DIRECTOR CITY ATTORNEY CITY MANAGER That the City Council hold a public hearing and introduce an Ordinance approving Specific Plan Amendment SP 180(1) to include a new land use category (Area 2c -Light lndu~triai/Commercial Tourist) that would allow a commercial hotel and related business traveler uses on Lot 75 of the Carlsbad Research Center Specific Plan with the approval of a Conditional Use Permit. The property is generally located on the southwest corner of Faraday Avenue and Van Allen Way within the Carlsbad Research Center and in Local Facilities Management Zone 5. The CRC is an existing comprehensively planned industrial park containing a mixture of research and development, industrial, office, commercial, and open space uses. The Specific Plan has and will continue to regulate the uses permitted within CRC and provide development standards such as building height and setback requirements. The CRC Specific Plan supersedes the development standards of the underlying Heavy Commercial-Limited Industrial (C-M) zoning designation of the properties within the CRC project area. On March 16, 2016, the Planning Commission conducted a public hearing and recommended approval (7-0) of a Specific Plan Amendment SP 180(1) that proposes a new hybrid Land Use Category designed as Area 2c -Light Industrial or Commercial Tourist that would allow for either Light Industrial uses as currently permitted or a Commercial hotel and related business traveler uses on Lot 75 of the Carlsbad Research Center Specific Plan. During the hearing, no members of the public spoke. Questions for staff and the applicant were raised pertaining to the viability for additional business hotels within the city and more specifically within the Carlsbad Research Center business park. The applicant, Paul Klukas, responded and spoke of the strong interest and demand for an additional hotel within the city's largest business park. Staff provided hotel statistics from a Tourism Industry Study prepared by Strategic Advisory Group for the city in 2015. The Planning Cornmission ultimately voted (7-0) to approve the project. However, commissioners L'Heu;·eux and Goyarts indicated that they would like additional information (i.e. economic data, hotel occupancy rates, etc.) to support the feasibility of another business hotel DEPARTMENT COI'JTACT: Greg Fisher (760) 602-4629 g::gg.fisher@carlsbadca.gal[ --------. Subsequent approval of a Conditional Use Permit (CUP} for a hotel would be presented to the Planning Commission for a recommendation to the City Council. The Planning Commission resolution recommending approval, along with the Planning Commission staff report, are attached for the Council's review. FISCAL IMPACT: No fiscal impacts to the city or public facilities have been identified as a result of this amendment. ENVIRONMENTAL IMPACT: The City Planner has determined that this project is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061{B)(3) (General Rule) and City of Carlsbad Municipal Code Chapter 19.04.070(A)(1)(c), minor municipal code amendments that do not involve physical modifications or lead to physical improvements beyond those typically exempt. CS-299 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING AN AMENDMENT TO THE CARLSBAD RESEARCH CENTER SPECIFIC PLAN (SP 180(H)) TO INCLUDE A NEW LAND USE CATEGORY THAT WOULD PERMIT A COMMERCIAL HOTEL AND RELATED BUSINESS TRAVELER USES ON LOT 75 WITH THE APPROVAL OF A CONDITIONAL USE PERMIT ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF FARADAY AVENUE AND VAN ALLEN WAY IN LOCAL FACILITIES MANAGEMENT ZONE 5. CASE NAME: CARLSBAD RESEARCH CENTER SPECIFIC PLAN AMENDMENT FOR LOT 75 CASE NO.: SP 180(1) The City Council of the City of Carlsbad, California, does ordain as follows: WHEREAS, the Carlsbad Research Center Specific Plan was originally adopted by City Council Ordinance No. 9561 on November 18, 1980 and has been amended several times and contains the uses, development standards and design guidelines for the development of the Specific Plan area; and WHEREAS. The Carlsbad Research Center Specific Plan is the implementing ordinance for this property; and WHEREAS, the City Council of the City of Carlsbad has reviewed and considered a Specific Plan Amendment (SP 180(1)) for the Carlsbad Research Center Specific Plan; and WHEREAS, the amendment is desirable to take advantage of the projects location within the Carlsbad Research Center which is adjacent to a commercial retail center (Islands at CarlsbadL large international businesses, and close proximity to the McClellan-Palomar Airport; and WHEREAS, after procedures in accordance with requirements of law, the City Council has determined that the public interest indicates that said Specific Plan Amendment (SP 180(1)) be approved. The above recitations are true and correct. 