RECOMMENDED ACTION:
Adopt Resolution No. 2015-157 accepting bids and authorizing the award of a contract for the
construction ofthe Library Renovation Projects, Project Nos. 4030 and 4020.
ITEM EXPLANATION:
For the past two years, staff has been working on the refurbishment and enhancement of both the Georgina
Cole Library (Cole Library) and Carlsbad City Library (Dove Library). The purpose of this effort is to continue
providing top quality services and revitalize Library & Cultural Arts infrastructure to maximize its current
and future benefit to the community.
On April 7, 2015, the City Council authorized staff to release invitations to bid for the Library Renovation
Projects, (project number 4020 and 4030). The pre-qualified firms were invited to submit a bid for providing
general construction services for both libraries.
On May 28, 2015 the city received five sealed bids for the construction of Library Renovation Projects which
are summarized in Table 1:

Staff has completed their review of the bid documents submitted by the low bidder, Prava Construction
Services, and found them to be in order. The Augustine Company submitted a protest on the basis that
Prava did not list the low voltage sub-contractor on the Designation of Subcontractors Form. Prava has
informed the city that the low voltage scope of work will be performed by their electrical sub-contractor.
Precision Electric. Upon review, staff determined that Precision Electric has the required licenses to perform
the low voltage work. Therefore, staff recommends that Prava's bid is both responsive and responsible.
Staff recommends that the City Council award the contract for the construction ofthe Library Renovation
Projects to Prava Construction Services in the amount of $5,473,968, which is the total of the base bid
defined in the RFP. The engineer's estimate for the base bid for the construction of the project was
$5,600,000.

FISCAL IMPACT:
The total approved budget for the projects is $11,346,529, which includes $5,300,000 for the Cole Library,
and $6,046,529 for the Dove Library. $5,600,000 of these funds is available for the construction contract
award, in addition, a contingency of $710,000 is available from this fund to apply towards this construction
contract. No additional appropriation is required at this time.
ENVIRONMENTAL IMPAa:
This project is exempt from California Environmental Quality Act (CEQA) review pursuant to CEQA
Guidelines Section 15301(d) - Existing Facilities - restoration or rehabilitation of existing facilities that are
deteriorated or damaged and are required to meet current standards of public health and safety involving
negligible or no expansion of use.

7 WHEREAS, city facilities are necessary to meet the current and future Library & Cultural
8 Arts services within the City of Carlsbad; and
^ WHEREAS Public Contract Code ("PCC") §20101 authorizes cities to pre-qualify

contractors who wish to bid on public works contracts; and authorizes staff to release invitations to
11
bid to the qualified contractors; and

J2 WHEREAS, city staff pre-qualified six contractors to submit bids for the Library Renovation
14 Projects in accordance with PCC §20101; and
15 WHEREAS, ON April 7, 2015, through Resolution No. 2015-090, the City Council ofthe City
of Carlsbad approved the plans and specifications for furnishing of all labor, materials, tools,

equipment, transportation, and other expenses necessary or incidental to Library Renovation
18
Projects, Project Nos. 4030 and 4020; and
2Q WHEREAS, five sealed bids were received on May 28, 2015 by the City of Carlsbad for the
21 construction ofthe Library Renovation Projects, Project Nos. 4030 and 4020; and
22 WHEREAS, the lowest responsive and responsible bid for the project was submitted by
Prava Construction Services Inc. in the amount of $5,473,968; and
WHEREAS, The Augustine Company, the second lowest bidder, has alleged that Prava
Construction had failed to list the low voltage sub-contractor in the Designation of Subcontractors

1 WHEREAS, staff has investigated the claim and determined that the low voltage work will
2 be performed by Prava's electrical subcontractor. Precision Electric, who was properly listed and
3
has the required license to perform this work, and therefore, recommends the City Council deny
4
the protest; and
5
, WHEREAS, funding for said project has previously been appropriated from the General
6
7 Capital Construction and Infrastructure Replacement Funds in the amount of $6,310,000 to cover
8 all contract costs including contingency and is sufficient; and
^ WHEREAS, payment of prevailing wages will be required as part of the construction

contract.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California,
as follows:
1. That the above recitations are true and correct.
2. The bid protest from The Augustine Company is denied as Precision Electric was
properly listed and has the required license to provide the low voltage work.
3. That the bid amount of $5,473,968 submitted by Prava Construction Services Inc.
for the construction of the Library Renovation Projects, is accepted and the Mayor is hereby
authorized to execute a contract with Prava Construction Services Inc.
4. That the City Manager is hereby authorized to approve construction change
orders up to $710,000 (13 percent) for Projects 4030 and 4020.
5. Thatthe award of this contract is contingent upon Prava Construction Services Inc.
executing the required contract and submitting the required bonds and insurance policies, as

described in the contract within 20 days of adoption of the resolution with the understanding that
the City manager may grant reasonable extensions of time.
