RECOMMENDED ACTION:
Adopt Resolution No. 2015-004 opening a portion of the cul de sac of The Crossings Drive within Lot 9
of Map 15902 City of Carlsbad Tract CT 09-03, recorded March 4, 2013 as File No. 2013-0139681, generally
located north of Palomar Airport Road, for public street and public utility purposes.
ITEM EXPLANATION:
Carlsbad Tract No. 85-17, Map No. 12903 recorded December 3, 1991 as File No. 91-646771 dedicated the
easterly portion of The Crossings Drive (Hidden Valley Road) for street and public utility purposes. City of
Carlsbad Tract 94-09 Carlsbad Ranch — Units 2 & 3, Map 13408 recorded April 1, 1997, Map No. 13408 as File
No. 97-147754 dedicated the westerly portion of The Crossings Drive (Hidden Valley Road) for public street
and utility purposes. City of Carlsbad Drawing No. 333-2V approved March 27, 1997 and 'As -Built' January 18,
1999 constructed The Crossings Drive (Hidden Valley Road). The cul de sac of The Crossings Drive (Hidden
Valley Road) was constructed on property owned by the City of Carlsbad, a municipal corporation outside of
the public street and public utility easements dedicated per Map 12903 and Map 13408. Subsequent to the
construction of The Crossings Drive (Hidden Valley Road), City of Carlsbad CT 09-03, Map 15902 recorded
March 4, 2013 as File No. 2013-0139681 and created Lot 9 including a portion of the cul de sac. On December
9, 2014 the City Council approved a ground lease option agreement between Grand Pacific Resorts and the
Carlsbad Public Financing Authority over property including Lot 9. Adoption of the resolution will open that
portion of The Crossings Drive (Hidden Valley Road) within Lot 9 of Map 15902 for public street and public
utility purposes. This action is required to clarify title issues related to the ground lease option agreement.
FISCAL IMPACT:
This item has no fiscal impact to the City of Carlsbad.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a
reasonably foreseeable indirect physical change in the environment, and therefore does not require
environmental review.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, OPENING A PORTION OF THE
CROSSINGS DRIVE LYING WITHIN LOT 9 OF MAP 15902 FOR
PUBLIC STREET AND PUBLIC UTILITY PURPOSES.
WHEREAS, on December 9, 2014 the City Council of the City of Carlsbad approved a
ground lease option agreement between Grand Pacific Resorts and the Carlsbad Public Financing
Authority; and
WHEREAS, to address title issues related to that action it is in the interest of the City of
Carlsbad to open that portion of The Crossings Drive (Hidden Valley Road) within Lot 9 of Map 15902
recorded March 4, 2013 as File No. 2013-0139681 for public street and public utility purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows.
1. That the above recitations are true and correct.
2. That the City of Carlsbad approves the opening of that portion of The Crossings
Drive (Hidden Valley Road) within Lot 9 of Map 15902 for public street and public utility purposes, more
particularly described in the legal description attached as Exhibit "A". The plat attached as Exhibit "B" is
for clarity only.
3. That the City Clerk is directed to record this resolution, the attached legal
description and plat in the office of the County Recorder of San Diego County.
4. That upon recordation of this Resolution at the County Recorder, that portion of
The Crossings Drive (Hidden Valley Road) within Lot 9 of Map 15902 is open for public street and public
utility purposes.
