RECOMMENDED ACTION:
Adopt Resolution No. 2015-269 approving the establishment of the City of Carlsbad Sewer
Lateral Grant Program (program) and approving modifications to the City of Carlsbad's Sanitary
Sewer Management Plan (SSMP).
ITEM EXPLANATION:
The majority of sewer spills the City of Carlsbad Wastewater Division respond to are due to faulty
sewer laterals. The sewer lateral is the piping system that conveys wastewater from the building on
private property to the city sewer main. Sewer spills adversely affect the environment and are a
threat to public health.
According to Carlsbad Municipal Code section 13.04.045, maintenance of all sewer lateral lines shall
be the responsibility ofthe property owner or parcel occupant/user. However as a result ofthe
settlement of a lawsuit earlier this year, the City of Carlsbad agreed to create a Sewer Lateral Grant
Program. The Carlsbad Wastewater Division will financially assist sewer customers within the City
of Carlsbad sewer service area with the restoration of their sewer lateral either by repair,
rehabilitation or replacement.
The Lateral Grant Program Guidelines (Exhibit 2) provide property owners with information
regarding the process to qualify for financial assistance. The applicant is required to agree to all
terms and conditions ofthe program and sign a "hold harmless" agreement to release the City of
Carlsbad from liability once the restoration work has been compieted. After a property owner
applies and has met all program criteria, the Carlsbad Wastewater Division will reimburse the
property owner one half of the cost, up to a maximum of $3,000 per location. The total amount of
funding available for this program is $50,000 annually.

City of Carlsbad SSMP Overflow and Emergency Response Section 3.2.6 will also be revised to reflect
this new program.
FISCAL IMPACT:
A total of $50,000 will be budgeted for this program for half of Fiscal Year 2016 and then Fiscal Years
2017-21. This funding is budgeted in the Wastewater Operating Budget, and there is an object code
specifically created to track program expenditures. Following expenditure of the annual funds
dedicated to this purpose, the program shall be suspended to evaluate its validity and until such
time as additional funds are appropriated to the program.
ENVIRONMENTAL IMPACT:
In restoring problematic sewer laterals to good working order, this program will help lower the
overall amount of sewer lateral spills/overflows within the City of Carlsbad sewer service area. The
sewer laterals to be rehabilitated or replaced with funds from this program are subject to
categorical exemptions from the California Environmental Quality Act (CEQA) under CEQA
Guidelines sections 15301 (Existing Facilities) and 15302 (Replacement and Reconstruction).

Sewer Lateral Grant Program
Guidelines
The City of Carlsbad Wastewater Division will assist property owners with replacement or
rehabilitation of their private sewer lateral from the building to the sewer main in an effort to
lower the number of sewer spills associated with faulty sewer pipelines.
The sewer lateral is a pipeline that runs from the building to the sewer main generally located in
the middle ofthe street.
Spills from private sewer laterals account for a majority ofthe overflows reported to the State
Water Board. The Carlsbad Wastewater Division is responsible to report every sewer spill
including spills from private sewer laterals. The goal ofthis lateral grant program is to lower the
amount of spills by assisting Carlsbad sewer customers with refurbishing the sewer lateral that
are in most need of repair.
This assistance is in the form of a grant program that will reimburse the property owner half (up
to $3,000) ofthe expenses spent on these repairs. Repairs can be accomplished by either open
trench cut method where the pipe is replaced or through trenchless techniques where the sewer
pipe is lined and all of the work is done inside the pipe and there are a minimal number of
trenches cut.
The property owner is required to:
• Fill out a questionnaire; and
• Solicit three bids for the repair work; and
• Submit the questionnaire and the bids to the Carlsbad Wastewater Division for
approval.
The bid winning licensed plumbing contractor will then apply for all appropriate City of Carlsbad
Permits. All of the necessary permits and plans must be submitted before they are granted
approval to start the work.
A video of the sewer lateral after construction is required. The Carlsbad Wastewater Division
representative and the property owner will review the video. The property owner will then
release the City of Carlsbad from liability.
The Sewer Lateral Grant Program will operate on a first come, first served basis. In the event
there are several applications submitted at one time, there will be a triage survey done to decide
a prioritization. The highest priority will be given to locations that have had overflows/spills.
This Program is offered to sewer customers within the Carlsbad Wastewater service area which
includes a majority ofthe City of Carlsbad except for the south and southeast portions ofthe city.
