Executive Summary The city is currently undergoing a major software implementation -Energov Permitting and Licensing - that will greatly increase the availability of development related information to the public. As part ofthis project, Community & Economic Development led a study to simplify the city's existing fees related to development. The preliminary review of the city's fees, attached as Exhibit 2, concluded that while there were opportunities for fire prevention to simplify fees, the city's fire fees warranted a comprehensive study. Prior to this study, fire prevention fees had not been comprehensively analyzed in a significant amount of time, so the Fire Prevention Division pursued a comprehensive analysis to determine if fire prevention fees were aligned with industry best practices and adequately recovering the city's costs to provide services. The study examined fees for the following areas related to fire prevention services: • Fire Extinguishing & Alarm Services • Development Applications, Plan Review & Inspection • Annual Inspection & Fire Code Permits There were three primary phases of analysis applied throughout the Cost of Services (Fee) Study: Cost of Service Analysis, Cost Recovery Evaluation, and Fee Establishment. The data used for the study included permit data from the city's existing permitting system, departmental budget reports as well as in-depth interviews to complete staff time analysis. The study shows that on average, the city is not recovering the total eligible cost of service for each fee category identified and studied. The city is currently recovering approximately 23% of the cost of providing services for which a fee could be charged. The study focuses on describing the defensible approach applied to calculating the total cost of service for each fee category analyzed, as well as the resulting 100% cost recovery amount derived for each fee category. The narrative Fee Study of Fire Prevention Services (attached as Exhibit 3) provides the full detail of the methodology and approach of the study. The User Item #17 August 23, 2016 Page 1 of 92 Fee Study of Fire Prevention Services (attached as Exhibit 4) provides the quantitative analysis outlining the total cost of service for each fee category. Discussion Fee Study Elements The fee study included a range of fee structure design and fee structure implementation considerations including: • Addition to and deletion of fee categories-The Study process provided the opportunity to propose additions and deletions to the fee schedule, as well as rename, reorganize, and clarify fees. Many such revisions were performed to better conform fees to current best practices, as well as improve the calculation of fees owed by an individual, the application of said fees, and the collection of revenues. Beyond this, some additions to the fee schedule were simply identification of existing services or activities performed by City staff for which no fee was imposed. • Revision to the structure of fees-In many cases, the current structure of fees was sustained; the level of the fee was simply recalibrated to match the costs of service and targeted cost recovery level. In several cases, however, the manner in which a fee is imposed on a user was changed. In the majority of cases in which this was done, the primary objective was to simplify and/or clarify the fee structure, or increase the likelihood that the full cost of service would be recovered. • Documentation of tools to calculate special cost recovery -Documenting combined fully burdened hourly rates for the Fire Prevention Division in the Master Fee Schedule provides an opportunity for the City Council to approve rates that should be used whenever the city computes a special form of cost recovery under a /(time and materials" approach. Publication of these rates should be included in the Master Fee Schedule with language providing that special forms of cost recovery for activities and services not contemplated by the adopted master fee schedule can be computed at the discretion ofthe City Manager or Manager's designee. Proposed Fee Structure The Fire Department recommends a 100% cost recovery model for fees associated with development. Development includes plan checking and inspections prior to a building being occupied or reoccupied during tenant improvements. A significant portion ofthese fees are contract service fees for plan check, which are passed through to the customer. Fire Prevention staff used three theoretical building projects to compare costs to the cities of Oceanside, Vista and Encinitas. Carlsbad's cost remain at the bottom using the proposed cost recovery model. This will only apply to fees collected directly by the Fire Department and will not include Engineering or Planning Department fees at this time. The Fire Department is recommending a 0% fee model for fees associated with the inspections of buildings for the purposes of maintenance. Maintenance fees are for operational permits, mandated inspections and non-mandated business inspections. Maintaining the fire code improves employee, public, and first responder's safety and the greater good is benefited through fire code maintenance programs that are aimed at correction rather than collection. The Fire Department is recommending a 100% fee model for fees associated with special events/activities. Special event/activity fees are geared towards those events that occur outside the normal operating hours of the city and for a defined period of time such as tent inspections, street fairs, tennis and golf tournaments, and fireworks. Most of these events require permitting, inspection and standby from fire prevention staff during off hours. Item #17 August 23, 2016 Page 2 of 92 Schedule for Adoption The following schedule will allow the city to implement the proposed new rates in time for go-live of Energov, the new permitting and licensing system and will be implemented along with the development related fee updates approved by City Council with the FY2016-17 budget. August 23, 2016 September 13, 2016 November 13, 2016 Set the Public Hearing for September 13, 2016 Hold the Public Hearing and adopt new rates Effective date of new rates Notification procedures will be conducted in accordance with Government Code Section 66016 which governs the implementation of development related fees. A sample of the Notice is shown in Exhibit 5. Fiscal Analysis The proposed fire prevention fee structure is the result of the fee study to ensure incorporation of industry best practices and standards and aligns with categories to similar development processes such as building permits. The new fee structure would go into effect the date the city goes live with the new permitting and licensing software system, Energov, but no sooner than is allowed by Government Code Section 66016. The User Fee Study (Exhibit 4) shows the total cost of service for each of the following fee categories: Fire Extinguishing & Alarm Services: These fees are primarily based on size and scope of the extinguishing or alarm system. Tiers are delineated by residential or commercial structures as well as total number of devices such as sprinkler heads or hydrants. Development Applications, Plan Review & Inspection: These fees are aligned to the fire prevention review and inspection of other development applications including planning, engineering and building. Annual Inspection & Fire Code Permits: These fees deal with state mandated inspections of particular types of facilities such as licensed care facilities and schools. It also includes required fire code permits related to categories such as hazardous materials and processes that require annual inspections. The proposed structure is tiered based on size or level of complexity. For example, permits related to hazardous materials and processes are divided into categories based on type and quantity of material or process. The purpose of this Memorandum is to document the outcome of NBS' research and recommendations regarding opportunities for fee structure simplification, as well as some secondary opportunities for improvement in the ways that fees for services could be charged to more be consistent with Best Management Practices of other neighboring cities. 1. Introduction to NBS NBS was founded in 1996 by experienced finance and engineering professionals, and has worked with more than 300 public agencies to date. NBS is an independent consulting firm serving local governmental agencies, including cities, towns, counties, municipal utilities, and special purpose districts. Our Financial Consulting practice focuses primarily on cost recovery mechanisms and supporting justification for various agency revenue streams, including preparation of User and Regulatory Fee studies. Our professional staff completing the professional review of the City's fee current fee structure possesses over 50 years of combined expertise and experience performing comprehensive fee analysis for California local government. 2. Project Approach User and/or Regulatory Fees represent cost recovery opportunities entirely within the City's control: revenues which the City Council may -at its sole discretion upon public hearing -implement and/or modify without further public process or approval. The City does not have to conduct a Proposition 218 process to impose these fees, nor are they covered by the strict guidelines of the Mitigation Fee Act. User fees are charges imposed by the City for a service provided or required due to the request or action of an individual/entity, while regulatory fees are those imposed to recover costs associated with the City's power to govern certain activities. In most cases, the only legal limitation on the establishment of these fees is that they may not exceed the estimated and reasonable costs incurred to provide the service or perform the function. The City provided NBS with a list of current fees from the Planning, Engineering, Building, and Fire departments to review from this perspective. The City also provided a four (4) fiscal year history of revenue by major fee category for each department, in order to assist NBS with gauging the degree of revenue neutrality related to recommendations for fee structure simplification. NBS also interviewed City staff from each department to gather their ideas regarding opportunities for fee structure simplification. Finally, NBS conducted a comparative review of fees from the following California communities: Oceanside, San Marcos, Vista, Escondido, Riverside, Santa Monica, Newport Beach, and Santa Barbara. Footer Removed Per City's Request Item #17 August 23, 2016 Page 7 of 92 It should be noted that NBS did not review or attempt to validate whether the City of Carlsbad's existing fee amounts are calibrated to recover more or less than the estimated and reasonable costs of providing each seNice, as required by the State's Government Code. NBS also did not do an in depth analysis of whether Carlsbad's existing fee amounts are more or less than the fees charged by comparison cities, though some minor comments and obseNations are provided to that affect. The focus of this study was primarily to gauge opportunities for simplification and/or elimination of fee items in the City's existing fee structure. In addition, penalties, taxes, fines, and impact fees were excluded from the NBS' scope of research and discussion, although a few of these items may have been suNeyed for informational purposes only. 3. The most significant increases in revenue are in the Coastal Development Permit, Environmental Review, Variances and Zone Changes, reviewing discretionary/administrative projects (4885), and Plans and Maps reviews. In addition, Hillside Development Permits, and Noticing fees showed steady increases. Attachment A provides a comparison of fee structures and amounts across selected California communities. The following provides a summary by each fee type and includes recommendations for the City to consider related to opportunities for simplifying the existing fee structure: • Agricultural Mitigation Fee: This project type is an impact rather than a user fee and is excluded from discussion. Footer Removed Per City's Request 2 Item #17 August 23, 2016 Page 8 of 92 • Appeal Fees: Two out of eight comparison cities charge fees that are similarly structured to Carlsbad, where fee amounts vary depending on the level of appeal requested, Planning Commission versus City Council. Four out of eight charge a single fee for an appeal, regardless of the level of appeal requested. Two cities have fee structures that are not comparable to Carlsbad's structure. Overall, Carlsbad's fee amounts are lower than cities that charge by level of appeal, and higher than those cities with a single fee, regardless of level of appeal requested. Recommendation: Because appeal fees tend to be heavily subsidized, charge a single appeal fee, regardless of level of appeal requested. Conduct a cost analysis, or default to the lower of two fees (Planning Commission), until a cost analysis is performed. • Coastal Development Permit: Three out of eight cities are not comparable to Carlsbad due to their location away from a coastal zone. Two additional cities, Newport Beach and Santa Monica, are also not comparable to Carlsbad because they charge on an hourly basis, or a single flat fee for "Approval in Concept". Santa Barbara has a similar fee structure to Carlsbad, where permit fees are "tiered" by lots for residential applications, and by square footage for non-residential. Oceanside's fee amounts appear to vary based on whether the application can be approved administratively (Department Director), or requires Planning Commission or City Council review. Overall, Carlsbad's fee amounts are lower than Santa Barbara and Oceanside. Recommendations: a) Structure Coastal Development Permit fees by level of review required rather than residential versus non-residential (should the City's Municipal Code allow); b) Create a single section in the fee schedule for exemptions, extensions, amendments, and emergency permits in order to reduce the number of sub-fee categories in the fee schedule. • Conditional Use Permits: Carlsbad's fee structure is based on a minor versus major project application, which is the standard approach seen in most comparison cities. Three out of eight cities break out additional major fee categories in consideration of special or non-profit uses, or residential versus