I am writing to you to point out what I believe are some misconceptions provided to you by City Planning Staff in their report recommendingthat you deny the appeal by Lisa Gunther regarding MCUP-14-17. While I cannot address the issues of zoning I do have specific expertise in the area of sh10oting range design, development and operations including issues of maintenance and lead management. My professional background is as a Law Enforcement officer. I served 28 years with the Carlsbad Police Department and retired as a Captain in late 2013. During my career I served as a fiream1s instructor, department armorer, firearms training supervisor and weapons training unit manager. I have been Cl member ef the National Shooting Sports Foundation (NSSF), the National Association of Shooting Ranges (NASR) and completed the National Rifle Association's range development training course. I served as the principle police~ member of the City team that developed, designed and constructed the City of Carlsbad's state of the art Public Safety Training Center. (STC) When we set out to develop an indoor training facility with live fire shooting ranges om~ of the major considerations was how to maintain a safe and healthy environment for our training staff and officers. Lead exposure is one of a nUJmber of health and safety issues for those who work regularly with firearms especially in an enclosed range. What we found is that with careful design and effectiVE! operations policies, maintenance routines and cleaning practices we could effectively mitigate the problems caused by airborne lead and other £:ontaminants. With these BMPs in place we have run the (SCT) for over two years and 10s of thousands of rounds fired with no environmental or health related prCiblems. This has been verified by independent environmental testing and regular employee health moniitoring. These practices are not difficult to implement or maintain and are consistent for all shooting facilities either publicly or privately owned. I am familiar with the conceptual plans for the Gunther's facility and know that they are well aware of these issues and have the same level of commitment to the health and welfare of their future customers as we have for our City employees. I would like to draw your attention to Attachments #9 and #12. Both of these documents explain the appropriate design, construction am;l subsequent maintenance practices that support the development and operation of a safe indo>or shooting range. Attachment #9 lead Management and OSHA Compliance for Indoor Shooting Ranges, produced by NSSF, is an updated version of one of the documents I used when planning the design and operation of the shooting ranges at the carlsbad SCT. Attachment #8 produced by the Centers for Disease Control focuses primarily on a limited number (by comparison with the number of recreational shooters nationwide) of lead exposure cases. It appears that most of those that they cited from shooting facilities were not maintained to proper standards. Attachment #11 an article from the Seattle Times appears to be reporting with a particular bias. They appear to have focused on some tragic but exceptional case studies to make a dramatic point. These stories from poorly designed or maintained facilities should have no bearing on the application before you. Staff has presented no evidence that the Gunther's intend to build a facility and then not properly maintain it. That would definitely not be in their best interest as community members <lr as a business entity which depends on satisfied customers for their livelihood. Attachment #10 "Poisonous; Pastime, The Health Risks of Shooting Ranges and Lead to Children, Families and the Environment" I found the opening paragraphs of the document alluding to a link between lead exposure at shooting ranges, to "violent criminal activity" or "spree shooting'' off putting. Ingesting lead is definitely hazardous and c:an have detrimental health impacts but historically, children with high lead levels have been linked to le!ad tainted paint and other domestic sources of contamination. As with the other articles the reference to outdoor ranges and lead management has no bearing on the indoor project up for your consideration. While dramatic stories of contamination may be compelling they are certainly not the norm. Unfortunately in this case I think it may also be overstated. I have been a recreational shooter since I was 16 and have spent mom time on ranges both indoor and outdoor than most gun owners or casual shooters ever will. I have taught shooting skills and safe firearms handling to youth camp attendees and police officers alike and I have never experienced any ill effects from these activities. As a law enforcement officer, where firearms are an unavoidable part of daily life, I chose to tea1ch my own children gun safety and let them shoot when they were old enough to understand the safety concepts. As pre-teens they often aco:>mpanied me to the City's old outdoor range and even helped in picking up brass and cleaning up. This was well before we adopted updated range maintenance equipment and clean-up consisted of regular soap and water. My son is now a High School teacher and my daughter is a PhD candidate conducting cancer research at a prominent University. In conclusion, while managing lead exposure is an important consideration in the operation of an indoor shooting range, current ran1ge designs, proper air and material handling equipment and effective maintenance practices make it an easily managed. Based on my professional training <md experience I believe that using the lead issue as a pretense for recommending denial of the Gunthe1r's MCUP request would be improper and unsupported by the evidence presented to you. I regret that I am not able to address you directly due to scheduling issues. I encourage you to visit the Carlsbad SafE~ty Training Center if you would like to see first-hand how cleanly and efficiently a well-designed and well maintained indoor shooting range can be managed. Sincerely, William Rowland The issue before us this ~evening is the definition of "Recreational" and "Recreational Shooting". I have selected a number of unbiased sources that define "Recreational" and "Recreational Shooting" to help us with the core issue of this evening's consideration. Webster's Colligate Dictionary defines "Recreational" as an adjective of recreation which is defined as, "to create anew, restore, refresh, refreshme~nt of strength and sprits after work, a means of refreshment or diversion, hobby. Wikitravel states that Recreational shooting catn refer to several activities including hunting, participating in shooting competitions, or using firearms as a hobby. San Bernardino County publishes a map showing "Recreational Shooting and Hunting Areas" USDOJ, National Institute of Justice, in the", introductory paragraph of "Guns in America National Survey on Private Ownership and Use of Firearms states, "The nearly 200 million guns in private hands are used in part for recreation, mostly hunting and target shooting." Of course zoning and planning regulations are not applicable on Camp Pendleton. 