AUTHORIZING SETTLEMENT OF
WORKERS' COMPENSATION CLAIM OF

RECOMMENDED AaiON:
Adopt Resolution No. 2015-033 authorizing settlement of Workers' Compensation claim of David
Kelso for $34,510.
ITEM EXPLANATION:
The claimant is a retired Fire Engineer. Mr. Kelso sustained a work related injury May 2, 2000
resulting in a permanent disability.
The terms and conditions ofthe proposed settlement are set forth in the Stipulation Request for
Award (on file in the Human Resources Department). The terms and conditions were agreed
upon by the claimant and the city, and have been recommended by Keenan & Associates, the
city's third party administrator.
FISCAL IMPACT:
The cost ofthe settlement is $34,510. There are sufficient funds available in the Workers'
Compensation Self-Insurance Fund to cover the cost of this settlement.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change in
the environment, or a reasonable foreseeable indirect physical change in the environment; and
therefore, does not require environmental review.

WHEREAS, all parties have agreed to settle this claim before the Workers' Compensation
Appeals Board.
5 WHEREAS, Keenan & Associates, the city's third party administrator, has recommended

JO NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Carlsbad, California,
11 as follows:
1. That the above recitations are true and correct.
2. That the expenditure of $34,510 from the Workers' Compensation Self-Insurance
Fund is authorized for the settlement of said claim.
3. That the City Council approves the Stipulation Request for Award on file in the
