CITY OF CARLSBAD-AGENDA BILL AB# 22,285 DISCUSS AND CONSIDER ALTERNATIVES RELATED TO THE DEPT. RECOMMENDED ACTION: That Council discuss retail pet sales and consider alternatives including introducing either the ordinance introduced October 13, 2013, or a revised ordinance; adopting a resolution directing city staff to pursue state and federal action; or taking no further action on this matter. ITEM EXPLANATION: On April 12, 2016, the Carlsbad City Council directed staff to place the subject item on an agenda for consideration within 30 days. Existing state and federal laws regulate dog and cat breeders, as well as pet stores that sell dogs and cats. These include California's Lockyer-Polanco-Farr Pet Protection Act (California Health & Safety Code section 122125 et seq.); the Polanco-Lockyer Pet Breeder Warranty Act (California Health & Safety Code section 122045 et seq.); the Pet Store Animal Care Act (California Health & Safety Code section 122350 et seq.); and the 1966 Animal Welfare Act (7 U.S.C. section 2131 et seq.). These laws define the minimum standards of care for dogs, cats and certain other species of animals bred for commercial resale, research and exhibition. They require that certain commercial breeders be licensed and routinely inspected by the United State Department of Agriculture (USDA). They require that breeders and retail sellers maintain minimum health and safety standards for their animals, sell only healthy animals, and provide various written disclosures and warranties to pet buyers. Pet stores selling live companion animals and fish are required to have a documented program covering routine care, preventive care, emergency care, disease control and prevention, veterinary treatment and euthanasia. Breeders are required to provide adequately sized and sanitary housing, adequate food, water, exercise, socialization and veterinary care. In San Diego County, Chula Vista, Encinitas, Oceanside, San Diego, San Marcos and Vista have passed restrictions. The City of Carlsbad currently has one retail pet store that sells dogs and cats. The store is regulated under existing state and federal law. On October 8, 2013, the Carlsbad City Council introduced and adopted Urgency Ordinance No. CS-231, and introduced Ordinance No. CS-232 amending Title 7 of the Carlsbad Municipal Code with the addition of Chapter 7.16, prohibiting the sale of dogs and cats in retail stores. Both ordinances prohibited the retail sale of cats and dogs, but provided exceptions for businesses already in existence at the time of adoption, local shelters, rescue organizations and humane societies, and small-scale breeders. Ordinance No. CS-232 failed on the second reading, and the Council directed that Urgency Ordinance No. CS-231 be repealed at its meeting on November 5, 2013. The City Council may consider the following options: 1. Introduce an ordinance regulating the sale of dogs and cats in retail stores. This ordinance could be the same as Ordinance No. CS-232, which was originally considered in 2013, or the Council could make changes to the ordinance prior to introduction. 2. Adopt a resolution directing city staff to pursue state and federal regulatory actions. 3. Take no action. FISCAL IMPACT: None. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code Section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not require environmental review. Breeders are required to provide adequately sized and sanitary housing, adequate food, water, exercise, socialization and veterinary care; and WHEREAS, the required minimum standard of care and the USDA's limited enforcement capabilities have resulted in practices contrary to responsible and humane breeding practices; and 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, in order to reduce demand for dogs and cats sourced from substandard breeding facilities, to encourage pet consumers to adopt animals from shelters, and to foster greater awareness of animal welfare issues, to date, 133 U.S. cities, including 29 in California, have passed retail pet sales bans; and WHEREAS, the health and welfare of dogs and cats is an issue of concern to many residents of the City of Carlsbad,; and WHEREAS, local legislation on the retail sale of dogs and cats would only be effective within the City of Carlsbad and could encourage unscrupulous animal breeders and retailers to continue their practices in another jurisdiction; and WHEREAS, animal welfare could be improved more significantly by enhancing state and federal laws preventing inhumane breeding and care of animals and the sale of animals bred and cared for under inhumane conditions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: Ill Ill 1. That the above recitations are true and correct. 2. