RECOMMENDED ACTION:
Adopt a resolution to open a portion Lot 9 of Carlsbad Tract No. 76-18, located on the south side of the westerly
cul-de-sac of Haymar Drive and lying within the Plaza Camino Real project, for public street and public utility
purposes.
ITEM EXPLANATION:
The intention of opening a portion of Lot 9 of Carlsbad Tract No. 76-18 for proposed public street and utility
purposes, also known as public right-of-way (PROW), is to simplify the process for obtaining necessary utility
services for the property located at 2545 El Camino Real, also identified as Lot 11 of Carlsbad Tract 76-18. The
PROW will be located within property owned by the City of Carlsbad, identified as Lot 9 of Carlsbad Tract 76-18,
and will lie between Haymar Drive and Lot 11 (see Exhibit 3).
Typically, individual properties abut a public right-of-way or a public utility easement. When these properties
need additional or upgraded utility services, the utility agency will obtain a simple permit for work within the
public easement. Because Lot 11 does not abut a PROW, utility agencies must obtain separate easements to
cross Lot 9 for their respective services. Administering and negotiating each individual easement requires a
considerable amount of city staff resources, utility agency staff resources and causes substantial delay in
placement of the utilities.
The proposed location of the PROW will overlay a previously dedicated vehicle access easement. Therefore, the
PROW will not create an undue burden on the property as it is consistent with the current use as a roadway for
vehicles to enter the Plaza Camino Real parking area.
FISCAL IMPACT:
This item has no fiscal impact to the City of Carlsbad.

of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonably

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,
OPENING A PORTION LOT 9 OF CARLSBAD TRACT NO. 76-18, LOCATED ON THE
SOUTH SIDE OF THE WESTERLY CUL-DE-SAC OF HAYMAR DRIVE AND LYING
WITHIN THE PLAZA CAMINO REAL PROJECT, FOR PUBLIC STREET AND PUBLIC
UTILITY PURPOSES.
EXHIBIT 1
WHEREAS, It is in the interest of the City of Carlsbad to open that portion of Lot 9 of
Map 8956 recorded August 11, 1978 as File No. 78-342265 for public street and public utility purposes;
and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the City of Carlsbad approves the opening of that portion of Lot 9 of Map
8956, lying generally south of Haymar Drive cul-de-sac and within the Plaza Camino Real site, for public
street and public utility purposes.
3. That the City Clerk is directed to record this resolution, the attached legal
description and plat in the office of the County Recorder of San Diego County.
4. That upon recordation of this Resolution at the County Recorder, that a portion
20 of Lot 9 of Map 8956 is open for public street and public utility purposes.