nonresidential. Two out of eight cities show a single fee for conditional use permits. Overall, Carlsbad's fee structure is as simple, or more simplified than comparison cities. Amounts are significantly lower for minor permits, and within range for major permits with the exception of fees charged by San Marcos and Santa Monica. Recommendations: Create a single section in the fee schedule for exemptions, extensions, amendments, and emergency permits in order to reduce the number of sub-fee categories in the fee schedule. • Construction Change Review: Only two out of eight comparison cities have a similar charge for this service. Fees are charged on a per sheet basis similar to Carlsbad, or as amount equivalent to Yz of the current fee for the project. Recommendation: Collapse the two existing fee categories into a single base fee amount plus per sheet charge, regardless of minor versus major review. Conduct a cost analysis, or default to the lower of two fees until a cost analysis is performed. • Environmental Impact Assessment: This fee category is also commonly termed an "initial study" in other cities across the State. Two out of eight comparison cities charge for this service based on an Footer Removed Per City's Request 3 Item #17 August 23, 2016 Page 9 of 92 hourly rate. San Marcos and Santa Monica charge for this service based on a flat fee amount, while Riverside and Santa Barbara show tiers based on whether a project requires grading, or whether staff prepares the analysis or a consultant. Carlsbad charges a lower fee amount for single family projects, and a higher fee amount for other land uses. Overall, Carlsbad's fees for an initial environmental assessment are significantly lower than comparison cities. Many comparison cities also charge a nominal fee for a Categorical Exemption; Carlsbad does not have a fee for this service. Recommendation: a) Collapse existing fee categories into a single category, regardless of single family versus other project types. Conduct a cost analysis, or default to the lowest fee amount until a cost analysis is performed. b) Consider adding a fee category for Categorical Exemption processing services, using a cost analysis to determine the potential fee amount. • Environmental Impact Reports: Three out of eight comparison cities charge for preparation of an Environmental Impact Report based on actual cost, which entails a deposit collected from the applicant and an hourly rate or any consultant costs charged against that deposit. Riverside charges a single minimum review fee, while all other cities charge a flat fee plus consultant costs or a percentage on top of consultant costs to recovery for city staff's administrative and review efforts. Recommendation: Collapse all fees for Environmental Review into a single fee category. Establish a flat, non-refundable administrative fee for facilitating review of EIR consultant work product. Charge on an hourly basis for hours required above and beyond the flat administrative fee. Conduct a cost analysis to implement this recommendation. • General Plan Amendment: Five out of eight comparison cities charge a flat fee amount for this service. Two cities structure their fees similarly by acreage tiers; Escondido has three tiers compared to Carlsbad's two tiers, and Oceanside requires a deposit for projects with 10 acres and above. Recommendation: Carlsbad should stay with current practice, but edit wording of fee categories to match Zone Change fee categories. • Habitat Management Plan: No comparison was available for this fee item for the selected comparison cities. However, NBS has seen similar fees charged in other cities for this service. Recommendation: Consider eliminating the single family fee category, unless Council policy specifically required such a subsidy to this user group. City staff should try to verify the reason for creation of the single family fee category to determine if elimination of this fee is viable. • Hillside Development Plan: No comparison was available for this fee item for the selected comparison cities. However, NBS has seen similar fees charged in other cities for this service. Recommendation: None • Landscape Plan Review and Inspection: Three out of eight comparison cities did not have comparable fees shown for this service. Two out of eight cities charge fee amounts based on the Footer Removed Per City's Request 4 Item #17 August 23, 2016 Page 10 of 92 value of the landscape project estimate, similar to Carlsbad. Two out of eight cities charge fee amounts based on the type of land use reviewed; single family, multifamily, commercial, etc. Recommendation: Continue with current practice. Ensure that fee categories reflect any changes that may occur with simplification efforts in Engineering Grading and Improvements fee categories. • Master Plan and Amendments: Two out of eight comparison cities listed a similar fee category for Master Plan review, Escondido and Santa Barbara. Escondido listed a Master Plan submittal fee a subcategory of "Planned Development". Santa Barbara listed a single flat fee for this service, much lower than the fee shown for Carlsbad. Carlsbad's fee structure is more elaborate than Escondido or Santa Barbara, where a flat fee amount is initially collected, and further charges apply based on an hourly rate if City staff hours exceed a stated limit. Recommendation: Carlsbad should stay with existing practice. • Noticing Service: No comparative city showed separate noticing fees. The service of noticing is assumed to be included in the primary application or permit fee, where required. Recommendation: Eliminate the additional fee category for noticing and including the average noticing cost within each primary application or permit fee. Postage costs can remain separate if desired by the City. • Planned Development: Three out of eight comparison cities showed comparable fee structures for review of planned developments. Carlsbad's current fee structure includes four separate fee categories for residential versus non-residential project types, and three tiers based on number of lots for each fee category. Comparison cities with fees for review of planned developments charge on a per hour basis or show three fee flat fee categories, or less. Recommendation: Reduce the number of tiers for residential versus non-residential projects to two tiers (major and minor). The decision to do so would depend on anticipated development applications and project size. Conduct a cost analysis to implement this recommendation, or default to the lowest current fee amount, until a cost analysis is performed. • Planning Commission Determinations and Discussion Items: Santa Barbara is the only comparison city which showed a comparable fee structure for a separate Planning Commission review process. Santa Barbara's fees for this service are structured for the first hearing, plus each subsequent hearing. Recommendation: Reduce the number of fee categories to a single fee category for a public hearing initial, and public hearing subsequent, regardless of whether the item is a determination or discussion, or single family versus other project type. Conduct a cost analysis to implement this recommendation, or default to the lowest current fee