RECOMMENDED ACTION:
Adopt a Resolution accepting bids and awarding a contract to Cyber Professional Solutions Corp in the
amount of $529,200 for construction of the Dove Library Exterior Improvements, Project No. 4030.
ITEM EXPLANATION:
For the past two years, staff has been working on the refurbishment and enhancement of both the
Georgina Cole Library (Cole Library} and Carlsbad City Library (Dove Library}. The purpose of this effort is
to continue providing top quality service and revitalize Library & Cultural Arts infrastructure to maximize
its current and future benefit to the community.
On June 23, 2015, the City Council awarded a construction contract to Prava Construction Services, Inc.
(Prava} to construct interior improvements for the Cole and Dove Library Renovation Projects. Exterior
improvements for the Dove Library were not included as they were still under design. The exterior scope
of work includes construction of a new west patio with a fireplace, seat wall, irrigated planters, and
landscaping; and upgrades to the front courtyard including enhanced lighting, landscaping, irrigation,
wood bench and column covers, pavers and planters.
On Dec. 15, 2015, City Council approved the plans and specifications for the Dove Library Exterior
Improvements Project and authorized issuing an invitation for bids. On March 8, 2016, Council rejected
all bids received pursuant to Carlsbad Municipal Code section 3.28.080(G}(3} and authorized the release
of a second invitation for bids with revised plans and specifications. On April 11, 2016, six sealed bids
were received for construction of the project as shown on the following table. The engineer's estimate
was $714,000.

Staff has determined that the lowest responsive bidder was Cyber Professional Solutions Corp with a bid
of $529,200. Cyber Professional Solutions Corp's bid contained a minor irregularity in failing to provide a
second signature on the bidder's bond and failing to have the signature on the bidder's bond notarized.
Cyber Professional Solutions Corp's bid substantially conformed to the requirements in the
advertisement for bids and the minor irregularity did not give it an advantage over other bidders. Staff
recommends that City Council waive the minor irregularity pursuant to Carlsbad Municipal Code section
3.28.080(G)(3) and award the contract to Cyber Professional Solutions Corp.
FISCAL IMPACT:
The estimated construction costs for the Dove Library exterior improvements are shown in the table
below. There are sufficient funds available in the project budget to complete the Dove Library exterior
improvements. The Dove Library Renovations Project is funded through the Infrastructure Replacement
Fund and the General Capital Construction Fund.

ENVIRONMENTAL IMPACT:
This project is exempt from California Environmental Quality Act (CEQA) review pursuant to CEQA
Guidelines Section 15301(d)-Existing Facilities-restoration or rehabilitation of existing facilities that are
deteriorated or damaged and are required to meet current standards of public health and safety
involving negligible or no expansion of use.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARD OF CONTRACT TO
CYBER PROFESSIONAL SOLUTIONS CORP IN THE AMOUNT OF
$529,200 FOR DOVE LIBRARY EXTERIOR IMPROVEMENTS,
PROJECT NO. 4030.

WHEREAS, city facilities are necessary to meet current and future Library & Cultural Arts
service demands within the City of Carlsbad; and
WHEREAS, On Dec. 15, 2015, City Council approved Resolution 2015-304 to approve the
10 plans and specifications for the Dove Library Exterior Improvements Project and authorized issuing
11 an invitation for bids; and
12 WHEREAS, on March 8, 2016, City Council approved Resolution No. 2016-045 rejecting
13 the initial bids received for the Dove Library Exterior Improvements Project pursuant to Carlsbad
14
Municipal Code section 3.28.080{G)(3) and authorized the release of invitations for a second bid
15
process with revised plans and specifications; and 16
17 WHEREAS, on April 11, 2016, six sealed bids were received for the construction of the
18 Dove Library exterior improvements and the lowest responsive and responsible bid for the project
19 was submitted by Cyber Professional Solutions Corp in the amount of $529,200; and
20
WHEREAS, Cyber Professional Solutions Corp's bid contained a minor irregularity in failing
21
to provide a second signature on the bidder's bond and failing to have the signature on the bidder's
22
23 bond notarized, such that its bid substantially conformed to the requirements in the advertisement
24 for bids and the minor irregularity did not give it an advantage over other bidders; and
25 WHEREAS, funding for the contract is available in the Dove Library Renovations Project
26 Budget, Project No. 4030, to cover all contract and contingency costs.

NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Carlsbad, California,
as follows:
1. That the above recitations are true and correct.
2. That the minor irregularity in the low bid of failing to provide a second signature
and notarization ofthe signature on the bidder's bond is waived pursuant to Carlsbad Municipal
Code section 3.28.080{G)(3}.
3. That the bid amount of $529,200 submitted by Cyber Professional Solutions Corp
9 for the construction of the Dove Library exterior improvements is accepted and the Mayor is hereby

authorized to execute a contract with Cyber Professional Solutions Corp.
4. That the City Manager is hereby authorized to approve construction change
13 orders up to $53,000 for the Dove Library exterior improvements.
14 5. That the award of this contract is contingent upon Cyber Professional Solutions
15 Corp executing the required contract and submitting the required bonds and insurance policies, as

described in the contract within 10 days of adoption of the resolution with the understanding that
the City Manager may grant reasonable extensions of time.
