City Manager RECOMMENDED ACTION: Adopt Resolution No. 2015-303 , appropriating funds in an amount not to exceed $650,000 from the General Fund — City Council Contingency account and authorizing the Administrative Services Director to transfer the funds as appropriate to cover all costs associated with the special election to be held on Tuesday, February 23, 2016. ITEM EXPLANATION: On November 17, 2015, the City Council adopted Resolution No. 2015-293, ordering a special election to be held on Tuesday, February 23, 2016, for the Agua Hedionda South Shore Specific Plan to the qualified voters of Carlsbad. The County of San Diego Registrar of Voters has estimated the cost of the special election at $450,000 to $550,000. In addition, the Registrar's office has invoiced the City of Carlsbad $26,953.36 for the costs associated with verifying the referendum petition signatures. Finally, with their action on November 17, 2015, the City Council also directed city staff to develop and provide informational material giving a fair presentation of the facts to the public within the bounds of the law without advocating for or against the passage of the Agua Hedionda South Shore Specific Plan measure. Government Code section 54964 authorizes a local agency to spend funds to provide information to the public about the possible effect of a ballot measure on the activities, operations or policies of the local agency when the informational activities are lawful and the information provided constitutes an accurate, fair and impartial presentation of relevant facts to aid the voters in reaching an informed judgment about the ballot measure. The information produced by the city will be reviewed for compliance with Government Code section 54964 and applicable case law and will be consistent with past city practice in previous elections. Costs associated with the efforts necessary to implement the City Council's direction will include graphic and text material development, printing and mailing charges, and communications and legal review services. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. WHEREAS, under the requirements of the laws of the State of California, a Special Municipal Election shall be held on February 23, 2016, for the purpose of submitting a proposed measure regarding the Agua Hedionda South Shore Specific Plan to the qualified voters of Carlsbad. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That pursuant to the requirements of the laws of the State of California relating to Special Elections, there is called and ordered to be held in the City of Carlsbad, California, on Tuesday, February 23, 2016, a Special Election for the purpose of submitting a proposed measure regarding the Aqua Hedionda South Shore Specific Plan. 3. That the City Council authorizes the appropriation of funds in an amount not to exceed $650,000 from the General Fund — City Council Contingency account and authorizes the Administrative Services Director to transfer the funds as appropriate to cover all costs associated with the special election to be held on Tuesday, February 23, 2016.
