DIRECTOR DATE 12/15/2015 DEPT. PW-PEM CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2015-308 rejecting the bid for the Fire Station No. 2 Renovation Project No. 47131. ITEM EXPLANATION: On July 28, 2015, Council adopted resolution 2015-202 approving plans and specifications and authorizing the City Clerk to advertise for bids for the Fire Station No. 2 Renovation Project. On Sept. 29, 2015 one bid was received, opened and recorded. The bid received was from SWCS, Inc. dba Southwest Construction Services, with a bid amount of $626,930. The bid received was substantially higher than the engineers estimate for the work, which was $345,000. A project of this size is subject to reduced competition in the current bidding market, as the region is experiencing a period of escalation based on available private construction. Staff engaged the Fire Department about the bid and level of investment for the aging facility. Staff subsequently recommends the rejection of the bid pursuant to Carlsbad Municipal Code section 3.28.080(A)(7)(c), and to not advertise for bids again, since other options are being considered for Fire Station No. 2. FISCAL IMPACT: Construction Contract $325,000 Construction Contingency $36,000 Current Appropriation $361,000 Bid Received $626,930 ENVIRONMENTAL IMPACT: Rejecting a bid for a project is considered a ministerial process and is exempt from California Environmental Quality Act (CEQA) review pursuant to CEQA Guidelines Section 15268 — Ministerial Projects. Resolution No. 2015-308 rejecting the bid for the renovation of Fire Station No. 2 Project No. 47131 2 EXHIBIT 1 RESOLUTION NO. 2015-308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REJECTING THE BID FOR THE RENOVATION OF FIRE STATION NO. 2 PROJECT NO. 47131 WHEREAS, on July 28, 2015, the City Council adopted Resolution No. 2015-202 approving contract documents, special provisions specifications, and authorized the City Clerk to advertise for bids to renovate Fire Station No. 2, herein after referred to as "Project" and WHEREAS, only one bid was received from SWCS, Inc., doing business as Southwest Construction Services, in the amount of $626,930; and WHEREAS, said bid was received, opened, witnessed, and recorded on Sept. 29, 2015; and WHEREAS, said bid is substantially higher than the engineer's estimate for the work, which was $345,000; and WHEREAS, in accordance with Carlsbad Municipal Code section 3.28.080(A)(7)(c), the City Council has the authority in its sole discretion to reject all bids; and WHEREAS, in lieu of pursuing the Project, staff will perform limited maintenance on the facility to maintain Fire Department operations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That the City Council does hereby reject all bids received by the City on Sept. 29, 2015. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 15th day of December 2015, by the following vote to wit: AYES: Council Members Hall, Blackburn, Schumacher, Wood, Packard.