2. That the Carlsbad Research Center Specific Plan (SP 180(1)L on file in the Planning Division, and incorporated herein by reference, is adopted. The Carlsbad Research Center Specific Plan (SP 180(1)) shall constitute the zoning for the property and all development of the property shall conform to the Specific Plan. 3. That the Carlsbad Research Center Specific Plan (SP 180(H)L as amended by Specific Plan Amendment SP 180(1), dated March 16, 2016, is approved. 4. That Specific Plan Amendment (SP 180(1)) amends several pages of the Carlsbad Research Center Specific Plan, as shown on the attached "Exhibit SP 180(1)". Removal of text is presented in a strikethrough type format, while new additional text is shown in underlined type format. 5. That the findings and conditions of Planning Commission Resolution No. 7153 shall also constitute the findings and conditions of the City Council. Approxin1ately 4114-l-4 acres are devoted to this land use. Individual lots within Area 1 are, and will continue to be, developed either as single-tenant, campus-type sites, or as multi-tenant complexes. Specific uses allowed and development standards and regulations on projects within Area I are identified in Chapter 4 of this specific plan. Area 1 also includes open spaces associated with the industrial lots, including natural chapaiTal-covered hillsides, a large manufactured slope along College Boulevard, and the street fi:ontage landscape buffers in front of the industrial lots. These open spaces encumber approximately 20% (116 acres) of the Area 1 industrial area, Although these open spaces are shown on the specific plan, not all open space is identified as open space in the Carlsbad General Plan. The Zone 5 public ballfield city park is also provided in Area 1, located on the northeast comer of Faraday Avenue and Camino Hills Dtive. This park was not identified in the original CRC Specific Plan, but has since been added to the City of Carlsbad's park inventory. The park is owned and operated by the City of Carlsbad, and is referenced in the City's Park and Recreation Element as "Industrial Park". The existing soccer and baseball field imptovements are only the first phase of an ultimate park development which is planned to contain additional soccer and baseball fields, picnic and parking ar~as, and will extend into propertynmtherly of the CRC boundary for a total park area of12.9 acres. 2.1.2 Area 2-Commercial Area 2, the commercial land use category is located on two of the comers of the central, main atterial intersection at College Boulevard and Faraday Avenue and on the two comers of the intersection of Faraday Avenue and El Camino Real. For land use purposes, these two areas represent tlu·eet'rre separate types of conm1ercial planning areas, Areas 2a~.c..a-00 Area 2b and Area2c. Area 2a. ATea 2a is characterized by three separate intersection corners within the CRC. Areas 2a and Area 2b together devote approximately 29 centrally-located commercial acres on arterial roadways which cater to the CRC business park. Specific uses allowed within Areas 2a and 2b are identified in Chapter 4 of this specific plan. Area 2c. Li2:ht Industrial or Conditional Hotel Use. CRC Lot 75. located on the southwest comer of Faraday Avenue and Van Allen Wav. is a presently-undeveloped parcel identified for either Light Industrial uses (per Area 1) or Commercial hotel and related business-traveler uses (per Area 2b). Tlus lot is centrally-located. directly across the street from the Area 2a retail center. AU allowed uses and development standards relating to land use categories Area 1 and Area ?b are applicable to development of Lot 75. In the event that the property owner elects to develop pursuant to Area 2b (hotel and related business-traveler use), approval bv the City of Carlsbad of a Conditional Use Pemut will be reguired. As shown on Figure 5, the mterial street frontages in front of the conm1ercial ptopetties are considered open space, wluch is maintained by the Owner's Association. 2.2 Infrastructure Public facilities and physical utility infi·astructure is provided to the CRC as discussed in the following sections. All public infrastructure improvements within the CRC Specific Plan comply with City standards, as required or accepted by the City Engineer. In addition, as required by the Carlsbad Growth Management Program, the City has enacted an ongoing monitoring program to evaluate the aspects of in1provements, development and demand on public irlfrastructure and facilities. 