Clerk THE LIMITS OF THE 40 MPH SPEED ZONE AND CITYMGR REMOVAL OF 25 MILE PER HOUR SPEED ZONE ON CADENCIA STREET RECOMMENDED ACTION: Adopt Ordinance No. CS-275 amending title 10, chapter 10.44, of the Carlsbad Municipal Code by the revision of section 10.44.200 to modify the limits of the 40 mph speed zone and removal of 25 mile per hour speed zone on Cadencia Street. ITEM EXPLANATION: Ordinance No. CS-275 was introduced and first read at the City Council meeting held on May 19, 2015. The second reading allows the City Council to adopt the ordinance. The City Clerk will have the ordinance or a summary ofthe ordinance published within fifteen days, if adopted. FISCAL IMPACT: See AB #21,969 on file in the Office of the City Clerk. ENVIRONMENTAL IMPACT: This project is exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301(c) -minor alteration of existing facilities, including streets, sidewalks, gutters, and similar facilities involving negligible or no expansion. CS-275 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.200 TO MODIFY THE LIMITS OF THE 40 MPH SPEED ZONE AND REMOVAL OF 25 MILE PER HOUR SPEED ZONE ON CADENCIA STREET EXHIBIT 1 WHEREAS, the City Council approves of the amendment to the Carlsbad Municipal Code Section Title 10, Chapter 10.44, of the Carlsbad Municipal Code by the revision of Section 10.44.200 to modify the limits of the 40 MPH speed zone and removal of 25 mile per hour speed zone on Cadencia Street. NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows that: 1. Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the revision of Section 10.44.200 to read as follows: "10.44.200 Cadencia Street: a. Upon Cadencia Street from Del Rey Avenue northerly to a point five hundred feet west of Perdiz Street, the prima facie speed limit shall be forty miles per hour. EFFECTIVE DATE: This ordinance shall be effective thirty (30} days after its adoption; and the city clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the city attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
