DIRECTOR CITY ATTORNEY CITY MANAG^F^iJ^ RECOMMENDED ACTION: Adopt Resolution 2015-040 authorizing $150,000 to be transferred from the Council contingency fund to the non-departmental unfunded litigation fund which will cover unbudgeted legal expenses and legal fees for outside counsel. ITEM EXPLANATION: Due to unbudgeted legal expenses and outside counsel fees for the 2015-2016 fiscal year, the City Council authorizes $150,000 to be transferred from Council's contingency fund into the non- departmental unfunded litigation to cover legal fees for the remainder ofthe fiscal year including costs for implementation of the settlement agreement between NRG and SDG&E, litigation regarding SB7, leasing City property, and special counsel advice on the General Plan update. FISCAL IMPACT: Adoption of this resolution will impact the City Council's contingency fund by $150,000. ENVIRONMENTAL IMPACT: The requested action is not a "project" within the definition of California Code of Regulations, Title 14, Chapter 3, section 15378(a) since the action has no potential for resulting in either a direct change in the environment or a reasonably foreseeable indirect change in the environment.