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 7 OF THE CARLSBAD MUNICIPAL CODE WITH THE ADDITION OF CHAPTER 7.16 Exhibit 2 WHEREAS, the City Council of Carlsbad, pursuant to its police powers delegated to it by the California Constitution has the authority to enact laws which promote the public health, safety , and general welfare of its citizens; and WHEREAS, the Department of Animal Services for San Diego County presented reports to the Carlsbad City Council on July 16 and September 17, 2013, on Pet Adoption and Animal Advocacy that included a discussion of why California cities are passing ordinances regulating commercial pet sales in an attempt to thwart "puppy mills"; WHEREAS, the Carlsbad City Council discussed and considered alternatives related to the sale of dogs and cats in retail stores on May 3, 2016; and WHEREAS, according to the Humane Society of the United States, hundreds of thousands of dogs and cats in the United States have been housed and bred at substandard breeding facilities known as "puppy mills" or "kitten factories" that mass-produce animals for sale to the public, and many of these animals are sold at retail pet shops. SECTION 1. Now, therefore, the City Council of the City of Carlsbad, California does find as follows: a. Existing state and federal laws regulate dog and cat breeders, as well as pet stores that sell dogs and cats. These include the Lockyer-Polanco-Farr Pet Protection Act (California Health & Safety Code section 122125 et seq.); the Polanco-Lockyer Pet Breeder Warranty Act (California Health & Safety Code section 122045 et seq.); the Pet Store Animal Care Act (California Health & Safety - 1 - 6 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Code section 122350 et seq.); and the Animal Welfare Act ("AWA'') (7 U.S.C. § 2131 et seq.) b. The Lockyer-Polanco-Farr Pet Protection Act requires pet dealers (i.e. retailer sellers of more than fifty (50) dogs or cats in the previous year; not including animal shelters and humane societies) to have a permit, maintain certain health and safety standards for their animals, sell only healthy animals, and provide written spay-neuter, health, animal history and other information and disclosures to pet buyers. If after fifteen (15) days from purchase, a dog or cat becomes ill due to an illness that existed at the time of the sale, or within one ( 1) year after purchase, a dog or cat has a congenital or hereditary condition that adversely affects the health of the dog or cat, an owner is offered a refund, another puppy or kitten, or reimbursement of veterinary bills up to one hundred and fifty percent ( 150%) of the purchase price of the puppy or kitten. c. The Pet Store Animal Care Act requires every pet store that sells live companion animals and fish to formulate a documented program consisting of routine care, preventative care, emergency care, disease control and prevention, veterinary treatment and euthanasia. d. The Polanco-Lockyer Pet Breeder Warranty Act offers protection similar to that of the Lockyer-Polanco-Farr Pet Protection Act, except that it applies only to dog breeders who sold or gave away either three litters or 20 dogs in the previous year. e. The Animal Welfare Act requires, among other things, the licensing of certain breeders of dogs and cats. These breeders are required to maintain minimum health, safety and welfare standards for animals in their care. The AWA is enforced by the United States Department of Agriculture ("USDA"). f. According to The Humane Society of the United States, American consumers purchase dogs and cats from pet stores that the consumers believe to be healthy and genetically sound, but in reality, the animals often face an array of health problems including communicable diseases or genetic disorders that present immediately after sale or that do not surface until several years later, all of which lead to costly veterinary bills and distress to consumers. g. According to The Humane Society of the United States, hundreds of thousands of dogs and cats in the United States have been housed and bred in substandard breeding facilities known as "puppy mills" or "kitten factories" that mass-produce animals for sale to the public; and many of these animals are sold at retail pet stores. Because of the lack of proper animal husbandry practices at these facilities, animals born and raised are more likely to have genetic disorders and lack adequate socialization, while breeding animals utilized are subject to inhumane housing conditions and are indiscriminately disposed of when they reach the end of their profitable breeding cycle. h. According to USDA inspection reports, some additional documented problems found at puppy mills include-(a) sanitation problems leading to infectious disease; (b) large numbers of animals overcrowded in cages; (c) lack of property veterinary care for severe illnesses and injuries; (d) lack of protection from harsh weather conditions; and (e) lack of adequate food and water. -2- 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i. While "puppy mill" puppies and "kitten factory" kittens were being sold in pet stores in San Diego County during the past year, thousands of dogs and cats were euthanized in city and county shelters in San Diego County . j. The homeless pet problem notwithstanding, there are many reputable dog and cat breeders who refuse to sell through pet stores and who work carefully to screen families and ensure good, lifelong matches. k. Responsible dog and cat breeders do not sell their animals to pet stores. The United Kennel Club ("UKC"), the second oldest all-breed registry of purebred dog pedigrees in the United States and the second largest in the world, asks all of its member breeders to agree to a Code of Ethics which includes a pledge not to sell their puppies to pet stores. Similar pledges are included in the Code of Ethics for many breed clubs for individual breeds. I. Within the past year, there has been significant community activity