RECOMMENDED ACTION:
Adopt a Resolution approving the plans and specifications, authorizing execution of a Temporary Right of
Entry Agreement, appropriation of funds in the amount of $185,000, and authorizing the City Clerk to
advertise for bids for the Agua Hedionda Creek Storm Drain Outfall and Streambank Restoration Project,
Project No. 6618.
ITEM EXPLANATION:
The Agua Hedionda Creek Storm Drain Outfall and Streambank Restoration Project is located along Agua
Hedionda Creek south of College Boulevard and east of Sunny Creek Road. The project is substantially
within a drainage easement over private property. This project will restore the streambank and creek
bottom damaged by storm water exiting an existing public storm drain pipeline into the creek. The storm
drain pipeline discharges into a rip rap energy dissipater that no longer functions as designed and has
resulted in stream bank erosion. In addition to eroding the streambank, the damaged rip rap energy
dissipater caused modifications to the creek bottom that were detrimental to the normal stream flow.
City staff were made aware of the issue in November 2013. Staff collaborated with the US Army Corp of
Engineers, the California Department of Fish and Wildlife, the Regional Water Quality Control Board
(collectively the "Resource Agencies"} and a team of consultants, and developed an innovative
bioengineered streambank restoration project. Traditional concrete and rip rap solutions are expected to
be ineffective. The majority of the work needed is restoration of the slope and replacement of the
damaged energy dissipater. Any work within the creek requires permits from the Resource Agencies and
the City of Carlsbad. The bioengineered solution would result in two benefits for the City of Carlsbad: (1}
the Resource Agencies consider the slope protection system to be self-mitigating, requiring no off-site
compensatory mitigation; and (2} the Resource Agencies allow a two-year maintenance period and a
three-year monitoring period, rather than the traditional five-year maintenance and monitoring period
for projects of this nature.

This project, which is designed to accommodate the one hundred year rain event, includes the
installation of a natural log retaining wall and a boulder lined spillway designed to slow flows. Boulder
step pools within Agua Hedionda Creek are designed to adjust the creek slope and restore a natural fall.
Native riparian plantings will be installed within the entire work area. In addition to long term slope
protection, the use of naturally occurring plants will protect water quality.
The bioengineered slope protection, with a cribwall and rock pools, are generally located within the city's
existing drainage easement. Portions of the new system are located outside the drainage easement on
private property. City staff has been working with the property owner throughout this process. It is not
feasible for the contractor and city staff to utilize the access easement off Palmer Way because of a
steep slope. Access for the work will be off Sunny Creek Road through the private property. To further
protect the private property the contract requires the storage of vehicles, equipment and materials not
required for each day's operation in a temporary staging area off College Boulevard. City staff has
negotiated a Temporary Right of Entry Agreement with the property owner.
Several studies and technical reports have been necessary to support the final design. The additional
studies increased both project costs and lengthened the schedule for installation. Additionally several
rain events increased the footprint of the impacted area beyond the project limits originally scoped. To
prevent continued erosion of the slope and loss of property, and in close coordination with the Resource
Agencies, staff contracted for the installation of temporary slope protection in January 2016. The plans
and specifications are on file with the City of Carlsbad Public Works Department.
FISCAL IMPACT:
The following table shows a breakdown of the project costs, including the current status of the funding
source. The Engineer's Estimate of the construction cost for the project is $220,000.

Available funds have been previously appropriated from the Infrastructure Replacement Fund. An
additional appropriation of $185,000 from the Infrastructure Replacement Fund is being requested at
this time.
The contingency for this project exceeds the standard 10 percent. The project is small and staff is
requesting an increase in the contingency to ensure there is adequate funding for the project.
ENVIRONMENTAL IMPACT:
The project is exempt from the California Environmental Quality Act (CEQA) per State CEQA Guidelines
Section 15333(d)(5), stream or river bank stabilization with native vegetation or other bioengineering
techniques, the primary purpose of which is to reduce or eliminate erosion and sedimentation. A Notice
of Exemption was filed with the San Diego County Clerk on April 21, 2016.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to construct the Agua Hedionda Creek Storm
Drain Outfall and Streambank Restoration Project, Project No. 6618; and
WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental to construct the Agua
Hedionda Creek Storm Drain Outfall and Streambank Restoration Project, Project No. 6618,
have been prepared and are on file in the Public Works Department of the City of Carlsbad and
are incorporated herein by reference; and
WHEREAS, an additional appropriation of $185,000 from the Infrastructure
Replacement Fund is requested to cover all project costs; and
WHEREAS, a Temporary Right of Entry Agreement with the property owner is necessary
to allow access to the project site.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California
as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications and contract documents for the Agua Hedionda
Creek Storm Drain Outfall and Streambank Restoration Project, Project No. 6618,

TEMPORARY RIGHT OF ENTRY AGREEMENT
THIS AGREEMENT, is made and entered into as of ~~~ t ) 11.-, 2016
("Agreement Date"), by and between the City of Carlsbad, a chartered municipal corporation
("City"), and the Owner of the real property identified below. City and Owner may also
individually referred to as a "Party" and collectively as "Parties."

