RECOMMENDED ACTION:
Adopt Resolution No. 2015-099 authorizing the City of Carlsbad to enter into a Memorandum
of Understanding with the Center for Community Solutions.
Approve and authorize the Police Chief to execute the Memorandum of Understanding between the
Center for Community Solutions and the City of Carlsbad Police Department (Exhibit 2).
ITEM EXPLANATION:
The Center for Community Solutions (CCS) received a grant from the U.S. Department of Justice
Office of Violence Against Women to "encourage arrest policies and enforcement of protection
orders program (Grant #CDFA 16.590)." The grant proposes to strengthen legal advocacy services
and other victim services for victims of sexual assault, domestic violence, dating violence, and
stalking. Participating agencies will collaborate as members of the North County High Risk Team
(North HRT), who identify and respond to victims who are at extreme risk of lethality due to intimate
partner violence.
By entering into this MOU, the Carlsbad Police Department agrees to participate with the Center for
Community Solutions as a member of the North HRT. One detective will work collaboratively with
the Center for Community Solutions North HRT as a case agent for high risk cases, and to refer
eligible victims in order to obtain emergency protective orders, longer duration restraining orders,
assistance with other legal needs, crisis counseling, emergency shelter, transitional housing, and
other basic needs.
FISCAL IMPACT:
The Center for Community Solutions (CCS) received a grant from the U.S. Department of Justice
Office of Violence Against Women to initialize a collaborative effort to identify and respond to
victims who are at extreme risk of lethality due to intimate partner violence. The City of Carlsbad will
not incur any costs as a participant in this collaborative MOU.

ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within
the meaning of CEQA in that it has no potential to cause either a direct physical change in the
environment, or a reasonably foreseeable indirect physical change in the environment, and therefore
does not require further environmental review.

WHEREAS, the City Council concurs that it is in the public interest to strengthen legal

WHEREAS, the Center for Community Solutions (CCS) received a grant from the U.S.
Department of Justice Office of Violence Against Women to encourage arrest policies and

WHEREAS, the CCS will use this grant to support the North County High Risk Team, who

Memorandum of Understanding
The Undersigned organizations hereby enter into a Memorandum of Understanding (MOU) with
Center for Community Solutions (CCS) in support of its fimding application to the U.S. Department of
Justice Office on Violence Against Women Grants to Encourage Airest Policies and Enforcement of
Protection Orders Program, Fiscal Year 2015 (CDFA # 16.590).
This grant application proposes to strengthen legal advocacy services and other victim services for
victims of sexual assault, domestic violence, dating violence, and stalking, including strengthening
assistance to such victims in immigration matters, for abuse victims who either reside m the North
Region of San Diego Coimty or who have cases m the North Coimty Judicial District. This grant
application also includes a continuation of the North County High Risk Team (North HRT), a
collaboration among Partners that identifies and responds to victims who are at extreme to severe risk
of lethality due to ultimate partner violence. The Project enhances victim services in North County
mcluding the underserved populations of Latinas and military families.
Partners and History
The Partners of the proposed Project are Center for Community Solutions (CCS, lead agency), Casa
Cornelia Law Center (CCLC, subcontractor), San Diego County District Attorney's Office (SDCDA),
County of San Diego Sheriffs Department (SDSD), Carlsbad Police Department (CPD), Escondido
Police Department (EPD), and Oceanside Police Department (OPD).
The Partners on this Project have a long history of collaboration and coordination of services across
disciplines. The Partners have collaborated for eleven years as participants m the North County Family
Violence Prevention Center (NCFVPC), a multidisciplinary project that provided coordinated case
management of domestic violence, dating violence, sexual assault and stalking cases in North San
Diego County. In 2013, Partners established the North HRT as part of their NCFVPC work. In addition
to the NCFVPC project, the Partners have also collaborated for twenty-four years as members of the
San Diego County-wide Sexual Assault Response Team.
All the partner agencies will continue to work closely together on the proposed Project to assist victuns
in obtaining short duration emergency protective orders, longer duration restraining orders, assistance
with other critical legal needs (family law, mcome maintenance, housing, and employment, e.g.), crisis
coimseling, emergency medical care, case management, emergency shelter, transitional housing,
transportation, counseling, and other basic needs. Partners will also continue to work collaboratively to
improve victim safety and hold perpetrators accountable through the North HRT.
Development of the Application
Representatives from CCS, CCLC, SDCDA, SDSD, CPD, EPD, and OPD have participated in the
development of the application including the development of this Memorandum of Understanding.
Activities proposed herein are the result of collaborative planning, group discussions, review of past
collaborative work, and ongoing coordination on the part of partners.
Roles and Responsibilities of Partner Organizations
1) All partners will:
a. Strive to ensure victim safety and increase perpetrator accountability;
b. Participate in biweekly North HRT case review meetings, in person, or via remote access portal;
c. Share pertinent information regarding clients to ensure optimimi services are provided to each
client with appropriate and informed client consent to release information; and
d. Refer cases to Children's Services, Child Welfare Services, Agmg and Independent Services, and
Adult Protective Services when appropriate.