in many cities in California to convince local pet store operators to convert from puppy sales to a humane business model offering adoptable homeless dogs and cats to their customers. m. Across the country, thousands of independent pet stores as well as large chains operate profitably with a business model focused on the sale of pet services and supplies and not on the sale of dogs and cats. Many of these stores collaborate with local animal sheltering and rescue organizations to offer space and support for showcasing adoptable homeless pets on their premises. n. While the City Council recognizes that not all dogs and cats retailed in pet stores are products of inhumane breeding conditions and would not classify every commercial breeder selling dogs or cats to pet stores as a "puppy mill" or "kitten factory", it is the City Council's belief that puppy mills and kitten factories continue to exist in part because of the public demand and the sale of dogs and cats in pet stores. o. The City Council finds that the retail sale of dogs and cats in pet stores that operate or choose in the future to operate in the City of Carlsbad must be consistent with the City's goal to be a community that cares about animal welfare. p. The City Council believes that eliminating the retail sale of dogs and cats in pet stores in the City will promote community awareness of animal welfare and, in turn, will foster a more humane environment in the City. q. The City Council believes that elimination of the retail sale of dogs and cats in pet stores in the City will also encourage pet consumers to adopt dogs and cats from shelters, thereby saving animals' lives and reducing the cost to the public of sheltering animals. SECTION 2: That section 7.16 is added to Carlsbad Municipal Code read as follows: - 3 - 8 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 7.16.010-Retail Sale of Dogs and Cats Prohibited a. Definitions. For purposes of this Chapter, the following definitions shall apply: 1. "Animal shelter" means a municipal or related public animal shelter or duly incorporated nonprofit organization devoted to the rescue, care and adoption of stray, abandoned or surrendered animals, and which does not breed animals. 2. "Cat" means an animal of the Felidae family of the order Carnivora. 3. "Dog" means an animal of the Canidae family of the order Carnivora. 4. "Existing pet store" means any pet store or pet store operator that displayed, sold, delivered, offered for sale, offered for adoption, bartered, auctioned, gave away, or otherwise transferred cats or dogs in the City of Carlsbad on the effective date of this Chapter, and complied with all applicable provisions of the Carlsbad Municipal Code. 5. "Pet store" means a retail establishment open to the public and engaging in the business of offering for sale and/or selling animals at retail. 6. "Pet store operator" means a person who owns or is designated by an owner to operate a pet store, or both. 7. "Retail sale" includes display, offer for sale, offer for adoption, barter, auction, give away, or other transfer of any cat or dog. b. Prohibition. No pet store shall display, sell, deliver, offer for sale, barter, auction, give away, or otherwise transfer or dispose of dogs or cats in the City of Carlsbad. c. Exemptions. This Chapter does not apply to: 1. any pet store selling dogs and cats in the City of Carlsbad as of the time this ordinance is adopted. 2. a person or establishment that sells, delivers, offers for sale, barters, auctions, gives away, or otherwise transfers or disposes of only animals that were bred and reared on the premises of the person or establishment; 3. a publicly operated animal control facility or animal shelter; 4. a private, charitable, nonprofit humane society or animal rescue organization; or 5. a publicly operated animal control agency, nonprofit humane society or nonprofit animal rescue organization that operates out of or in connection with a pet store. d. Adoption of Shelter and Rescue Animals. Nothing in this Chapter shall prevent a pet store or its owner, operator or employees from providing space and appropriate care for animals owned by a publicly operated animal control -4- 9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 agency, nonprofit humane society, or nonprofit animal rescue agency and maintained at the pet store for the purpose of adopting those animals to the public. 7.16.20 -Notice of violations of chapter. This chapter shall be enforced by the San Diego County Department of Animal SeNices. Any person who violates any of the provisions of this chapter may be seNed with written notice of such violation by any law enforcement officer of the county. Notice may be seNed upon such person personally, by mail or by posting such notice for five days in a conspicuous place where the violation occurs. 