RECOMMENDED ACTION;
Adopt Resolution No. 2015-014 approving the grant of an easement and right-of-way to San Diego Gas &
Electric Company (SDG&E) for a portion of Parcel 2 (APN 208-010-38 and APN 208-010-42), together with
the right of ingress and egress over the easement and other practical routes across the Fire Station No. 3
site.
ITEM EXPLANATION:
The City of Carlsbad owns a 2.3-acre site located northwest ofthe intersection of Cannon Road and Wind
Trail Way and on which the city is building the new Fire Station No. 3. SDG&E has requested a grant of
an easement at Fire Station No. 3, as described in Exhibit 3. The purpose of the easement is to allow
SDG&E to construct and maintain underground electric facilities for the transmission and distribution of
electricity, and underground communication facilities, together with the right of ingress and egress over
the easement and other practical routes across Fire Station No. 3. These electrical facilities are part of
the ongoing construction ofthe Fire Station No. 3.
SDG&E has submitted draft plans ofthe construction area and will record the easement (APN: 208-010-
38 and 208-010-42), with the San Diego Recorder's Office, if granted by the Carlsbad City Council.
Staff has reviewed the easement documents and recommends that the City Council approve the grant.
FISCAL IMPACT:
There is no fiscal impact to the City of Carlsbad associated with the grant of this easement to SDG&E.
The cost of construction, installation and maintenance ofthe underground electrical facilities is the sole
responsibility of SDG&E.

ENVIRONMENTAL IMPACT;
On November 21, 2012, the Planning Commission adopted Resolution No. 6929 adopting a Negative
Declaration (ND) and approved Resolution No. 6930 approving Conditional Use Permit CUP 12-07 for
Carlsbad Fire Station No. 3. Granting an easement as recommended is within the scope ofthe previously
approved project and no further California Environmental Quality Act (CEQA) compliance is required.

WHEREAS, the City Council of the City of Carlsbad has determined it is necessary,
desirable, and in the public interest for San Diego Gas and Electric Company (SDG&E) to install,
periodically inspect, and maintain electric facilities to provide service to its customers; and

2Q WHEREAS, the Fire Station No. 3 project requires electrical service; and
11 WHEREAS, proposed electric facilities are to be located on property that is owned by the
City of Carlsbad; and
WHEREAS, SDG&E has requested a grant of easement at said Fire Station No. 3 property
for the purpose of constructing and maintaining: (1) underground electric facilities for the
purpose of transmission and distribution of electricity, (2) underground communication

27 facilities, together with the right of ingress and egress over the easement; and
18 WHEREAS, the City of Carlsbad has determined it to be in the public interest to grant an
right-of-way easement at the Fire Station No 3 to per the attached SDG&E construction plans
(Exhibit 4); and
WHEREAS, upon execution of the easement by the City Manager, it will be released to
SDG&E for recordation with the San Diego County Recorder and provide the City of Carlsbad

24 Clerk's Office with a conformed copy; and
25 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows that:
