Executive Summary The claimant is a former Police Officer. Ms. Jannusch sustained work related injuries to the spine, head, neck, back and left knee resulting in permanent disabilities. Discussion The terms and conditions of the proposed settlement are set forth in Request For Settlement Authority (on file in the Human Resources Department). The terms and conditions were agreed upon by the claimant and the city, and have been recommended by Keenan & Associates, the city's third party administrator. Fiscal Analysis The cost of the settlement is $160,000. There are sufficient funds available in the Workers' Compensation Self-Insurance Fund to cover the cost of this settlement. Next Steps This action will result in settlement of all Workers' Compensation claims by claimant and the claims will be closed with no future medical care. Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonable foreseeable indirect physical change in the environment; and therefore, does not require environmental review. Item #7 August 23, 2016 Page 2 of 3 RESOLUTION NO. 2016-176 r - L \ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AUTHORIZATION OF SETTLEMENT OF WORKERS' COMPENSATION CLAIMS OF RACHEL JANNUSCH FOR $160,000. WHEREAS, Keenan & Associates, the city's third party administrator, has recommended a settlement of the Workers' Compensation claims of Rachel Jannusch with no future medical care required; and WHEREAS, all parties have agreed to settle this claim before the Workers' Compensation Appeals Board . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the expenditure of $160,000 from the Workers' Compensation Self-Insurance Fund is authorized for the settlement of said claims. 3. That the City Council approves the Request for Settlement Authority on file in the Human Resources Department. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 23rd day of August, 2016, by the following vote, to wit: AYES: Hall, Wood, Schumacher, Blackburn, Packard.