7.16.030-Violations after notice deemed misdemeanor. (a) Every pet store operator violating any provision of this chapter who has been seNed with written notice of such violation as prescribed by section 7.16.020 and who refuses to comply with such notice is guilty of a misdemeanor. (b) Each animal simultaneously displayed, offered for sale or sold in violation of this section constitutes a separate violation of this section. Furthermore, the display, offer for sale, offer for adoption, barter, auction, giving away, or otherwise transferring of cats or dogs after the date a citation has been issued shall also constitute a separate violation. Puppy and kitten mills are in business to supply pet stores. The pets kept in these facilities often spend their entire lives in dirty, crowded cages for the sole purpose of producing as many animals as possible for the pet trade. Pet stores that obtain animals from these facilities are not an asset to our community. However, they could become part of the solution by phasing out the sale of these pets and transitioning to a business model that offers profitable products and services, as well as animals for adoption from local shelters and rescue groups. Therefore, a retail pet sales ordinance would not prevent pet stores from staying in business, but would reduce the burden on shelters and rescue groups by increasing pet adoptions. It would also benefit local hobby breeders by allowing them to continue providing responsibly bred animals directly to people who cannot find what they are looking for through adoption. I urge you to support this important reform to protect pets, consumers and taxpayers in Carlsbad by enacting a retail pet sales ordinance for our city. Thank you. We loved the small town atmosphere, the friendly people and that it was a dog loving community. We see people out walking their dogs along the beach, in the village and in our neighborhood. We are an educated, enlightened and compassionate community. We must try to stop the inhumane treatment of female dogs kept in cages for the sole purpose of breeding, until they are worn out and put down having served their purpose to commercialized breeders. Not to mention the proliferation of puppies, who often end up sick or end up in shelters only to be put down. Please join Encinitas, Oceanside, San Marcos, San Diego and Vista by taking a stand against cruelty to animals and vote to ban stores from selling animals from puppy mills. The resolution will protect consumers from supporting the cruel puppy mill industry. Most pet store puppies come from puppy mills, where dogs typically live in appalling conditions. Breeding dogs are often kept in tiny, wire-floored cages without access to proper veterinary care as they are forced to breed litter after litter. Consumers, for the most part, are unaware of the cruelty they are perpetuating by purchasing a pet store puppy. All too often, they will find themselves with a sick pet store puppy, and only then might learn about the substandard conditions in which that dog was raised. Meanwhile, there are plenty of adoptable dogs and cats who are in need of homes here in San Diego County. Under this ordinance, pet stores could partner with shelters to offer these animals for adoption. There 144 jurisdictions in the US and Canada that have retail pet store sales bans according to Best Friends Animal Society, including our neighboring cities of San Diego, San Marcos, and Oceanside. The City of Carlsbad needs to join these communities in taking a stand against the puppy mill industry. I am proud to live in a county that has been a leader in enacting humane laws, and I hope I can count on you to eliminate puppy mill dogs and cats from our community's pet stores by supporting this resolution. I call it there is no home for you and with this needle your life is over. After a dog is dead they put it in a Hazardly waist bag and take it out to the trash. Problem solved. Many died, their bodies were disposed in the trash, and then the next group of puppies would come and it would start all over again.Consumers are not aware of where these puppies are coming from.lf they only could see the parents and understand what a horrific life they have they would never purchase a pet store puppy. I am also the owner of a pet store puppy that I rescued when he was young. This dog suffers with so many congenital problems, the vet bills are in the thousands. I am able to take care of him only due to my veterinary background. Also, consumers should not bear the brunt of an animal that is sickly and has congenital issues for life. I believe there are many rescue organizations that would be able to fill the pet store windows with animals that are already here eliminating the need for the ones being manufactured by mills. Last summer, my son and his wife came to my home to tell me that that store was selling two "micro-pigs." They were told that the pigs would get no larger than 15-18 lbs. My son and his wife told me this because they know that I've wanted a pet pig for quite some time now. So I went to the store and was told the same thing that they were: these pigs would not get any larger than 15-18 lbs. So I bought them both for over $1,000. Their names are Fred and Ethel and today Fred is close to 100 lbs. and Ethel is not far behind. I have been unable to get anyone to return my phone calls to talk to me about this situation, and my money is gone. A business like this is NOT reputable. If they can lie like this just to get a sale, then would it really be such a far cry for them to lie about getting puppies from puppy mills? Is Carlsbad so desperate for businesses within its city limits that a completely unethical business such as this is tolerated and even protected by the city government? I can tell you that as long as this pet store is allowed to continue to do business in your city, I am going