ITEM EXPLANATION: The city's Capital Improvement Program includes a project to construct curb, gutter, and sidewalk improvements on Valley Street between Magnolia Avenue and Chestnut Avenue, including improvements along 500 feet of Magnolia Avenue, just east of Valley Street. Per city policy, the undergrounding of the overhead utilities within the project limits is included as part of the project scope of work. The undergrounding of utilities will be constructed concurrently with the project frontage improvements. San Diego Gas and Electric (SDG&E), Time Warner Cable, and AT&T are the three utility companies currently located on the utility poles. Staff has met in the field with representatives of the utility companies and established the boundaries of the district with consideration of utility facilities, services to existing building, and property boundaries. The undergrounding district boundary map is shown in attached Exhibit 2. FISCAL IMPAa: The preliminary cost estimate for the utility undergrounding of District No. 20 is $500,000. The undergrounding of the electric facilities will be funded by the city's allocation of 20 A funds which are collected and kept on account by SDG&E. As of March 13, 2015, the balance of 20A funds on account with SDG&E was $696,144. The other utility companies (Time Warner Cable and AT&T) will underground their utilities concurrently at their own expense. Further, construction of street improvements and the undergrounding of utilities along Valley Street is exempt pursuant to CEQA Guidelines Section 15301(b) (minor alteration of existing public structures) and 15302(d) (undergrounding of overhead utility lines). PUBLIC NOTIFICATION: The office of the City Clerk will mail notice to affected property owners and occupants at least 15 days prior to the public hearing date on Nov. 3, 2015. EXHIBITS: 1. EXHIBIT 1 1 RESOLUTION NO. ^"^5-245 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, 3 CALIFORNIA, EXPRESSING ITS INTENT TO INITIATE PROCEEDINGS PURSUANT TO CHAPTER 11.08 OF THE CARLSBAD MUNICIPAL 4 CODE AND CALLING A PUBLIC HEARING ON NOV. 3, 2015 TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY, OR WELFARE 5 REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON VALLEY STREET BETWEEN CHESTNUT AVENUE AND MAGNOLIA AVENUE, PROJECT NO. 6019. 7 8 WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides for the formation in 9 the City of Carlsbad of Underground Utility Districts to accomplish the orderly removal of 11 existing overhead facilities and the construction of new underground facilities; and 12 WHEREAS, the city has consulted with the affected utilities and has conducted 13 preliminary studies and made investigations concerning the feasibility of such a district in an area on Valley Street between Chestnut Avenue and Magnolia Avenue; and WHEREAS, said studies and investigations indicate that further proceedings pursuant to Chapter 11.08 are warranted to determine whether or not the district should be established. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. The Council hereby expresses its intent to Initiate proceedings for the formation of an Underground Utility District for the above-described area to be known as Underground Utiilty District No. 20, Project No. 6019. 15 16 17 18 19 20 21 22 23 2. That a public hearing will be held by the City Council of the City of Carlsbad on 24 Nov. 3, 2015 at the hour of 6:00 p.m. In the City Council Chambers, at 1200 Carlsbad Village 25 Drive, Carlsbad, California. The intent ofthe public hearing is to ascertain whether the public 26 health, safety, or welfare require the removal of poles, overhead wires, and associated 27 overhead structures, and the underground installation of wires and facilities for supplying 3 28 3 1 electric, communication, or similar associated service In the area herein above described and 2 to determine whether or not the city should continue proceedings to create and implement an Underground Utility District to accomplish said removal and installation. ^ 3. At said hearing, all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 7.
