IMPROVEMENT AND LA COSTA AVENUE SLOPE REPAIR

RECOMMENDED ACTION:
Adopt Resolution No. 2015-201 awarding the contract to Vailston Company, Inc., in the
amount of $404,553 and appropriating an additional $51,112 in Gas Tax funds to construct the
Romeria Drainage Improvement and La Costa Avenue Slope Repair Projects, Project Nos. 6604 and
6024.
ITEM EXPLANATION:
The Romeria Drainage Improvement Project is the replacement of an existing concrete lined
drainage channel which runs through open space westerly of Romeria Street. Channel
improvements include removal of the existing damaged concrete channel. The concrete channel
will be replaced in the same location. Slope protection at the headwall connecting the channel to
the storm drain system and an all-weather maintenance access road are included in the channel
improvements.
The La Costa Avenue Slope Repair Project includes repairing an area subject to historic landslides
located on city property south of La Costa Avenue just westerly of the channel. Installation of a
subdrain system and geotextile fabric within the reconstructed slope will prevent future slope
movement.
The area outside the channel footprint impacted as a result of the construction of the projects will
be replanted under a separate contract. The remaining impacts from both projects will be mitigated
at the Lake Calavera Preserve under a separate contract.
An Engineer's Estimate of the construction cost for the Romeria Drainage Improvement and La
Costa Avenue Slope Repair Projects was prepared by Rick Engineering Company, the consulting
engineer of work and totals $405,000.

On June 16, 2015, five sealed bids were received for the construction ofthe project as shown on
the following table.

FISCAL IMPACT:
The following tables show a breakdown of the project costs including the current status of the
funding sources. All project components have sufficient funding with the exception ofthe La Costa
Avenue Slope Repair Project. Staff is requesting an additional appropriation of $51,112 from the
Gas Tax Fund to fully fund the La Costa Slope Repair Project, Project No. 6024.

ENVIRONMENTAL IMPACT:
A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program
(MMRP) were prepared forthe Romeria Drainage Improvement and La Costa Avenue Slope Repair
projects (HMP 09-03). The MND was adopted bythe City Planner on Dec. 7,2009 in compliance with
the California Environmental Quality Act (CEQA) Guidelines Section 15074.

None required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AWARDING THE CONTRACT TO VAILSTON COMPANY,

WHEREAS, the City Council ofthe City of Carlsbad, California, has determined it necessary,
desirable, and in the public interest to construct the Romeria Drainage Improvements and La
Costa Avenue Slope Repair Projects, Project Nos. 6604 and 6024; and
11 WHEREAS, On April 21, 2015, the City Council adopted Resolution No. 2015-093 which
12 approved the plans and specifications and advertised for bids for the Romeria Drainage

Improvement and La Costa Avenue Slope Repair Projects, Project Nos. 6604 and 6024; and

WHEREAS, on June 16, 2015 five sealed bids were received, opened and witnessed for the
15
construction of this project; and

jy WHEREAS, the lowest responsive and responsible bid to construct said project was
18 submitted by Vailston Company Inc. in the total amount of $404,553; and
1^ WHEREAS, funding for said projects has been appropriated from the Gas Tax and General
Capital Construction Funds; and
WHEREAS, an additional appropriation of $51,112 from the Gas Tax Fund is needed to
fund the La Costa Avenue Slope Repair, Project No. 6024, project costs; and

24 WHEREAS, Section 3.28.040 (c)(5) of the Carlsbad Municipal Code authorizes the City
25 Manager to approve change orders in the amount equal to the contingency set at the time of
project award.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California,

as follows:
1. That the above recitations are true and correct.
2. That the low bid submitted by Vailston Company Inc. for the construction of the
Romeria Drainage Improvement and La Costa Avenue Slope Repair Projects, Project Nos. 6604

y and 6024, is accepted and the Mayor is authorized to execute a contract for this project

amount up to $50,000 for the Romeria Drainage Improvement Project No. 6604 and $25,000
forthe La Costa Avenue Slope Repair, Project No. 6024, project.
5. That the award of this contract is contingent upon the bidder submitting the
II lowest responsible bid executing the required contract and submitting the required bonds and
lg insurance policies, as described in the contract, within 20 days of adoption of this resolution.