to be hesitant to do business with ANY business in Carlsbad. This experience has really tainted my opinion of Carlsbad, which until then had always been of high regard. In addition, grandfathering in this store will give it a monopoly on this type of business. This just isn't fair on so many levels. It's not fair to the consumers and it's not fair to the animals. Please do the right thing by not allowing this dishonest business to not just be allowed to do business within the city of Carlsbad, but actually protected and fostered by giving it a special dispensation in the form of a grandfather clause. As for Fred and Ethel, they got very lucky that I was the person who bought them. I live in rural San Diego county on a piece of property big enough to have two full size Pot-Belly pigs. We love them and they have become valued members of our family, but we do have the added expense of feeding full size Pot Belly Pigs, which we were not expecting. But we are making it work. As you know, the conditions for the dogs in commercial breeding facilities are unsatisfactory, including caging dogs for their entire lives without human interaction, no grooming or veterinary care for illnesses or injuries, .and lack of proper food. Even dogs from USDA regulated facilities suffer horribly. The puppies these facilities produce are not bred for quality; in fact they are mass produced, and removed from the mother at a young age so they can be shipped off to pet stores while they are still in the adorable puppy stage. These puppies are traumatized, and often don't have proper care as they are being transported to the pet stores. Unsuspecting customers are routinely misled about the origin of the puppies, finding out later that they have purchased an unhealthy dog that came from a puppy mill. Our country has a problem of pet over-population. It's believed that 2 million dogs are euthanized in shelters annually, while puppy mills are producing at least the same amount of puppies to flood the market. Taxpayers' money is used to house, feed, provide vet care, and euthanize homeless dogs in local shelters. As our communities stop supplying commercially bred puppies for sale, the number of homeless animals in shelters will drop because people will go to the shelters, rescues, or to local, reputable breeders when they want to add a dog to their family. Over 150 communities in the United States have instituted bans or restrictions on the sale of commercially bred puppies, including Philadelphia, PA and Los Angeles, CA. Even dogs from USDA regulated facilities suffer horribly. The puppies these faculties produce are not bred for quality; in fact they are mass produced, and removed from the mother at a young age so they can be shipped off to pet stores while they are still in the adorable puppy stage. These puppies are traumatized, and often don't have proper care as they are being transported to the pet stores. Unsuspecting customers are routinely misled about the origin of the puppies, finding out later that they have purchased an unhealthy dog that came from a puppy mill. Our country has a problem of pet over population. It's believed that 2 million dogs are euthanized in shelters annually, while puppy mills are producing at least the same amount of puppies to flood the market. Taxpayers' money is used to house, feed, provide vet care, and euthanize homeless dogs in local shelters. As our communities stop supplying commercially bred puppies for sale, the number of homeless animals in shelters will drop because people will go to the shelters, rescues, or to local breeders when they want to add a dog to their family. Over 150 communities in the United States have instituted bans or restrictions on the sale of commercially bred puppies, including Philadelphia, PA and Los Angeles, CA. Tomorrow your city council will make a most important decision regarding the treatment and very lives of an untold number of innocent animals. You are voting on whether or not you will ban or continue to sanction the retail pet shop sale of "puppy mill" dogs within the boundaries of your city. If you have not done so as yet, I urge you to do research on the operation of wholesale canine breeding operations. But be forewarned, do not engage in this research unless you have a strong constitution and a heart of steel. I am not referring to reputable breeders who have their buyers come to their locations to personally view the litter, both of its parents and the humane conditions the dogs are born into and are living in. In those situations, these breeders have nothing to hide. I am talking about wholesale breeders who turn tens and perhaps hundreds of female and male dogs into breeding stock that are kept in deplorable conditions with little to no human interaction and rarely any veterinary care. When the "stock" is no longer able to breed, it is often killed or allowed to be "rescued" by the many, many rescue organizations that exist all over the U.S. These organizations ex,ist for the sole purpose of rescuing and rehabilitating these poor, used- up, half-dead creatures. The puppies that are born out of these random matings are the ones that are wholesaled to retail pet shops. Most have had no vet care at all. Many are taken from their birth mother before they are weened, which can create a whole unique set of problems in itself. Due to these