CITY OF CARLSBAD WITH COUNTY SUPERVISORS

RECOMMENDED ACTION:
Adopt Resolution No. 2015-149 approving the Risk Manager to act on behalf of City of
Carlsbad with County Supervisors Association of California dba California State Association of Counties
Excess Insurance Authority (CSAC-EIA).
ITEM EXPLANATION:
The city had previously purchased excess liability insurance on the open market. This year, Risk
Management obtained monetary indications from several liability risk financing pools. CSAC-EIA provided
the most competitive pricing indication with better terms than the city currently possesses with private
insurance.
On May 6, 2015 the CSAC-EIA Underwriting Committee approved moving forward with the membership
of the City of Carlsbad and on May 1, 2015 the CSAC-EIA Executive Committee completed the process to
confirm the City of Carlsbad as a full member.
Once approved for membership, CSAC-EIA requires each member agency to delegate a person with
authority to act on the member's behalf in matters relating to the member and the Authority. The
designee's duties related to the CSAC-EIA may include attending board meetings, communicating with
the CSAC-EIA regarding city operations and audits, and responding to the yearly application process.
FISCAL IMPACT:
Joining this risk sharing pool will provide the stability of higher liability limits along with a lower self-
insured retention at a substantial savings over insurance purchased on the open market. CSAC-EIA is one
of the largest risk sharing pools in the country and possesses impressive financial stability.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment,
or a reasonably foreseeable indirect physical change in the environment, and therefore does not require
environmental review.

7 WHEREAS, The CSAC Excess Insurance Authority (Authority) has approved
Membership of the City of Carlsbad into the Authority;
WHEREAS, The CSAC Excess Insurance Authority has determined that it is necessary for
each member of the Authority to delegate to the Risk Manager authority to act on the
members' behalf in matters relating to the member and the Authority; and

1^ WHEREAS, except as to those actions that must be approved by the City of Carlsbad,
14 such delegation of authority is necessary in order to carry out the purposes and functions of the
15 Authority with its members; and
WHEREAS, in order to ensure the Risk Manager is delegated with authority to act on the
member's behalf in matters relating to the member and the Authority, action by the members
governing body is necessary.

managed facilities? If so, info on the projects, provide information on any claims
received regarding Lead exposure over the past 7 years.
e. Are there any underlying insurance programs which currently provide coverage for
Lead exposure

(see attached for application and additional premium for NP's) or are they not including
coverage?

Regarding Loss Prevention:
EIA has informed us that any prospects for WC and GL that would like to join the program on
7/1/2015 must have the loss prevention meeting no later than 4/15/2015 so that they can be
added to the agenda by 4/29/2015 for approval by the UW meeting on 5/6/2015 and the
Executive Meeting on 5/7/2015. For the convenience of everyone, they would like to schedule
one loss prevention meeting for both GL and EWC however they will need the above EWC
documents prior to this meeting.