2. Poway Weapons & Gear's indoor range has 42,000+ square feet, 42 lanes and three separate ranges -25, 50 and 100 yards it is the third largest indoor gun range in the nation. This range is located at 13550 Danielson Stree~t. Poway, 25 miles from the proposed Gunther's Gun Shooting Range. & shooting range is on unanimously approved by the Poway City Council in February 2012,. 3. Sights' is a smaller range with 24lanes and has 2 separate ranges ·-15 and 25 yards. This range is located at 618 Airport Rd. Oceanside, 10 miles from the proposed Gunther's Gun Shooting Range the 4. Center is a small range with 14 twenty-five yard lanes. This rangE~ is located at 5590 Ruffin Rd, San Diego, 26 miles from the proposed Gunthe~rs Gun Shooting Range the property is zoned IL-:2-1 vvhich allows recreation facilities. 5. Diego's indoor range is a small range with 13 twenty-five yard lanes. This r~nge is located at 7853 Balboa Ave, San Diego, :26 miles from the proposed Gunther's Gun Shooting Range the property is zoned IL-3-1 which allows rc:.r•rc.,;nu"'t ' ' f' ~: • 6. San indoor range is a small range with 10 twenty-five yard lanes. This range is located at 12150 Flint PI, Poway, 25 miles from the proposed Gunther's Gun Shooting Range the is allows recreation facilities 7. P2K Range's indoor range is a larger facility with 11 twenty-five yard, 2 fifty yard and 7 one-hundred yard lanes. This range is located at 2082 Willow Glen Drive, El Cajon, 40 miles from the proposed Gunther's Gun Shooting Range the property has a land use designation A72 and a zoning of SR-4, semi-rural residential.which allows participant sports and recreation. All of these ranges have a sophisticated purging filtered ventilation system for cleaner air for the shooter and surrounding properties that effectively surpass all NIOSH, NRA, and OSHA air quality standards. The old saw, "Comparisons are odious", may seem to apply here. Howevelr the point of examining other agency zoning regulations as they apply to this case is that for every indoor shooting range in the cities located in San Diego County and San Diego County has been approved and iis located within a planning zone that allows shooting ranges to be included under the designation of "Recreational Uses". For the planner to determine that recreational use does not include an indoor shooting range is arbitrary and capricious. Firearms and Lead Contamination Safety 1. Data sources including the National Center for Health StatisticS, the National Safety Council, the Bureau of the Census, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and firearms industry reports, the 2009 Fact Sheet on Firearms Accidents proves that despite a doubling of our country's population since 1930, and a quintupling in the number of privately owned firea1rms, the annual number of accidental firearms deaths has decreased 75%. In fact, the fatal firearm accident rate has decreased 92% since the all-time high recorded in 1904. Nationwide, the annual number of fatal firearm accidents among children has decreased 86% since 1975. 2. Comparisons to Other Sports -The National Safety Council's Injury Facts 2008 Edition, as well as the International Hunter Education Association, the fact sheet reveals that only 2 people per 100,000 are injured while enjoying the sport of hunting, compared to 2,585 who are injured while playing football, 1',984 basketball players, 1,349 bicycle riders, 1,332 soccer players, 1 ,29fi skateboarders and 1,122 baseball players (all per 100,000). I further understand that the Planning Commission, in a tie vote, upheld the planner's finding after being asked to vote only on whether the planner had abused his position in making this determination. In fairness to residents and the business owners who applied for the permit, I urge you to reconsider the issue on its own merits. Whether the planner abused his power or erred unintentionally is, at this piJint, an employment matter. This tragedy likely spurred women in Carlsbad to go through the legal steps to buy firearms for their own defense against similar attacks, and they deserve and need a place to practice safe firearm handling. • Carlsbad has the highest percentage of female residents in the entire North County. It's higher than Vista, Oceanside, San Marcos, Escondido, Encinitas, Poway, San Diego (city)'and the county as a whole. I want to live, work, play, shop and accomplish as much as possible in my own town. There seems to some disjoint and reluctance of the Planning Commission to validate that shooting sports are a recreational activity. And while the exact use is not specified in the City Planning Documents, you cannot hardly ever think all uses could be spelled out in such a document. Is it not the Planning Commissions job to work these matters out? It sure seems to me that such a use in the proposed location would be an asset to the city. Recreational shooting, target practice, firearm safety training are an important part of many familiies activities no to mention another place for persons who carry firearms as part of their work etc. and need to practice to stay proficient. As such,a local range than instructs on firearm safety and teaches shooting sports with a quality facility in our area would be fantastic. Traveling to adjacent cities or all the way to Riverside and Orange Counties to shoot is really a lot of effort. Shooting ranges like the one proposed are so well regulated by the State and Federal government there can be no operational issues surrounding this use. I fully support this use in our City and even more so in the proposed location so we have yet another recreational activity in which to participate on our own backyard. Please, I encourage to you to vote to allow the proposed shooting range to be built and operated for the benefit of our entire city population.
