RECOMMENDED AaiON: Adopt Resolution No. 2015-275 continuing the Public Hearing for Underground Utility District No. 20 Valley Street from Nov. 3, 2015 until Nov. 17, 2015. ITEM EXPLANATION: On Oct. 6, 2015, the City Council adopted Resolution No. 2015-245 setting a Public Hearing for Underground Utility District No. 20 on Nov. 3, 2015. While timely notice was published in the Union Tribune, the mailed notice to affected property owners and utilities was inadvertently omitted. In order to provide adequate notice to all affected property owners and utilities within the proposed district boundary, as required by Carlsbad Municipal Code section 11.08.020, the Public Hearing will be continued until Nov. 17, 2015. Notice of the re-scheduled Public Hearing was published in the Union Tribune and mailed directly to the affected property owners and utilities as shown on the last equalized assessment roll and utilities at least 15 days prior to the Public Hearing on Nov. 17, 2015. The proposed district includes Valley Street between Chestnut Avenue and Magnolia Avenue and a portion of Magnolia Avenue approximately 500 feet east of Valley Street, as shown on Exhibit 2. After affected property owners and utilities have had an opportunity to speak at the Public Hearing, Council may determine that the public health, safety and welfare require the removal of overhead lines and the installation of underground utilities. FISCAL IMPACT: The preliminary cost estimate for the utility undergrounding of District No. 20 is $500,000. The undergrounding of the electric facilities will be funded by the city's allocation of 20A funds which are collected and kept on account by SDG&E. As of March 13, 2015, the balance of 20A funds on account with SDG&E was $696,144. The other utility companies (Time Warner Cable and AT&T) will underground their utilities concurrently at their own expense. Further, construction of street improvements and the undergrounding of utilities along Valley Street is exempt pursuant to CEQA Guidelines Section 15301(b) (minor alteration of existing public structures) and 15302(d) (undergrounding of overhead utility lines). EXHIBIT 1 1 RESOLUTION NO. 2015-275 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CONTINUING PUBLIC HEARING FOR UNDERGROUND UTILITY DISTRICT NO. 20, AND MAKING ORDERS IN REGARD 4 THERETO 5 ^ WHEREAS, on Oct. 6, 2015, the City Council of the City of Carlsbad adopted Resolution No. 2015-245 expressing its intent to initiate proceedings pursuant to Chapter 11.08 of the Carlsbad Municipal Code and calling a Public Hearing on Nov. 3, 2015 to determine whether or not the public health, safety or welfare requires the formation of an underground utility district in a portion of Carlsbad; and WHEREAS, in order to provide adequate notice to all affected property owners and occupants within the proposed district boundary, the Public Hearing will be continued until Nov. 17, 2015; and WHEREAS, the City Clerk has advertised notice ofthe Public Hearing and mailed notice to all affected property and utilities within Underground Utility District No. 20 at least 15 days 17 prior to the Public Hearing on Nov. 17, 2015. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 19 California, as follows: 20 1. That the above recitations are true and correct 21 2.