facts, many puppies are already ill when they are purchased (at exorbitant prices) by a well-meaning family. It is only after the puppies are taken home that their health deficiencies begin to manifest themselves; sometimes resulting in costly vet bills to the purchaser. Sometimes there are chronic health problems that exist for the dog's entire life. I could continue, but I will leave things at that. I urge you to join the cities of San Diego, Oceanside, San Marcos, Encinitas and Chula Vista, that all have these pet shop retail sales bans in place. It is our hope that as cities initiate these bans, that the "pipeline" for the sales of these dogs shrinks, and the wholesale breeding operations will dry up. Those puppies then go to pet stores, like those in Carlsbad, where unsuspecting consumers purchase them. This ban will not force consumers to buy pets online from less reputable sources. Responsible dog breeders, animal shelters, and breed rescue organizations have healthy dogs of all breeds, sizes, temperaments and ages that need safe and loving homes. It may take a little more time and research, but consumers can find exactly what they are looking for from these sources without supporting puppy mills. This ban does not punish responsible breeders either; they do not sell to pet stores because they want to meet the future owners of the pets and ensure the best home for their animals. Responsible breeders welcome consumers into their facilities (often in their home) to see the conditions that the puppies and the puppies' parents are living in. That way, consumers can make sure their new puppy is getting adequate socialization and the care that he or she needs during this crucial developmental period. This ordinance will also not negatively affect the Carlsbad economy. Many pet stores, including PetSmart and Petco, have successfully shifted to a humane model that does not rely on sales of puppy mill animals. Sixteen California cities, including Chula Vista, Oceanside, San Diego and Vista have passed ordinances to ban puppy mill dog sales. To ensure consumer protection and animal welfare Carlsbad, like its neighbors, can and should ban pet store sales of animals raised in cruel settings and posing potential risks to the health and safety of its human and canine residents. These are facilities that house hundreds of dogs. They have been cited for licensing violations due to animals with visible health problems, as well as unsanitary and unsafe conditions. Without doing extensive research, the average citizen would have no idea that the puppy they are about to purchase comes from such appalling circumstances. In short this is a business making significant profits off of egregious animal cruelty and unsuspecting consumers who would never knowingly support such an industry. My position is that supporting such a business in this community runs counter to Carlsbad's mission, beliefs and progressive nature. Stores such as Carlsbad Pets are the reason over 145 municipalities in the United States and 6 cities in San Diego County have taken local action to require such stores to convert to a humane business model in order to continue operating in their communities. These ordinances are effective because they eliminate the primary sales outlet for unethical breeders (responsible breeders, in contrast, do not sell to pet stores), and consumers are no longer misled as to the origins of the pet they are purchasing. I would like to highlight here that it is the misrepresentation of the origin of the puppies that should most certainly give you pause as you know, you were elected to protect the citizens of Carlsbad from just such duplicity. Many of your constituents have hailed your service to Carlsbad and are urging you to do the right thing for their community. In 2012, I initiated the introduction of an ordinance in the city of San Diego prohibiting the retail sale of dogs, cats and rabbits from commercial breeding facilities, which passed unanimously in August of 2013. Lastly, these stores employ deceptive loan tactics by charging exorbitant interest rates and make a pet owner exchange a defective dog (once attached of course) instead of covering owner's pet bills. In city after city, I have heard horrific stories from people duped into buying these poor, sick animals. I volunteer at different animal rescue facilities, including the Helen Woodward Animal Center ( a no-kill facility which takes in about 90% of their animals from kill shelters), known for their educational programs and their extremely successful adoption programs) and know that millions of dogs and cats are still euthanized in this country, needlessly, because many people still think that purebred dogs are 'better' pets. Chances are, the puppies sold in the these stores are coming from breeders who overbreed, and contain the females and males in small, inhumane crates, breeding them over and over, with the sole purpose of making money. Their lives are led out in misery, never knowing the love and devotion of human. (I am not against responsible breeders being very careful about their own pets, but how can you know where these pets are coming from when they are in a shop cage?) I would suggest these retail store owners go and rescue the animals one by one, from our local shelters, slated to be killed, and contribute to saving these precious lives.