RECITALS
1. The City is proposing a public improvement project as set forth in the approved
construction plans identified as the Sunny Creek Stream Bank Restoration Project (Project No.
6618, Special Use Permit No. 15-02, incorporated herein by reference) ("Project").
2. The Project is located within the boundary of the Subject Property.
3. The Project will include installation of drainage facilities, planting of permanent
landscape, and post-construction maintenance and monitoring of the permanent landscape (the
"Work").
4. In order to complete the Project, Owner will need to grant access to the Project
site by City's contractor's employees and City's employees along Sunny Creek Road as
identified in the construction plans for Project.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained therein, City and Owner, agree as follows:
1. ENCUMBERED AREA. The portion of the Subject Property encumbered by this
Agreement shall be that area identified in the approved construction plans for the Sunny Creek
Stream Bank Restoration Project ("Project site"), including that portion of Sunny Creek Road
from College Avenue to the Project site and the staging area adjacent to the Project site
(collectively, the "Encumbered Area"), as shown in Exhibit A.
2. ACCESS. Owner authorizes and shall provide reasonable access to the City, its
employees or its contractor over and to the Encumbered Area in order to perform the Work
during the term of this Agreement. The Work and all related activities or events shall be limited
and conducted as required by the approved construction plans for the Project, all at City's sole
cost and expense. Owner shall incur no cost or expense in connection with the Work or any
related activities or events. Access during construction shall be provided in accordance with the
construction schedule as shown in Exhibit B. During the post-construction maintenance and

monitoring period, the City, its employees, or its contractor shall give Owner notice at least 24
hours before entering the Encumbered Area, except in the case of an emergency.
3. IMPROVEMENTS WITHIN ENCUMBERED AREA. This Agreement provides the
City or its contractor with the right to enter onto the Subject Property for access to perform the
Work. The City agrees to have its contractor repair any damage to the Encumbered Area that is
caused by or results from the Work and shall remove any and all equipment and materials used
by City or its contractor in conducting the Work and shall restore the Property to a condition
similar to the existing condition before construction.
4. INDEMNITY. The City shall jointly and severally protect, defend, indemnify and
hold harmless Owner and, if applicable, its respective officers, directors, employees, contractors
and consultants, and each of them, jointly and severally, from and against only those claims,
demands, causes of action, damages, costs (including reasonable attorneys' fees), expenses,
losses and liabilities, to the extent arising out of or in any manner connected with the Work, the
entry upon the Subject Property by City and/or its contractor.
5. TERM. This Agreement shall begin on the date shown above and continue in
force until the completion of the maintenance and monitoring period, which is anticipated to end
five-years after the Notice of Completion is recorded by the City.

C/jV 6. COMPLETE AGREEMENT. This Agreement sets forth the entire agreement
Between the Parties and supersedes other oral or written provisions. No modification of any
provisions shall be binding on either party unless expressly agreed to in writing by all Parties.
7. RELEASE. Upon the termination of this Agreement and restoration in
accordance with the terms hereof, the Owner releases the City and its contractors from any and
all future maintenance or repair responsibilities in the area within the Encumbered Area that is
outside the City's drainage easement.
8. COUNTERPARTS. This Agreement may be executed in duplicate counterparts,
and when executed by both of the Parties each duplicate shall be deemed a single agreement
IN WITNESS WHEREOF, the Parties hereto have caused this Agreement to be
executed as of the Agreement Date.

PERIOD. WATER WILL BE APPLIED IN A WAY TO ALLOW FOR THE 'WEANING OFF' OF PlANTS.
2. IRRIGATION WILL BE CONDUCTED USING A TEMPORARY MANUALLY-OPERATED OVERHEAD SPRAY SPRINKLER SYSTEM.
3. THE EXISTING CREEK WILL BE USED TO SUPPLY THE WATER FOR THE IRRIGATION SYSTEM. A MOBILE ENGINE-DRIVEN PUMP WILL BE USED TO DRAW WATER FROM THE CREEK TO PROVIOE THE REQUIRED WATER PRESSURE AND FLOW TO ENERGIZE THE IRRIGATION SYSTEM. AT THE CONTRACTOR'S DISCRETION OR IF NEEDED DUE TO LOW FLOWS IN THE ~~~~~IC~~IbE~STRUCKS MAY BE USED TO SUPPLY WATER TO THE IRRIGATION SYSTEM FOR THIS PROJECT. REFER TO THE
