CITY CLERK TO RECORD NOTICE OF COMPLETION AND
RELEASE BONDS
RECOMMENDED ACTION:
Adopt Resolution No. 2015-061 accepting the contract for construction of the Home Plant
Sewer Lift Station & Force Main Rehabilitation, Project No. 5509 as complete and directing the City Clerk
to record a Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On Jan. 8, 2013 the City Council of the City of Carlsbad awarded a contract to NEWest Construction
Company, Inc. in the amount of $2,563,828 for the construction of the Home Plant Sewer Lift Station &
Force Main Rehabilitation, Project No. 5509.
NEWest Construction Company, Inc. completed the work on Jan. 31, 2015. Staff has inspected the work
and found it to be satisfactory. Staff recommends acceptance of the improvements by the City Council.
FISCAL IMPACT:

The approval of a Notice of Completion is a ministerial process and is exempt from the requirements of
the California Environmental Quality Act (CEQA) pursuant to Carlsbad Municipal Code Section
19.04.070A.l.a.

7 WHEREAS, the construction of the Home Plant Sewer Lift Station & Force Main
8 Rehabilitation was completed to the city's satisfaction by NEWest Construction Company, Inc.
on Jan. 31, 2015; and
WHEREAS, the formal Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California

15 1. That the above recitations are true and correct.
2. That the Home Plant Sewer Lift Station & Force Main Rehabilitation, specifically
identified as Project No. 5509 is deemed complete and is hereby accepted by the City Council of
the City of Carlsbad.
3. The City Clerk of the City of Carlsbad is hereby authorized and directed to execute
21 and record the Notice of Completion for the Home Plant Sewer Lift Station & Force Main
22 Rehabilitation, Project No. 5509.
