POLICE AUTHORIZE APPROPRIATION OF FEDERAL ASSET FORFEITURE FUNDS IN THE AMOUNT OF $55,682 TO PURCHASE FIRE PERSONAL PROTECTIVE EQUIPMENT AND STOP STICKS CITY MGR. ^ RECOMMENDED ACTION: City Council to adopt Resolution No. 2015-016 authorizing the appropriation of police federal asset forfeiture funds in the amount of $55,682 for the purchase of fire personal protective equipment and stop sticks. ITEM EXPLANATION: The Poinsettia Fire clearly demonstrated that police personnel also respond to Urban Interface Fires (brush fires that threaten urban structures). During early stages ofthe fire, law enforcement conducted emergency evacuations, traffic control, and security. Officers were subjected to smoke, high heat, flying embers and close contact with burning structures and brush. The standard police patrol uniform provided inadequate protection. Providing officers with fire personal protective equipment i.e. brush jackets and pants, will keep them safer and allow them to provide better service for longer periods of time. Stop sticks are tire-deflation devices that are engineered and constructed to respond to the specific needs of law enforcement in stopping a moving vehicle or preventing movement of a stationary vehicle. They provide officers with an effective tool to end automobile pursuits quickly and safely. Two thirds ofthe existing patrol fleet is not currently equipped with stop sticks. FISCAL IMPACT: There is approximately a $288,000 cash balance available in the police Federal Asset Forfeiture Fund. The cost of fire personal protective equipment for all officers, is $42,578, including patches for jackets (Exhibit 2). The cost of stop sticks is $13,104 (Exhibit 3). Fire personal protective equipment and stop sticks are not purchased via the General Fund, so use of asset forfeiture is allowable (no supplanting). An appropriation of $55,682 from the Federal Asset Forfeiture Fund is being requested at this time. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require further environmental review. The above recitations are true and correct. 23 24 2. The cost of personal protective equipment is $42,578. The cost of stop sticks is 25 $13,104. Use of asset forfeiture funds is allowable (not supplanting), because neither 26 have been purchased via the General Fund. 27 28 y 1 3.
