CONTRACT FOR CONSTRUCTION OF THE 2015
CONCRETE REPLACEMENT

RECOMMENDED ACTION:
Adopt Resolution No. 2015-260 accepting bids and awarding the contract to Victor Concrete for
construction ofthe 2015 Concrete Replacement Project No. 6013-15.
ITEM EXPLANATION:
As part of the city's annual Concrete Replacement Program, staff has evaluated the concrete
improvements in the public right-of-way and produced a list of 259 locations where concrete
replacement is necessary. At these locations curb, gutter, sidewalk, curb ramps, and driveway
approaches need to be replaced because of deterioration, cracking, and uplifting.
On Aug. 27, 2015, 12 sealed bids were received for the construction of this project as shown on the
following table:

The lowest responsive bidder, Victor Concrete, submitted a bid in the amount of $308,954. Staff has
completed its review of the contract documents and has determined that they are in order. Staff
recommends that Victor Concrete be awarded the contract.

FISCAL IMPACT:
The estimated construction cost for the 2015 Concrete Replacement Project is shown in the table below:

Construction Management, Inspection, and Materials Testing $75,000

Total Available Concrete Replacement Program, CIP No. 6013 $754,083
Additional Appropriation Requested $0
There are sufficient funds available to complete the 2015 Concrete Replacement Project, as shown
above. The Concrete Replacement Program is funded with Gas Tax funds. Remaining Concrete
Replacement Program funds will be used on future concrete replacement projects.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15301(c) - minor alteration of existing facilities including streets, sidewalks, gutters, and similar
facilities involving negligible or no expansion.
PUBLIC NOTIFICATION:
None.

WHEREAS, the City Council of Carlsbad, California has determined that it is necessary,
desirable, and in the public's best interest to construct the 2015 Concrete Replacement Project
No. 6013-15; and
,|Q WHEREAS, on June 9, 2015, the City Council of the City of Carlsbad approved contract
11 documents for the construction of the 2015 Concrete Replacement Project No. 6013-15; and
12 WHEREAS, 12 sealed bids were received on Aug. 27, 2015 bythe CityofCarlsbad forthe

construction ofthe 2015 Concrete Replacement Project No. 6013-15; and

WHEREAS, the lowest responsive and responsible bid to construct said project was
15
submitted by Victor Concrete in the amount of $308,954; and

yj WHEREAS, there are sufficient funds available in the Concrete Replacement Program to
18 complete the project; and
WHEREAS, subsection 3.28.040(C)(5) of the Carlsbad Municipal Code authorizes the

City Manager to approve change orders in the amount equal to the contingency set at the time of
21
project award.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

25 1. That the above recitations are true and correct

2. That the low bid of $308,954 submitted by Victor Concrete for the construction
of the 2015 Concrete Replacement Project No. 6013-15 is accepted and the Mayor is hereby
authorized to execute a contract for this project.
3. That the City Manager is hereby authorized to approve construction change
orders up to $75,000.
4. That the award of this contract is contingent upon the bidder submitting the
lowest responsible bid executing the required contract and submitting the required bonds and
insurance policies, as described in the contract, within 20 days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