2.2.1 Circulation Plan The CRC is accessed via a number of existing arterial roadways in Carlsbad. These include Cannon Road and Palomar Airport Road to the west and south, El Ca11uno Real to the east, and College Boulevard to the north. The two prin1ary vehicular circulation roadways within the CRC are the north-south arterial College Boulevard, and the east-west artelial Faraday A venue. These arterials serve the collector and locai streets accessing the lots within the CRC. Vehicular circulation within the CRC is provided in sufficient size, qua11tity and variety to meet the needs of businesses and workers within, and visitors to the park. Please see Figure 6; Circulation Plan. The vehicular, bicyclist and pedestrian circuh1tion concept of the CRC Specific Plan establishes a pattern of circulation alignment and standards for streets; pedestrian sidewalks, bicycle lanes and transit bus stops. These roadways are desigrted of sufficient size to accommodate peak hour traffic demands from the project and other a11ticipated off-site vehicular trips travelling through the park. The roadway hierarchy for the CRC is as follows: • Alterials-College Boulevard a11d Fai'aday Avenue. ElCaimrto Real also borders the eastem edge of the CRC. • Collectors -Rutherford Drive, Priestly Drive, Salk Avenue and Aston A venue. • Local Streets -All remaining public streets within the CRC. Any use similar to the above if the City Planner detemrines that such similar use falls within the intent and purpose of this Specific Plan and is substantially similar to the specified Regular Conditional Uses. 4.2,2,2(13)-Minor Conditional Use Pennit The following uses may be allowed subject only to issuance of a Minor CUP in accordance with the Intent and Purpose identified in Section 2.L2 of this Specific Plan, and subject to the findings referenced in Carlsbad Mui:licipal Code Chapter 2L42; including but not limited to; 1. Atea 1 Conditional Uses 2. Athletic clups 3. Daycare centers 4. Gas stations 5. Hotels and motels &L Wireless communication facilities 1-:fL_ Any use similar to the above if the City Planner determines that such similar use falls within the intent and purpose of this Specific Plan and is substantially similar to the specified Minor Conditional Uses. 4.2.3 Area 2b 4.2.3.1 Pennitted Uses .Mea 2b is designated for commercial -tourist uses. As such, the following uses are allowed on Area 2b subject to issuance of a Major CUP: 1. Hotels and motels; 2. Uses that are specifically accessory to hotel or motel uses, such as conference facilities, restaurants, spa, cafe, etc; 4.2.4 Area 2c 4.2.4.1 . Pennitted Uses Area 2c is designated for either Industrial (Area l permitted or conditional uses) or commercial business hotel (Area 2b pem1itted or cOnditional uses). Hotel use shall require approval of a Major CUP by the City CounciL 4.2.~4 Restrictions on Non-Residential PUDs Non.-residential PUDs (subdivisions allowing for separate ownership of individual buildings on a single commonly~owned lot) shall be allowed within the CRC pursuant to Chapter21.47 of the CMC only if the minimtirri building size in the proposed PUD is 25,000 square feet in floor area. Applications for PUDs must be consideted in the context of the broader goals of the CRC and should not be a dominant land use configuration. Such prohibited outdoor storage shall include materials, supplies, pallets, or equipment, including the parking of all company-owned or operated motor vehicles with the exception of regular passenger vehicles (automobiles). Storage outside of the main structure is allowed only when fully screened consistent with C-M Zoning standards and Section4.3.2.4 of this specific plan. Where legally and physically possible, all exterior on-site utilities, including but not limited to drainage systems, sewers, gas lines, water lines, and electrical, telephone, and communications wires and equipment, shall be installed and maintained underground. On-site underground utilities shall be designed and installed to minimize the disruption of off~site utilities, paving, artd landscape during construction and maintenance, and shall be of such a design so as not to place excessive burdens upon off-site utility systems during use. 4.2.]6.2 Noise Generation Excessive noise generation shall be prohibited in the CRC. All mechanical and electrical equipment shall be located and operated in a manner that does not distl..irb adjacent uses and activities. No loudspeakers, bells, buzzers or other noise attention or attracting devices exceeding 60 decibels at any one time beyond the boundaries of the property line within which the noise is created, is allowed, CRC Lots 97-100, located within the northwestern section ofthe business park abutting the residential area to the north of CRC, shall be limited to office or similar' allowed uses and shall preclude heavy manufactwing and labor-intensive light manufactuting with shifts after 10 p.m. and before 6 a.m. 4.2.]6.3 Hazards on Private Property No pmiion of the property shall be used l.n violation of the standards of this plan or in such a manner as to create a public or private nuisance as indicated below: CARLSBAD RESEARCH CENTER SPECIFIC PLAN AUGL!ST30, 201 ,..,FEBRUARY 3, ?016 PagelV-10 Item 11; page 15 CARLSBAD RESEARCH CENTER SPECIFIC PLAN-CHAPTER 4 Development Regulations 1. No operation or activity shall cause the emission of any smoke, fly ash, dust, fumes, vapors, gases or other forms of air pollution which can cause damage to human health, vegetation or other forms of property, or which can cause excessive soiling on any other parcel. 2. No operation or activity shall cause any source of electrical or electronic disturbance that adversely affects persons or the operation of any equipment on any parcel that is not in conformance with the regulations of the Federal Conununications Commission. 3. Unless intended as part of a master lighting plan, no operation, activity or lighting fixture shall create illumination which exceeds five (5) foot candles on any adjacent propetiy, whether the illumination is direct or indirect light from the source. 4. No operation shall discharge at any point into any public or ptivate street or dtive, public sewer, storm drain, or into the ground, any materials which can contaminate any water supply or otherwise cause the emission of dangerous or offensive elements. . 5. All open areas shall be landscaped, surfaced or tt·eated and maintained pem1anently in a dust-free condition. 6. No operation or activity shall be pemntted which emits odorous gases or odorous matter in such quantities as to be dangerous, injurious, noxious or otherwise objectionable to a level that is detectible with or without the aid of instiUments at or beyond the ptopetiy within which the odor is created. 7. No operation or activity shall be permitted to cause an eatth-bome oscillation that is continuous and occurring more frequently than 100-times per minute beyond the propetiy within which the vibration was originally created. 8. Excessive air pollution shall be prollibited in the CRC. Buildings or lots may not produce excessive vibrations, heat, glare, or electtical disturbances beyond the boundaries of the specific site. Air pollution detectable by the human senses without the aid of insttuments, shall be ptohibited beyond the boundaties of the site. Emissions wl:rich endanger human health can cause damage to aninlals, vegetation, or property, or which can cause spilling at any point beyond the boundaries of the site shall be prohibited. 9. Placards or other appropriate signage shall be maintained in all uses indicating the storage location of hazardous materials. 4.2.~ Special Events Special events, such as promotional activities or special sales affairs, may be allowed on pi'ivate prope1ties in the CRC. A site development plan (SDP) shall be processed and approved pursuant to Chapter 21.06 of the CMC prior to any new development, re-development or reduced development of the property, as applicable, subject to certain exceptions allowed in CMC Chaptei" 21.06. Apmoval of a conditional use perrnit by the Citv Council shall be required for tourist-related uses on Areas 2b and 2c. 2. In the event that a property is redeveloped, such redeveloped property shall meet all applicable development standards of this Specific Plan, 3. Approved sign programs exist for the existing development on Ate as 2a and 2b. Any proposed re-development or expansion of these areas will necessitate the processing and approval of an amendment to the applicable sign program, consistent with the requirements ofthis Specific Plan. 4. The proposed development or re-development must be found to be compatible with the sulTounding industrial and research and development buildings. 4.3.5 Signage Criteria Signage and graphics are an important unifying design element of the urban environment. The purpose of signage within the CRC is to provide adequate identification of individual developments, buildings and business establishments while maintaining the quality of the area's appearance through appropriate design, location and maintenance. Signage for lots within the CRC shall comply with the specific design criteria articulated in Chapter 21 .41 of the Carlsbad Municipal Code. Additional more detailed signage criteria1 intended to implement the goals and objectives of this Specific Plan and the Signage Objectives indicated below, is located within the CRC Design Guidelines document, which is enforced by the CRC Owner's Association. Design criteria in the CRC Design Guidelines may be more restrictive. The objective of the signage guidelines is to ensure that the extelior signs for each facility are compatible with the overall aesthetic integlity of the CRC. Signing gnidelines for Area 1 are different than for Areas 2a~-aB4 2b and 2c. Signs within Area 1 are not intended to adVe1tise uses or tenants. This does not preclude some recognition and accommodation of corporate identities through signing. With regard to Area 2a commercial uses, some degree of promoting uses in Area 2a to increase visibility is a necessity for the success of the uses. Nonetheless the signage standards in the CRC Design Guidelines are stricter than those typically allowed in the other plmmed industrial areas of the city. The primary purpose of signing visible from the street system for service/retail uses in CRC is to identify the "place", not the individual services. On- site signing internal to the project shall be oriented to assisting the patron in finding uses within the development. The overall objectives for signage within the park are: 1. To insure that the exterior signs for each facility contribute to the aesthetic integrity of the CRC. 2. To provide location and direction assistance to those using the various CRC facilities and activities. 3. To promote continuity of sign format and design, and support the comprehensively planned theme of the Center. 4. To prohibit the proliferation of signs which serve to erode the in1age of the park as a comprehensively designed business envirom11ent. 5. To support and promote the land use concept of the park as primarily a premier office and research and development complex with signage appropriate to that end. 4.3.6 Lighting Standards Lighting within the CRC shall be used to contribute to the safe, secure and efficient use of each development site. Exterior building lighting is intended to compliment and accent the architecture and site design. It is the intention of tlus specific plan to require unifonn parking lot lighting fixtures and consistent illununation levels throughout CRC. The lighting design should control illununation levels and prevent casting of glare on adjacent ptoperties and streets. These standards are intended to ptmnote conformance with energy saving design criteria. A lighting plan shall be required to be subnutted and approved by the City of Carlsbad prior to issuance of a buildi11g pemlit for any building vvithin the CRC. Proposed development of tourist-related uses within Area 2c shall require processing and approval of a Conditional Use Pem1it issued bv the City Council. 5.1.2 Owner's Association Approval Process All development proposed within the CRC shall also be reviewed and approved by the CRC ARC. Pursuant to requirements of this specific plan and the CC&Rs, the CRC Board of Directors appoints CRC ARC representatives who review all applications and plans for development. The CRC ARC review process includes an assessment of compliance with the regulations stipulated in this specific plan, the requirements of the CC&Rs, and the adopted CRC Design Guidelines. The primary objective of the CRC ARC is to perpetuate the CRC as a high value, premier business park 5.2 Specific Plan Amendments The procedures to amend this specific plan shall be by ordinance or resolution as specified by State of California Govt Code 65456. Any amendment to the specific plan shall occur in accordance with the process described in this section. These amendments, should they occur, are divided into two categories. 1. Minor Specific Plan Amendment. Upon completion of consultation with the CRC Board of Directors, the City Planner has the authority to approve minor modifications to the specific plan. A specific plan amendment request shall be determined to be minor if the amendn1ent does not substantially change the boundaries of the CRC or involve an addition of a new use or group of uses not shown in this specific plan or the rearrangement of uses within the specific plan. Such minor amendments must fall into the following categmies, and may only be approved when they are determined to be consistent with the Objectives stated in Chapter! of this specific plan; a. The Carlsbad Research (CRC) Specific Plan is a regulatory document governing development within the area defined as the CRC. The CRC is an existing comprehensively planned industrial/business park containing a mixture of research and development, industrial, office, commercial, and open space uses. The Specific Plan regulates the uses and provides the development standards for the CRC area. The CRC Specific Plan also supersedes the development standards of the underlying C-M zoning designation of the properties within the CRC business park. The original Specific Plan was adopted in 1981 and has been revised through the years to reflect changing development standards and use changes. Lot 75 is one of the remaining three vacant properties within the CRC It is located at the corner of Faraday Avenue and Van Allen Way, near the central intersection of College Boulevard and Faraday Avenue. Table A below includes the General Plan designations, zoning and current land uses for the project site (Lot 75) and surrounding properties. Area 2c will allow for either Light Industrial uses as currently permitted. in (Area 1) or a Commercial hotel and related business traveler uses as currently permitted in (Area 2a), see Figure 5. Lot 75 is located on the southwest corner of Faraday Avenue and Van Allen Way, is currently vacant and has already been graded in conjunction with the original CRC mass-grading for development of the site. This lot is centrally located within the CRC and located directly across the street from Area 2a -Commercial Retail which is developed with the Islands Food Court. As requested, all allowed uses and development relating to both Land Use categories Area 1 (planned industrial) and Area 2b (hotel and business traveler uses) will be applicable to new Land Use Area 2c (Lot 75). In the event that the property is developed pursuant to the new Land Use category Area 2b (hotel), all projects will require a Conditional Use Permit subject to the approval of City Council. Based on strong interest in hotel and related business traveler uses within the City and more specifically within proximity to McClellan-Palomar Airport, this new Land Use classification will create flexibility for the future use of this lot. The CRC is the largest business park in the City, but presently contains only one business hotel within its boundaries (Marriott Residence Inn). The applicant has provided documentation to support the viability of a business hotel use on Lot 75 (see Attachments No.5, 6 and 7). As recommended, an approval of a hotel and related business traveler use at this location would require City Council action through approval of a Conditional Use Permit. The proposed changes to the CRC Specific Plan are shown in an underline/strikeout exhibit attached to the City Council draft ordinance. Ill. ANALYSIS The proposed project is subject to the following plans, ordinances and standards as analyzed within the following section of this staff report: A. General Plan Land Use Element-Planned Industrial (PI) Land Use Designation; B. Carlsbad Research Center Specific Plan (SP 180(1)); C. The Specific Plan Amendment is required to change the text and exhibits of the plan to allow for the applicant's request. The future physical development of the site (Lot 75) requires compliance with the development standards of the Carlsbad Research Center Specific Plan. Therefore, the amendment is consistent with the CRC Specific Plan. All infrastructure needed to serve the industrial park is presently in place in accordance with the Zone 5 Local Facilities Management Plan, regardless of the ultimate use of the property. C. For the ,,average" communiiy this may be a valid observation. However Carlsbad is by no means the average communiiy. Carlsbad's location on the coast with a significant and accessible shoreline is just a "first example" of the demand for hotel uses within this diverse communiiy. Of course there are many iypes of hotels for many iypes of patrons. The beach example covers a broad category of vacation tourism which is one of the San Diego Couniy's prime revenue sources. There are numerous levels of tourism included in the Carlsbad example, beginning with the beach, but also including the many other tourist attractions, such as LEGOLAND, the flower fields, The Village and proximiiy to other significant San Diego Couniy and Orange Couniy amenities. Most communities don't even come close to possessing just the "tourism" venues in Carlsbad. In addition to the vacation attractions the Ciiy also has one of the premier collections of business parks in Southern California. There is almost 20 million square feet of office and industrial space which is home to some of the most prominent Fortune 500 companies as well as numerous R&D, manufacturing and administrative businesses. In today's business world congregations of high-end business parks create a huge demand for hotel (both short stay and extended stay) facilities. Effect on Resort Hotels rn Carlsbad. Tourist-oriented or resort hotels in Carlsbad are different than business hotels. Carlsbad possesses a number of significant tourist-oriented destinations, indudlng the beaches, Legoland, The Flower Fields, Carlsbad Vfl!age, three professional-level golf courses, Premium Outlets, and The Forum Carlsbad shopping center. The resort hotels in Table 2 below pro-vide a completely separate hotel experience from business hotels. These hotels are recreation-oriented, with lounges and restaurants included. Less emphasis is provided on the conveniences for business travelers, and more on tourism. Most of the tourist--oriented hotels are located near the beiK-h, or in prominent locations (Park Hyatt Aviara, Resort Omni La Costa Resort and Spa), well away from the industrial center of the City. Commissioner Goyarts asked about the occupancy rates of the hotels. Mr. Neu responded. Chairperson Anderson asked about the timeframe. Mr. Klukas stated he did not know. Mr. Neu stated it typically is a yearly average. Lower occupancy rates tend to be November thru January. Commissioner Segall suggested enhancing the signage allowance at the Islands at Carlsbad located adjacent to the project site.