amount, until a cost analysis is performed. • Precise Development Plan and Amendment: Escondido is the only comparison city with similar fees for these services. Recommendation: Unless the review processes for a Precise Development Plan are redundant or can be combined with another fee category, NBS has no recommendations. Footer Removed Per City's Request 5 Item #17 August 23, 2016 Page 11 of 92 • Preliminary Plan Review: Three out of eight comparison cities charge similar fees for preliminary project consultation or plan review prior to application submittal; however, no comparison city offers a comparable method of charging. The most significant increases in revenue overall are in the following fee categories: SWPPP and SWMP plan check, Improvement and Grading Plan Check, and Easements and Agreements. Several fee categories show an overall decrease in revenue from Fiscal Year 2011 and 2015, including Encroachments and Plans and Maps which capture the largest decreases. Attachment B provides a comparison of fee structures and amounts across selected California communities. The following provides a summary by each fee type and includes recommendations for the City to consider related to opportunities for simplifying the existing fee structure: • Adjustment Plat: Two out of eight comparison cities charge a flat fee for this service, yet the fee is listed in the Planning fee schedule rather than Engineering. One city charges based on the percentage of the initial plan check fee. Recommendations: None. • Miscellaneous Inspections and Re-Inspections: Most comparison cities charge based on an hourly rate or per inspection. One city charges based on the percentage of the initial plan check fee. Recommendations: None • Electrical, Plumbing, and Mechanical "Trade" Permits: All comparison cities charge fees for review and inspection of various types of electrical, plumbing, and mechanical aspects of construction which are regulated by the California Building Code. Due to the lengthy nature and minutiae of trade permit fee schedules, NBS did not complete an itemized comparison of trade permits. Typically, cities will utilize an itemized list of fees broken down by the number of circuits, fixtures, or pieces of equipment needing review. For electrical, plumbing, and mechanical systems associated with a building permit for new construction, tenant improvements, or remodels, cities have several approaches to calculating fees: a. Calculate a separate fee amount for each trade based on the itemized list of permit fees. b. Charge one all-inclusive building permit and plan review fee for these services as determined by the project-value calculation or other method c. Calculate a separate fee amount for all trades together, or each category of trade separately, that is based on a percentage of the building permit or plan check fee, or square footage of space requiring trades review. For electrical, plumbing, or mechanical permits that are not associated with a building permit, most cities utilize the itemized list. In order to simplify the traditional approach to calculating trade permit fees (counting and adding items off the extensive list), some cities have started to move toward a "per permit" or "per inspection" basfs for trade permits that are not associated with a building permit, or associated with minor building permits. Carlsbad has recently added an individual electric, mechanical, or plumbing permit fee with the same intention in mind. Recommendation: NBS supports the Building Division's current direction toward streamlining permit fees and reducing or eliminating the number of itemized trade permits on the fee schedule. However, in attempting to convert trades permits associated with building permit projects, NBS recommends further discussion regarding fee structure options along with a cost analysis be performed. City staff expressed a desire to establish a flat residential fee for smaller scopes of work and then a fee structure possibly based on square footage instead of itemized calculations. 6. Fire Fees The table below provides a 5-year history of Fire Division fee revenue by major fee category I type. Table 4. Attachment D provides a comparison of fee structures and amounts across selected California communities. The following provides a summary by each fee type and includes recommendations for the City to consider related to opportunities for simplifying the existing fee structure. However, it should be noted that upon initial review and discussion of these recommendations, the Department agrees that a full scale user and regulatory fee analysis might b~ the best option for Fire. City staff would also like to explore a full scale analysis of Fire fees to more accurately reflect staff timing and resources necessary to fulfill the division's business capabilities and government regulations. On the whole, Fire Prevention staff aligned with other divisions and expressed a desire to move away from itemized counting as a fee basis and move toward a more scaled approach such as project square footage. • Fire Nuisance Alarm: These fee items are considered penalties and were surveyed, but are excluded from discussion. • Expedited Fire Plan Review Service Fee: Two out of eight comparison cities listed fee amounts for similar services; one city listed a similar fee in their building department. Recommendations: None • Alternative Materials and Methods: Two out of eight comparison cities listed flat fee amounts for similar services. Overall, Carlsbad's flat fee for this service is higher. Recommendation: None • Fire Department Review of Building Construction Plans: Beyond review performed by a Fire Department related to sprinkler and alarm plans, there is often additional efforts expended to review the life and safety aspects of a building construction plan. Carlsbad does not list a current fee for service, but upon interviewing staff, the Expedited Fire Plan Service Review fee may currently be charged for this service. All comparison cities except for San Marcos listed a fee for this service. Fee structures and amounts vary significantly between cities, but the most common approaches are to charge varied fees based on occupancy type and size (square footage), or a nominal flat fee per plan check. The City of Vista charges a fee based on a percentage of the initial building plan check fee. Recommendation: Consider eliminating this fee category if the seNice is no longer provided, or can be combined within another existing fee category. • State Mandated Fire Clearance Inspections: Most comparison agencies listed similarly structured fees for these services that are required to be conducted on an annual basis. Recommendation: None • Yearly Operational Permits and Single California Fire Code Permits: Oceanside, San Marcos, and Vista did not list similar fees for these services. Escondido and Santa Monica listed fees for these services, however the same fee amounts applied for various permit types. Newport Beach and Riverside have developed simplified fee structures that group yearly operational permits and/or California Fire Code Permits into a simplified structure. Recommendation: Pursue a simplified fee structure for single or multiple permits, or similar to Newport Beach in order to eliminate a lengthy itemized list of individual permits. A cost of seNice analysis is likely required to complete a transition to a streamlined fee structure, unless the City can group similar activities and default to the lowest fee amount. • Service Installation Fee -Fire Hydrant Lateral and Assembly or Sprinkler Lateral: No comparison was available for this fee item for the selected comparison cities. Recommendation: Consider eliminating this fee category if the seNice is no longer provided, or can be combined within another existing fee category. 