RECOMMENDED ACTION:
City Council receive and file this report.
ITEM EXPLANATION:
Assembly Bill (AB 1234), enacted on October 7, 2005, effective January 1, 2006 (Government Code
Section 53235), requires all local officials such as City Council Members and district governing board
members to receive two hours of mandatory ethics training every two years. The training covers topics
related to transparency laws and fair process, including disclosure of economic interests; conflicts of
interest under the Political Reform Act, Brown Act, Public Records Act, common law bias and due
process.
AB 1234 provides local agencies the option of offering one or more training courses, or sets of self-study
materials with tests, to meet requirements of the law, courses may be taken at home, in-person or
online. Standard practice has been to take the online course which meets requirements.
The City Attorney is offering the training at a City Council meeting to provide a more interactive course.
This will meet the requirements of the two-hour training and will provide participants with proof of
participation to meet the biennial training requirements of section 53235.2.
Objectives of the training are:
• To alert officials to the kinds of interests and activities that trigger disclosure or disqualification
under ethics laws.
• To advise officials to avoid prohibited activities, comply with disclosure requirements and to
consult with qualified legal counsel or regulatory authorities regarding specific situations.
• To advise officials of legal consequences of violating ethics laws
