RECOMMENDED ACTION:
Adopt a Resolution authorizing the Public Works Director or designee to execute all necessary forms for
payment programs through the California Department of Resources, Recycling and Recovery.
ITEM EXPLANATION:
California's Department of Resources, Recycling and Recovery (CaiRecycle) brings together the state's
recycling and waste management programs. Pursuant to Public Resources Code (PRC) Sections
14581{a)(3)(A) ofthe California Beverage Container Recycling and Litter Reduction Act, and Sections 48600,
48691, and 48653, relative to used oil collection and recycling programs, CaiRecycle administers programs
to provide payments to eligible jurisdictions for assistance in implementing programs that facilitate
beverage container recycling and used oil collection and recycling activities, thereby supporting state
recycling and waste diversion goals. The City of Carlsbad has applied for and received funding from these
payment programs in the past and would like to continue utilizing these available funds to support
important programs within the city.
With City Council's approval, the Public Works Department will apply for, accept and appropriate payment
program funding through Cal Recycle for a period of five years from the date of approval. Funding will be
used on qualified expenditures in an effort to increase awareness through education and outreach to the
community, increase availabilty of recycling opportunities, and pay for staff time related to program
management.
FISCAL IMPACT:
CaiRecycle payment programs require that the funds be expended within the 24 month term of the
program. Any unused funds must be returned to Cal Recycle within 45 days of the end of the term. If the
city's applications are approved for payment by CaiRecycle, funds are normally received annually in April
for the Used Oil Payment Program, and in October for the Beverage Container Recycling Payment Program.

ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the
meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or
a reasonably foreseeable indirect physical change in the environment, and therefore does not require
environmental review.

RESOLUTION NO. 2016-062
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AUTHORIZING THE PUBLIC WORKS DIRECTOR OR
DESIGNEE TO EXECUTE ALL NECESSARY FORMS FOR PAYMENT
PROGRAMS THROUGH THE CALIFORNIA DEPARTMENT OF
RESOURCES, RECYCLING AND RECOVERY.
EXHIBIT 1
WHEREAS, pursuant to Public Resources Code Sections 14581, 48600, 48691 and 48653,
the California Department of Resources, Recycling and Recovery (CaiRecycle) has established
various payment programs to make payments to qualifying jurisdictions for implementation of
their payment programs; and
WHEREAS, in furtherance of this authority Cal Recycle is required to establish procedures
governing the administration of the payment programs; and
WHEREAS, CalRecycle's procedures for administering payment programs require an
applicant's governing body to declare by resolution certain authorizations related to the
administration of the payment program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City of Carlsbad Public Works Director, or his/her designee, is hereby
authorized as Signature Authority to execute all documents necessary to
implement, secure and appropriate payments.
3. This authorization is effective for five years from the date of its adoption.
