POLICE AMOUNT OF $1,000 TO CONTRIBUTE TO THE CITYMGR. ~itJ SAN DIEGO SHERIFF'S DEPT TO HELP FUND A REGIONAL GUN BUY BACK EVENT RECOMMENDED ACTION: Adopt Resolution No. 2015-214 authorizing the appropriation of police federal asset forfeiture funds in the amount of $1,000 to contribute to the San Diego Sheriff's Department (SDSO) to help fund a regional gun buy-back event. ITEM EXPLANATION: The Carlsbad Police Department is participating in a regional gun buy-back event, in partnership with the SDSO on October 24, 2015. The event will offer community members gift cards in exchange for turning in a firearm. The Police Department will transfer $1,000 in federal asset forfeiture funds to the SDSO to purchase gift cards. The Sheriff's Department will, in turn, give a gift card to community members who turn in firearms. Carlsbad community members can participate in this gun buy-back event. FISCAL IMPACT: The Department of Justice's Guide to Equitable Sharing states cash transfers of shared funds from one state or local agency to another is permissible, as long as the use of funds is permissible and the funds transferred are used by an eligible agency. Buy-back programs are listed specifically as a permissible use of shared funds, in that they further law enforcement goals or missions, and the SDSO is an eligible agency. Both the Carlsbad Police Department and the SDSO will report this transfer of $1,000 on their annual Equitable Sharing Agreement and Certification Form. There is approximately a $173,113 cash balance available in the police federal asset forfeiture fund. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require further environmental review.
