ADOPTION OF A RESOLUTION AUTHORIZING
THE EXPENDITURE OF $169,754 TO FORMS+
SURFACES FORTHE FABRICATION AND DELIVERY
OF TRASH/RECYCLING RECEPTACLES AND
DECORATIVE BENCHES WITHIN THE OUTLYING

RECOMMENDED ACTION:
Adopt Resolution No. 2015-254 authorizing the expenditure of $169,754 to Forms+Surfaces for the
fabrication and delivery of 68 trash/recycling receptacles and 14 decorative benches within the outlying
Village and adjacent coastline (Exhibit 1).
ITEM EXPLANATION:
As part of the Fiscal Year 2013-14 Capital Improvement Program (CIP) Budget, the City Council
appropriated $290,000 in funds for the Village Streetscape - Downtown Area Project (CIP No. 4019). The
project's initial phase included the procurement of 75 trash/recycling receptacles and 30 decorative
benches, from Forms+Surfaces, within the core of the Village. The subsequent installation of these
amenities provided for a cohesive feel, a sense of continuity, and an enhancement of branding within the
core ofthe Village. The amenities have been well received by downtown area merchants, residents, and
visitors alike.
As part ofthe Fiscal Year 2015-16 CIP Budget, the City Council appropriated an additional $345,000 in
funds forthe extension ofthe Village Streetscape - Downtown Area Project (CIP No. 4019). The project's
next phase proposes to include the procurement of an additional 68 trash/recycling receptacles and 14
decorative benches, from Forms+Surfaces, within the outlying Village, and the adjacent coastline. The
subsequent installation ofthese amenities is intended to provide forthe continuation ofa cohesive feel,
a sense of continuity, and an enhancement of branding within the outlying Village and adjacent coastline.
Request for Proposals
On May 1, 2014, a request for proposals for trash/recycling receptacles and decorative benches was
advertised. Four bids were received, opened, witnessed and recorded on June 3, 2014. The bids were
evaluated by a committee using the following best value criteria:
1) Cost; 2) ability to meet specifications and quality of product sample; 3) references/previous
performance; 4) delivery wait time or implementation schedule; 5) warranty/ability to provide service,
repairs, etc.; and 6) unspecified value added offerings by supplier.

The two proposals submitted by Avalon Amenities, Inc. were considered non-responsive, as their
proposed products were not equal material and quality to that specified in the request for proposals. The
two remaining bids were evaluated using the stated criteria. Forms+Surfaces was determined to be the
best value provider ofthe requisite amenities.
On July 8, 2014, the City Council adopted Resolution No. 2014-168, accepting the bid and authorizing the
expenditure of $229,909 to Forms+Surfaces for the fabrication and delivery of 75 trash/recycling
receptacles and 30 decorative benches within the core Village (Exhibit 2).
The administrative services department/purchasing division has concluded that the results of the subject
request for proposals remain valid, and Forms+Surfaces has retained the unit pricing established in its
original bid. Staff is therefore recommending the City Council adopt a resolution authorizing the
expenditure of $169,754 to Forms+Surfaces for the fabrication and delivery of 68 trash/recycling
receptacles and 14 decorative benches within the outlying Village and adjacent coastline.
FISCAL IMPACT:
There are sufficient funds available in the Village Streetscape - Downtown Area Project (CIP No. 4019) to
accommodate the described $169,754 expenditure. The $345,000 appropriated by the City Council as
part ofthe Fiscal Year 2015-16 CIP Budget, forthe extension ofthis project, is fully intact.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment,
or a reasonably foreseeable indirect physical change in the environment, and therefore does not require
environmental review.

7 WHEREAS, the City Council appropriated $1.4 million dollars in funds for the Fiscal
8 Year 2013-14 Downtown Area Capital Improvement Projects (Resolution No. 2013-146) for
Village and Barrio revitalization projects; and
WHEREAS, the appropriated funds include $290,000 for the Village streetscape
improvements which include costs to purchase trash/recycle receptacles and benches; and
WHEREAS, the Village streetscape improvements will provide a cohesive feel, a

sense of continuity and enhance the branding of the Village; and
15 WHEREAS, funds are available in the Fiscal Year 2013-14 Capital Improvement
16 Program budget for the trash/recycle receptacles and benches for the Village; and
WHEREAS, requests for proposals were posted on May 1, 2014; and
WHEREAS, four sealed bids were received, opened, witnessed and recorded in
public by the city on June 3, 2014 for the trash/recycle receptacles and benches; and
WHEREAS, a committee reviewed the bids following best value selection criteria;
and

23 WHEREAS, it was determined that Forms+Surfaces is the best value
24 NOW, THEREFORE, BE IT RESOLVED bythe City Council ofthe City of Carlsbad,

6 responsive, responsible bid is hereby determined to be that of Forms+Surfaces, in the amount of
$229,908.90.
4. That the bid received from Forms+Surfaces is accepted, and that the
contract is hereby awarded to Forms+Surfaces and that the Mayor is authorized to execute said
contract on behalf ofthe city.

23 The time within which judicial review ofthis decision must be sought is governed
by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of

15 this decision becomes final; however, if within ten days after the decision becomes final a request