7. Summary of Consultant Review I Conclusion NBS provided a detailed review of fee structures in comparison agencies, and provided recommendations for consideration by the City to simplify or eliminate fee categories. The largest opportunity for simplification in the Planning fees is to create a single and uniform section of fees and fee amounts for modifications, amendments, extensions, etc. For both Planning and Engineering fees the City should begin or continue to collapse or eliminate "tiered" fee structures (by number of lots, Footer Removed Per City's Request 19 Item #17 August 23, 2016 Page 25 of 92 project construction value, etc.) as the community approaches build out of available vacant land. Additionally for Engineering, there is an opportunity to simplify the structure of SWMP and SWPPP plan check and inspection fee categories, should the City decide to pursue staff's recommendation to roll se_veral fee items together with Improvement Plan and Inspection fee categories. The City's Building fees are already simple in their structure through use of the project-value method of calculating fees. However for trade permits, opportunities exist for simplification or elimination of an extensive itemized list by using a single fee system, percentage, or square footage based method of calculating fees. Finally, for fire, opportunities for simplification are apparent in eliminating fees for which services are no longer provided, or not charged on a routine basis. However, NBS also notes that the City's Fire fees are likely grossly under-recovering their costs and should be studied comprehensively. Predicting the amount to which any changes in fee structures will affect Department revenues is difficult to quantify. The level of detail in the City's revenue reports was not available to complete such an analysis, but could be looked at in greater detail if a full fee study is conducted. For the near-term, the City should not recommend any fee structure change without conducting an internal cost of service analysis, or defaulting to the lowest fee amount currently shown on the adopted fee schedule. To implement any change to a fee amount, NBS recommends the item be reviewed, discussed, and adopted by the City Council. This report presents the Study's findings and recommendations, which intend to defensibly update and establish user and regulatory fees for service for the City of Carlsbad, California. The City's chief purposes in conducting this Study are to: • structure fees according to current best practices in fire prevention service delivery, • ensure that existing and proposed fee amounts are calibrated to the costs of providing each service; and, • offer an opportunity for the City Council to optimize its revenue sources, provided that any increased cost recovery from user fees and regulatory fees would not conflict with broader City goals and objectives. On average, the City is not recovering the total eligible cost of service for each fee category identified. According to the City's revenue reports for Fiscal Year 2014-15, approximately $170,000 were collected in fees for Fire Prevention services. As discussed in Section 2 of this report, the total estimated cost of providing fee related services for the Division is approximately $727,000. The City is currently recovering approximately 23% of the cost of providing services for which a fee could be charged. As discussed further in Section 1 of this report, there are many economic, political, and behavioral reasons city staff or policy makers may or may not recommend or adopt fees at 100% of their costs. For these reasons, City staff made an initial effort to suggest cost recovery policy levels for Council's consideration by providing initial "recommended fee" input for each service area studied. These recommended fee amounts are included as part of the City's staff report to Council. This report from NBS focuses on describing the defensible approach applied to calculating the total cost of service for each fee category included in the Study, as well as the resulting 100% cost recovery amount derived for each fee category. Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 3 Item #17 August 23, 2016 Page 61 of 92 Section 1 -Introduction and Fundamentals It is generally accepted in California that cities are granted the authority to impose user fees and regulatory fees for services and activities they provide through provisions of the State Constitution. Under this legal framework, a fee may not exceed the estimated reasonable cost of providing the service or performing the activity. For a fee to qualify as such, it must relate to a service or activity under the control of the individual/entity on which the fee is imposed. For example, the individual/entity requests service of the municipality or his or her actions specifically cause the municipality to perform additional activities. In this manner, the service or the underlying action causing the municipality to perform service is either discretionary and/or is subject to regulation. As a discretionary service or regulatory activity, the user fees and regulatory fees considered in this study fall outside requirements that must otherwise be followed by the City to impose taxes, special taxes, or fees imposed as incidences of property ownership. Scope of Study The following categories of fees were examined in this study: I. Fire Extinguishing and Alarm Systems: The City permits new or retrofitted sprinkler and alarm systems, as well as other types of specialized extinguishing systems. II. Development Applications, Plan Review, and Inspection: The City's Fire Prevention Division reviews and provides comments on many types of applications submitted to the Planning and Engineering Division. The Fire Prevention Division also supports the Building Division by reviewing plans and inspecting most types of new non-residential projects, residential vegetation fuel modification requests, and any hazardous materials storage, high piled storage, or above and underground tank permits. Ill. Annual Inspection and Fire Code Permits: The City is required to perform routine, State-mandated inspections on many types of building within City limits such as residential and commercial care facilities, hotels and motels, apartments, etc. The City also charges both annual and one-time fire prevention permit fees for activities regulated or permitted per the California Fire Code and/or Carlsbad Municipal Code. The fees examined in this Study specifically excluded any type of utility rates, development impact fees, and special assessments, all of which fall under distinct analytical and procedural