RECOMMENDED ACTION:
Adopt Resolution 2015-040 authorizing $150,000 to be transferred from the Council contingency
fund to the non-departmental unfunded litigation fund which will cover unbudgeted legal expenses
and legal fees for outside counsel.
ITEM EXPLANATION:
Due to unbudgeted legal expenses and outside counsel fees for the 2015-2016 fiscal year, the
City Council authorizes $150,000 to be transferred from Council's contingency fund into the non-
departmental unfunded litigation to cover legal fees for the remainder ofthe fiscal year including
costs for implementation of the settlement agreement between NRG and SDG&E, litigation
regarding SB7, leasing City property, and special counsel advice on the General Plan update.
FISCAL IMPACT:
Adoption of this resolution will impact the City Council's contingency fund by $150,000.
ENVIRONMENTAL IMPACT:
The requested action is not a "project" within the definition of California Code of Regulations,
Title 14, Chapter 3, section 15378(a) since the action has no potential for resulting in either a
direct change in the environment or a reasonably foreseeable indirect change in the
environment.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING TRANSFER OF $150,000 FROM THE
COUNCIL CONTINGENCY FUND TO NON-DEPARTMENTAL
UNFUNDED LITIGATION FUND
WHEREAS, during the 2015-2016 fiscal year unbudgeted legal fees have accrued; and
y WHEREAS, the City Council finds it necessary to transfer $150,000 from its contingency
8 fund into the non-departmental unfunded litigation fund to cover these expenses.
9 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows that:

1. The above recitations are true and correct.

2 That the City Council authorizes the Administrative Services Director to transfer
