RECOMMENDED AaiON: Adopt Resolution No. 2015-190 authorizing the City Manager to sign an amendment to the reimbursement agreement with San Diego County Water Authority (SDCWA) in the revised amount of $1,228,049 to provide additional asphalt paving associated with installation ofthe Carlsbad Desalination Conveyance Pipeline. ITEM EXPLANATION: On May 5, 2015, the City Council approved Resolution No. 2015-108 authorizing the City Manager to sign a Reimbursement Agreement with the San Diego County Water Authority (SDCWA) in the amount of $975,000. This amount was based on the city agreeing to fund the cost of restoring the asphalt over the additional roadway width. Following a thorough field investigation, it has been determined the city's share of the additional asphalt overlay, removal and replacement, leveling course and grinding shall not exceed $1,228,049. The city's share ofthe cost has increased due to additional asphalt removal and replacement and pavement leveling courses not included in the original quantities estimated. The increased cost also includes administrative fees included in the Design Build Agreement between SDCWA and Poseidon Resources. FISCAL IMPAa: The reimbursement agreement provides for the city to be responsible for the additional Vi roadway width or $1,228,049. There are sufficient funds available in the Pavement Management Program and no additional appropriation is needed. Pavement Management Program funds consist of non- jurisdictional fees (generated from trash haulers). Gas Tax funds and TransNet-Local funds (available for drawdown from SANDAG). EXHIBIT 1 RESOLUTION NO. 2015-190 3 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO SIGN AN AMENDMENT TO THE REIMBURSEMENT AGREEMENT WITH SAN 4 DIEGO COUNTY WATER AUTHORITY (SDCWA) IN THE REVISED AMOUNT OF $1,228,049 FOR ADDITIONAL ASPHALT PAVING 5 ASSOCIATED WITH INSTALLATION OF THE CARLSBAD DESALINATION CONVEYANCE PIPELINE. 6 7 8 9 10 26 27 28 WHEREAS, on June 13, 2013 the city issued an Encroachment Permit to the San Diego County Water Authority (SDCWA) for the purpose of establishing reasonable rules for use of the public right-of-way associated with the installation of the Carlsbad Desalination Conveyance 11 Pipeline; and 12 WHEREAS, the SDCWA acknowledged that the public right-of-way is owned and 13 controlled bythe city; and 14 WHEREAS, it is necessary and in the public interest to repair and restore several ofthe 15 effected sections of pavement to current city standards; and 16 17 WHEREAS, staff has deemed it appropriate that the cost for the pavement restoration 18 be shared by the city and the SDCWA; and 1^ WHEREAS, a reimbursement agreement in the amount of $975,000 between the city 20 and the SDCWA was approved on May 5, 2015; and 21 WHEREAS, an amendment to the reimbursement agreement in the amount of 22 22 $1,228,049 between the city and the SDCWA includes additional paving and administrative 24 costs associated with the Carlsbad Desalination project; and 25 WHEREAS, there are sufficient funds available in the Pavement Management Program to cover the city's portion ofthe pavement restoration; and WHEREAS, staff is currently negotiating the terms ofthe agreement 3 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2.