requirements different from the body of user/regulatory fees analyzed in this effort. Additionally, this Study excluded facility and equipment rental rates, as well as most of the fines and penalties that may be imposed by the City for violations to its requirements or code. (The City is not limited to the costs of service when charging for . entrance to or use of government property, or when imposing fines and penalties.) Methods of Analysis There were three primary phases of analysis applied throughout this Cost of Services (Fee) Study: Cost of Service Analysis, Cost Recovery Evaluation, and Fee Establishment Cost of Service Analysis A cost of service analysis is a quantitative effort that compiles the full cost of providing governmental services and activities. There are two primary types of costs considered: direct and indirect costs. Direct Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 4 Item #17 August 23, 2016 Page 62 of 92 costs are those that specifically relate to the activity in question, including the real-time provision of the service. Indirect costs are those that support the provision of services but cannot be directly or easily assigned to the activity in question. An example of a direct cost is the salary and benefit expense associated with an individual performing a service. In the same example, an indirect cost would include the expenses incurred to provide an office and equipment for that individual to perform his or her duties, including (but not exclusive to) the provision of the service in question. Components of the full cost of service include direct labor costs, indirect labor costs, specific direct non- labor costs where applicable, allocated non-labor costs, and allocated organization-wide overhead. Definitions of these cost components are as follows: • Labor costs -These are the salary/wage and benefits expenses for City personnel specifically involved in the provision of services and activities to the public. • Indirect labor costs -These are the salary/wage and benefits expenses for City personnel supporting the provision of services and activities. This can include line supervision and departmental management, administrative support within a department, and staff involved in technical activities related to the direct services provided to the public. • Specific direct non-labor costs -These are discrete expenses incurred by the City due to a specific service or activity performed, such as contractor costs, third-party charges, and very specific materials used in the service or activity. (In most fee types, this component is not used, as it is very difficult to directly assign most non-labor costs at the activity level.) • Allocated indirect non-labor costs -These are expenses other than labor for the departments involved in the provision of services. In most cases, these costs are allocated across all services provided by a department, rather than directly assigned to fee categories. • Allocated indirect organization-wide overhead -These are expenses, both labor and non-labor, related to the City's agency-wide support services. Support services commonly include general administrative services such as: City Manager, City Clerk, City Attorney, Human Resources, Finance, etc. The amount of costs attributable to each department or division included in this study were developed though a separate Cost Allocation Plan provided by the City's Finance Department. All costs in this Study are expressed using annual (or annualized) figures, representing a twelve-month cycle of expenses incurred by the City in the provision of all services and activities agency-wide. Nearly all of the fees under review in this study require specific actions on the part of City staff to provide the service or conduct the activity. Because labor is an underlying factor in these activities, the full cost of service was most appropriately expressed as a fully burdened cost per available labor hour. This labor rate -expressed as an individual composite rate for the Fire Prevention Division, and serves as the basis for further quantifying the average full cost of providing individual services and activities. The fully burdened labor rate is used at the individual fee level to estimate an average total cost of providing each fee related service or activity. This step required the development of staff time estimates for the services and activities listed in the proposed fee structure. It should be noted that the development of these time estimates was not a one-step process: estimates received were carefully reviewed by both consultant and the Fire Marshal to assess the reasonableness of such estimates. The average cost of service represents the average cost at the individual fee level. The City does not currently have the systems in place to impose fees for every service or activity based on the actual amount Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 5 Item #17 August 23, 2016 Page 63 of 92 of time it takes to serve each individual. Moreover, such an approach is almost universally infeasible without significant -if not unreasonable -investments in costly technology. Much of the City's Fire Prevention fee schedule is composed of flat fees, which by definition, are linked to an average cost of service; thus, use of this average cost method was the predominant approach in proceeding toward a schedule of revised . fees. Flat fee structures based on average costs of service are widely applied among other California municipalities, and it is a generally accepted approach . Cost Recovery Evaluation Current levels of cost recovery from existing fee revenues were stated simply by comparing the existing fee for each service or activity -if a fee was charged -to the average total cost of service quantified through this analysis. Cost recovery was expressed as a percentage of the total cost. A cost recovery rate of 0% means no costs are recovered from fee revenues. A rate of 100% means that the full cost of service is recovered from the fee. A rate between 0% and 100% indicated partial recovery of the full cost of service through fees. A rate greater than 100% means that the fee exceeded the full cost of service. User fees and regulatory fees examined in this Study should not exceed the full cost of service. In other words, the cost recovery rate achieved by a fee should not be greater than 100%. In most cases, imposing a fee above this threshold could require the consensus of the voters. Fee Establishment This Study also included a range of fee structure design and fee structure implementation considerations, as described below: • Addition to and deletion of fee categories -The Study process provioed the opportunity to propose additions and deletions to the fee schedule, as well as rename, reorganize, and clarify fees. Many such revisions were performed to better conform fees to current best practices, as well as improve the calculation of fees owed by an individual, the application of said fees, and the collecti_on of revenues. In other words, as staff is more knowledgeable and comfortable working with the fee schedule, the accuracy achieved in both imposing fees on users and collecting revenues for the City is greater. Beyond this, some additions