Recommended Action
Adopt a Resolution accepting bids and awarding a contract to NEWEST Construction, Inc. for
construction ofthe Foxes Landing Lift Station Replacement, Project No. 5526.
Executive Summary
The Foxes Landing Sewer Lift Station is located adjacent and easterly of Interstate 5 on the
north shore of the Agua Hedionda Lagoon (Lagoon). Portions of the sewer lift station and force
main are in need of replacement or rehabilitation to improve operational reliability. A project
to construct improvements at the Foxes Landing Sewer Lift Station has been bid and staff
recommends award of a construction contract to NEWEST Construction, Inc. in the amount of
$2,870,800.
Discussion
The Foxes Landing Lift Station was constructed in its current configuration in the 1960's. The lift
station serves a sewer basin generally north of the Lagoon and east of Interstate 5, pumping
approximately 1.25 million gallons of raw wastewater per day, with a peak flow capacity of over
2,000 gallons per minute. A new force main was installed in 1999, along with miscellaneous
electrical and mechanical repairs to the station. The original force main was decommissioned
for future rehabilitation at that time. Most recently, the reliability and efficiency of the lift
station has declined and improvements are necessary to comply with the State Regional Water
Quality Control Board's discharge requirements for sewer systems and current industry
standards intended to eliminate sewer overflows and spills. The lift station's proximity to the
Lagoon further reinforces the need for improved reliability.
The project includes the construction of a new wet well with submersible pumps, the
conversion of the old station structure to a wastewater emergency overflow basin and
installation of a new odor control system. The original force main, now decommissioned, will be
rehabilitated and made available for emergency backup and operational versatility. The overall
project will enhance operational efficiency, improve reliability, increase emergency storage

capacity, and provide redundancy of essential components; all reducing the potential of a
station failure and sewer overflow.
On April 16, 2016, through the adoption of Resolution No. 2016-51, the Carlsbad City Council
approved plans and specifications and authorized the City Clerk to advertise to receive bids for
the Foxes Landing Lift Station Replacement Project.
On July 20, 2016, seven sealed bids were received for the construction of this project as shown
in the following table.

The engineer's estimate was $2,950,000. NEWEST Construction, Inc. submitted the lowest bid
in the amount of $2,870,800. Staff has completed the review of contract documents and has
determined that NEWEST Construction, Inc. is the confirmed low bidder and their bid
documents are responsive. Staff recommends that NEWEST Construction, Inc. be awarded the
contract.

1 A contingency of approximately 15 percent for the Construction Contract has been included to address
unforeseen costs related to the complexity of interfacing the new station with the existing system and structures
and working below groundwater levels.
There are sufficient appropriations from the Sewer Replacement Fund for the construction of
the Foxes Landing Lift Station Replacement Project.

Next Steps
Staff will provide the Public Works Contract to NEWEST Construction, Inc. for their execution
and request that NEWEST Construction, Inc. provide the required bonds and proof of insurance.
Once this task is complete, staff will schedule a pre-construction meeting with NEWEST
Construction, Inc. and a Notice-to-Proceed will be issued. The duration of the Construction
Contract is 220 working days, exclusive of rain days and Change Orders that may extend the
Contract duration. Upon the successful completion of the project, staff will request that Council
accept the construction of Foxes Landing Lift Station and direct the City Clerk to record a Notice
of Completion and to release bonds.
Environmental Evaluation {CEQA)
The project is exempt from the California Environmental Quality Act {CEQA) per State CEQA
Guidelines Section 15302{c) -Concerning replacement or reconstruction of existing facilities
involving negligible or no expansion of capacity. A Notice of Exemption was filed in the Office
of the San Diego County Clerk on Sept. 1, 2015 .
Climate Action Plan Consistency
This project/action is a continuation of a project/action that was started prior to adoption of
the Climate Action Plan in September 2015. However, the project is consistent with the intent
of Measure N, Action Item N-1, which states that the Utility shall "Improve water utilities
(including water supply, wastewater, and recycled water) conveyance, treatment, and
distribution, and other system improvements." This project will improve the energy efficiency
of the lift station by providing more efficient pumps and replacement of the odor control
system with a biological treatment process.

RESOLUTION NO. 2016-173
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO NEWEST
CONSTRUCTION, INC., FOR THE FOXES LANDING LIFT STATION
REPLACEMENT, PROJECT NO. 5526.
WHEREAS, the City Council of Carlsbad, California has determined it necessary, desirable, and
in the public interest to construct the Foxes Landing Lift Station Replacement, Project No. 5526; and
WHEREAS, on April 16, 2016, through the adoption of Resolution No. 2016-051, the Carlsbad
City Council approved plans and specifications, and authorized the City Clerk to advertise to receive
bids for the Foxes Landing Lift Station Replacement, Project No. 5526; and
WHEREAS, seven sealed bids were received on July 20, 2016, by the City of Carlsbad for the
construction of this project; and
WHEREAS, the lowest responsive and responsible bid was submitted by NEWEST Construction,
Inc. in the amount of $2,870,800; and
WHEREAS, funds have been appropriated from the Sewer Replacement Fund and are sufficient
for the completion of this project; and
WHEREAS, this project is exempt from California Environmental Quality Act (CEQA) review
pursuant to CEQA Guidelines section 15302(c) in that it is a replacement of an existing utility system
on the same site involving negligible or no expansion of capacity and a Notice of Exemption was filed
with the San Diego County Clerk on May 29, 2014.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $2,870,800 submitted by NEWEST Construction, Inc., for the
construction of the Foxes Landing Lift Station Replacement, Project No. 5526, is accepted and the
Mayor is hereby authorized to execute a contract with NEWEST Construction, Inc.

3. The City Manager is hereby authorized to approve construction Change Orders up to
$430,620.
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 days of adoption of this Resolution. The City Manager
may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 23rd day of August, 2016, by the following vote, to wit:
