CED AMENDMENT NO. 1 TO THE AGREEMENT FOR LANDSCAPE PLAN CHECK CONSULTANT SERVICES CITY MANAGER Kt\ RECOMMENDED ACTION; ADOPT Resolution No. 2015-271 approving Amendment No. 1 to the agreement with Michael Elliott Landscape Architect (MELA), for landscape and irrigation and miscellaneous Planning inspection services for current development. ITEM EXPLANATION: The increase in the volume of current development projects in CaHsbad has resulted in a corresponding increase in the need for landscape and irrigation plan review and inspection services. The original agreement with MELA allowed for $150,000 per year to be spent on consultant services. This amount will be increased to $250,000 per agreement year. MELA has provided the City of CaHsbad excellent services by providing thorough and timely turnaround times for conceptual plans and landscape and irrigation plan review, in addition to expeditious final inspections for building permits. FISCAL IMPACT: The Planning Division has sufficient funds in its current Fiscal Year Budget to fund the proposed amendment. Funds have been budgeted for FY 2015-16 for the agreement amendment. All consultant costs for plan checking services are recovered through plan review fees. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. MATT HALL, Mayor ATTEST: IBARA ENGLESON, gfty Clerk (SEAL) AMENDMENT NO.1 TO THE AGREEMENT FOR LANDSCAPE PLAN REVIEW & INSPECTION SERVICES MELA (MICHAEL ELLIOTT LANDSCAPE ARCHITECT) This Amendment No. 1 is entered into and effective as of the day of \\\(\\f/Vy\^^CJ^ 20 ^5"amending the agreement dated March 11, 2015 by and between the City of Carlsbad, a municipal corporation, ("City"), and MELA (Michael Elliott Landscape Architect), sole proprietor, ("Contractor") (collectively, the "Parties") for landscape plan review and inspection services. RECITALS A. On March 11, 2015 the Parties executed an Agreement for landscape plan review and inspection services; and B. The Parties desire to amend the Agreement's scope of work to increase the yearly amount by $100,000 for landscape plan review and inspection services, not to exceed $250,000 per agreement vear. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. The Agreement is amended to increase the not-to-exceed amount in paragraph 5 to $250,000 per agreement year 2. All other provisions of the Agreement, as may have been amended from time to time, shall remain in full force and effect. 3. All requisite insurance policies to be maintained by the Contractor pursuant to the Agreement, as may have been amended from time to time, shall include coverage for this Amendment. 4.