to the fee schedule were simply identification of existing services or activities performed by City staff for which no fee was imposed. • Revision to the structure of fees -In many cases, the current structure of fees was sustained; the level of the fee was simply recalibrated to match the costs of service and targeted cost recovery level. In several cases, however, the manner in which a fee is imposed on a user was changed. In the majority of cases in which this was done, the primary objective was to simplify and/or clarify the fee structure, or increase the likelihood that the full cost of service would be recovered. • Documentation of tools to calculate special cost recovery -An element included in the City's fee schedule development is a combined fully burdened hourly rate for the Fire Prevention Division. Documenting these rates in the fee schedule provides an opportunity for the City Council to approve rates that should be used whenever the City computes a special form of cost recovery under a "time and materials" approach. It also provides clear publication of those rates, so ultimate fee payers of any uniquely determined fee can reference the amounts. Publication of these rates in the Master Fee Schedule should be accompanied by language providing that special forms of cost recovery for activities and services not contemplated by the adopted master fee schedule can be computed at the discretion of the City Manager or Manager's designee, following that the rates adopted by the City Council are as shown in the Master Fee Schedule. Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 6 Item #17 August 23, 2016 Page 64 of 92 Data Sources The following City-published data sources were used to support the cost of service analysis and fee establishment phases of this study: • The City of Carlsbad's Adopted Budget for Fiscal Year Fiscal Year 2015-16. • A complete listing of Fire Prevention Division personnel, salary/wage rates, regular hours, paid benefits, and paid leave amounts -provided by the Finance Department. • Various correspondences with the City staff supporting the adopted budgets and current fees, including budget notes and expenditure detail not shown in the published document. • Prevailing fee schedules provided by the Fire Department. The City's adopted budget is the most significant source of information affecting cost of service results. It should be noted that consultants did not conduct separate efforts to audit or validate the City's financial management and budget practices, nor was cost information adjusted to reflect different levels of service or any specific, targeted performance benchmarks. This study has accepted the City's budget as a legislatively adopted directive describing the most appropriate and reasonable level of City spending . Consultants accept the City Council's deliberative process and ultimate acceptance of the budget plan and further assert that through that legislative process, the City has yielded a reasonable expenditure plan, valid for use in setting cost-based fees. Beyond data published by the City, original data sets were also developed to support the work of this study: primarily, estimated staff time at various levels of detail. To develop these data sets, consultants prepared questionnaires and conducted meetings and interviews with individual City staff relevant to the fees and service areas studied. In the Cost of Service Analysis phase of the analysis, departmental staff provided estimates of average time spent providing a service or activity corresponding with an existing or new fee. Consultants and departmental management reviewed and questioned responses to ensure the best possible set of estimates. Cost of Service Analysis Based on the City's current organizational and cost accounting structure, NBS studied the costs of the Fire Prevention Division separate from the Fire Department's emergency response operations. The following table categorizes the Division's total costs across both fee related and non-fee related services, as well as the resulting fully-burdened hourly rate applicable toward establishing the "full" or "maximum" charge for fee related services. All subsequent cost of service calculations at the individual fee level assume a fully-burdened hourly rate of $132, with potential to recovery approximately $727,000 (78%) in costs from fees for service. The "Amount Requiring Another Funding Source" row of the table identifies service areas that NBS recommends as best funded via alternate revenue sources than fees for service. All subsequent cost of service calculations at the individual fee level exclude these amounts, resulting in approximately $206,000 (22%) requiring funding from non-user or regulatory fee revenues. The cost category nomenclature shown in the columns of table above was adapted and summarized from Division staff interviews. To assist the reader in understanding the underlying costs and assumptions used to calculate the fully-burdened hourly rate, summaries of the cost categories are provided as follows: • General Public Information -Staff time devoted to responding to phone calls and public inquiries not specifically associated with an active permit. Typically, some portion of costs for provision of general public information and assistance are not linked for recovery from fees for fire prevention services. Fire Prevention staff estimates approximately 75% of their time spent on this activity is associated with current and near term application submittal activities, while the remaining costs should be not be considered in the calculation of fees for services. • Weed Abatement -Groups of tasks and activities devoted to the responsibilities of enforcing weed abatement activities. As these tasks are typically considered activities related tci violation of State Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 8 Item #17 August 23, 2016 Page 66 of 92 laws and municipal codes specific to weed abatement, the funding source is typically found in penalty revenues, or is subsidized by the City's general fund. • Public Education -the Fire Prevention Division provides various public outreach and public safety education services. These activities are not related to activities for which a fee is charged, and are typically subsidized by a city's general fund. • Arson Investigation and Incident Response: Fire Prevention staff are occasionally called upon to provide investigation and response activities for the City. These activities are typically billed on a time and materials basis or are subsidized by the general fund. • Direct Plan Check and Field Services: Activities associated with an active fire prevention plan check, inspection, or permit application. 