2) CCS will fulfill the followmg specific responsibilities:
a. Serve as lead agency for the project;
b. Submit quarterly financial and semi-annual progress reports to OVW;
c. Employ and supervise one (1) full-time equivalent bilmgual (English/Spanish) Project Manager/CA-
Licensed Attomey, one (1) full-time equivalent bilingual (English/Spanish) Legal Advocate, and one
part-time bilingual (English/Spanish) Administrative Assistant with project fimds;
d. Convene and facilitate North HRT meetings;
e. Convene and facilitate meetings between CCS and Partners to review progress towards program goals,
discuss changing and evolving needs of the community and develop and implement strategic action
plans regarding project implementation as well as activities that strengthen and foster collaborative
relationships;
f. Serve as the Case Coordinator at North HRT meetings, collect data, follow up with members to ensure
response steps are implemented, and track outcomes;
g. Assist victims in obtaining both short duration emergency protective orders and longer duration
restraming orders and provide legal representation with restraining order proceedings;
h. Assist victims with other critical legal needs (femily law, income maintenance, housing, and
employment, e.g.)(partly with leveraged funds);
i. Coordinate with CCLC on cases with immigration-related concerns;
j. Assist victims in obtainmg crisis counseling, emergency medical care, case management, emergency
shelter, transitional housing, transportation, and other basic needs;
k. Provide sexual assault victim advocacy services, includmg 24-hour emergency response in-person
hospital accompaniment and follow-up case management services (with leveraged funds),
1. Provide 24-hour domestic violence and sexual assault hotline services to provide crisis counseling,
information and referrals to clients after hours (with leveraged funds); and
m. Participate in required OVW trainings.
3) Casa Cornelia Law Center
a. Refer adult victims of sexual assault, domestic violence, dating violence, and stalkuig to CCS legal and
advocacy services and North HRT when appropriate;
b. Identify CCLC staff member and/or volunteer to participate in the North HRT meetings and tramings,
as appropriate. Provide legal assistance regarding immigration issues dealing with either U-Visas or
VAWA self-petitions as resources allow and

4) SDCDA's office will fulfill the following specific responsibilities:
a. Participate in ongoing planning and coordination meetings relating to grant activities;
b. Assign a Deputy District Attomey and a District Attomey Investigator (provided with leveraged funds)
to provide case investigation follow-up, client referrals to the program, data collection, danger
assessment, liaison with local law enforcement agencies to assist with vertical prosecution, and case
coordination with CCS legal and advocacy staff;
c. Participate in cross-training with project Partners, as available and appropriate;
d. Provide leadership in the implementation and ongoing refinement of the North HRT model; and,
e. Refer adult victims of sexual assault, domestic violence, dating violence and stalkmg to CCS and
North HRT for services.
5) SDSD, CPD, EPD, OPD, will fiilfill the followmg specific responsibilities:
a. Refer eligible victims of sexual assault, domestic violence, dating violence, and stalking to CCS legal
and advocacy services and to the North HRT when appropriate;
b. Assign a representative to serve as a liaison and point of contact to the North HRT;
c. Participate as needed in ongoing planning and coordination meetings relating to the North HRT;

d. Ensure that staff assigned to North HRT have completed the required online Danger Assessment
training and certification process;
e. Educate victims referred to the HRT on the potential risks and benefits of participating in the HRT,
uicluding the limits of confidentiality of the HRT, and obtam the victim's informed consent to
participate in the North HRT process;
f. With victim consent, conduct case records checks in ARJIS;
g. Assist with the unplementation of any response steps, such as follow up investigation, that are
determined to be the role of said agency at the North HRT meeting;
h. Serve as case agent for any high-risk cases referred to the North HRT by said agency; and
i. Allow CCS and DA staff to deliver training on CCS legal and advocacy services as well as North HRT
at shift change line-ups to sworn staff and other venues, where appropriate.

These team members will continue to collaborate as members of the North HRT. In addition, team members will
refer victuns of domestic violence, sexual assault, and stalking to CCS for confidential legal and advocacy services,
includmg lethality assessments and safety planning. Individual team members are responsible for ensiuing that their
respective organizations fulfill then- roles as outlined in this MOU as well as for supporting and supervising staff
under their employ who participate in the North HRT. To such end, team members meet and commimicate with the
Project Manager regularly.
Budget Approval
All Partners have reviewed and approved the proposed budget.
Resource Contribution of Each Partner
1) CCS agrees to provide sexual assault victim advocacy services, 24-hour domestic violence and sexual
assauh hotline crisis counseling, trauma-informed individual and group therapy, domestic violence shelter,
and prevention and education services, at no cost to the Project;
2) CCLC agrees to provide....
3) SDCDA agrees to participate in this program, including contributing a District Attomey Investigator, who
will provide case investigation, follow up, and case coordination, and a Deputy District Attomey, who will
serve on the North HRT, at no cost to the grant.
4) SDSD will agree to participate in this program, including designating representatives from the San Marcos
and Vista Sheriffs Stations to serve on the North HRT, at no cost to the grant.
5) Carlsbad Police Department will agree to participate in this program, including designating a Detective to
serve on the North County HRT, at no cost to the grant.

6) Escondido Police Department will agree to participate m this program, including designating a Detective
from the Family Protection Unit to serve on the North County HRT, at no cost to the grant.
7) Oceanside Police Department will agree to participate in this program, including designating a Sergeant to
serve on the North County HRT, at no cost to the grant.
Timeline
The duration of this collaborate effort will correspond with the grant period, anticipated to be October 1,2015
through September 31,2018.
Approval
We, the imdersigned, have examined and are in support of the contents of this MOU pertaining to CCS' application
for the U.S. Department of Justice, Office on Violence Against Women, Fiscal Year 2015 Grants to Encourage
Arrest Policies and Enforcement of Protective Orders Program. Upon careful inspection of the proposed budget
applying to the extensive collaborative efforts detailed in this application, we stand in agreement with its contents.
