommends awarding the contract to the lowest responsive bidder, Cora Constructors, Inc. for the construction ofthe North Batiquitos Lift Station Pump Replacement, Project No. 5517. FISCAL IMPACT: The following table provides a breakdown of the total project cost: PROJECT COST SUMMARY FOR THE NORTH BATIQUITOS LIFT STATION PUMP REPLACEMENT PROJECT (PROJECT NO. 5517) Design $85,000 Construction Contract (Cora Constructors, Inc.) $622,845 Construction Contingency $82,000 Construction Management, Inspection & IVlaterial Testing $80,000 TOTAL PROJECT COST $869,845 CURRENT APPROPRIATION $905,000 There are sufficient appropriations from the Sewer Replacement Fund for the construction ofthe North Batiquitos Lift Station Pump Replacement Project. The funding source for this project is not subject to State or Federal restrictions regarding prevailing wage. Therefore, pursuant to Carlsbad Municipal Code Section 3.28.130, the payment of prevailing wages is not required for the construction of this project. ENVIRONMENTAL IMPACT: This project is exempt from California Environmental Quality Act (CEQA) review pursuant to CEQA Guidelines Section 15302(c) - replacement or reconstruction of an existing utility system and/or facility involving negligible or no expansion of capacity. A Notice of Exemption was filed with the San Diego County Clerk on May 29, 2014. PUBLIC NOTIFICATION: None required. That the above recitations are true and correct. 2 2. That the Atom Engineering Construction, Inc. bid is a nonresponsive bid; and is 3 precluded from award of a contract. 4 3. Atom Engineering cleariy does not have tiie required experience. The contract documents state, "Contractor shall demonstrate, providing proof of their experience and technical ability..." Atom Engineering does not have five wastewater pump/list station projects in the last seven years, or three projects in the last five years. Attached please find an experience list for Cora Constructors Inc. In addition to the highlighted project which contained bypasses, we just completed a bypass forthe City of Big Bear Lake Sewage Lift Station No. 3 project we currently have under construction. The bypass portion ofthe work was completed last week. The contact information is the same as for the Lift Stations 2/2A project aiso completed for the City of Big Bear Lake.