100% of these costs are recoverable in the Fire Prevention Divison's user and regulatory fees for service. Significant analytical and policy decisions often revolve around inclusion of categorized activity costs in the fully-burdened hourly rate. The decision whether to include or exclude some or all of a particular cost category in user/regulatory fees for service is guided by basic fee setting parameters offered by the California State Constitution and Statutes, which requires that any new fee levied or existing fee increased should not exceed the estimated amount required to provide the service for which the charge is levied. Cost Recovery Evaluation Attachment A presents detailed cost recovery tables for each fee recoverable service. The 'Total Cost of Service per Activity Column" establishes the legal maximum at which a fee could be charged for the corresponding service identified in the "Fee Description" list. NBS worked extensively with City staff to gather estimates of time required to perform each service identified in the Attachment. Time estimates were independently evaluated on separate occasions by staff members and also analyzed by NBS to determine whether the time estimates provided seemed reasonable when compared against the numerous fee studies NBS staff have performed. When the Cost of Service per Activity is compared to the Department's "Current Fee". some fees will appear to under recover their costs, some will come close to 100% recovery, and some will appear to collect more than the cost of providing services. This is a typical outcome of any Fee Study. According to the City's revenue reports for Fiscal Year 2014-15, approximately $170,000 were collected in fees for Fire Prevention services. As discussed in the Cost of Service Analysis section, above, the total estimated cost of providing fee related services for the Division is $727,000. The City is currently recovering approximately 23% of the cost of providing these services. Fee Establishment The Fire Prevention Division has not reconsidered the design of its fee structure (in terms of number of categories, fee names, additions and deletions of fees) for many years. As such, much of the efforts of this Study focused on bringing the fee structure up to current best practices seen in other agencies, based on the combined professional experience of the current Fire Marshal and NBS' consulting team. The following provides a summary of changes and observations regarding each major section of the fee table shown in Attachment A: Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 9 Item #17 August 23, 2016 Page 67 of 92 I. Fire Extinguishing and Alarm Systems: The City permits new or retrofitted sprinkler and alarm systems, as well as other types of specialized extinguishing systems. This Study established separate fee categories for the Processing, Plan Review, and Inspection portions of the permitting services provided by the Division. In addition, the Study focused on clarifying fee names and re-defining appropriate tiers (breakpoints) for fee categories. The Fire Marshal should be able to utilize the revised structure in deciding how to best charge for insourced versus outsourced plan reviews, as well as have a better tracking of fees aligned with specific services provided. The City's customers should experience greater transparency in what their fee amount for specific project requests will be. II. Development Applications, Plan Review, and Inspection: The City's Fire Prevention Division reviews and provides comments on many types of applications submitted to the Planning and Engineering Divisions. The Fire Prevention Division also supports the Building Division by reviewing plans and inspecting most types of new non-residential projects, residential vegetation fuel modification requests, and any hazardous materials storage, high piled storage, or above and underground tank permits. NBS reviewed the City's prior fee analysis and determined that some costs for Fire Prevention activities related to the review of Planning, Engineering, and Building projects were included in the establishment of those Divisions' fees for service. However, the City collects each fee as one fee, and does not track Fire Prevention's component of that fee calculation to a separate revenue account. For purposes of analysis, Attachment A makes an attempt within the "Current Fee" column, with available data from the last fee study, to estimate the portion of the City's current fee amounts that could be attributed to Fire's costs of providing services. Sufficient data was available to provide approximate current fee information for Planning and Engineering application review, but not for Building plan review or inspection services. NBS' recommendation for fees associated with Fire Prevention's review of Planning, Engineering, or Building projects is to establish a separate fee rather than combine the costs of Fire Prevention review into the total fee for service. The primary reason for this is the City should be able to charge the Fire Prevention review fee when it applies, and not charge it when a review is not needed or not conducted. Ill. Annual Inspection and Fire Code Permits: The City is required to perform routine, State-mandated inspections on many types of building within City limits such as residential and commercial care facilities, hotels and motels, apartments, etc. The City also charges both annual and one-time fire prevention permit fees for activities regulated or permitted per the California Fire Code and/or Carlsbad Municipal Code. The Fire Marshal indicated the City would like to expand its compliance with current mandates, as well as look into expanding the program as a whole to achieve greater public safety objectives. This Study assisted the City in adjusting fee amounts for current services in this area, as well as creating a comprehensive system offees should the City pursue an expanded annual inspection and permitting program. Via this report, NBS provides the total estimated cost of service information and the framework for considering fees, while those closest to the fee-paying population, the Fire Prevention Division, considered appropriate cost recovery levels at or below that total cost calculation. Section 1 of this report may be referenced for cost recovery evaluation guidelines. Predicting the amount to which any adopted fee increases will affect City revenues is difficult to quantify, and was not possible to estimate at this time with the data available from City resources. Fee Study of Fire Prevention Services -City of Carlsbad Prepared by NBS 10 Item #17 August 23, 2016 Page 68 of 92 Section 4 -Conclusion Based on the Cost of Service Analysis, Cost Recovery Evaluation, and Fee Establishment phases of analysis in this study, the proposed schedule of fees formatted for implementation has been prepared and included in the City's accompanying staff report. As discussed throughout this report, the proposed fee schedule includes fee increases intended to greatly improve the City's recovery of costs incurred to provide individual services, as well as to adjust fees downward where fees charge exceed the average costs incurred. For the near-term, the City should not count on increased revenues to meet any specific expenditure plan. Experience with these fee increases should be gained first before revenue projections are revised. However, unless there is some significant, long-term change in activity levels at the City, proposed fee amendments should -over time -enhance the City's revenue capabilities, providing it the ability to stretch other resources further for the benefit of the public at large. The City should consider adjusting these user fees and regulatory fees on an annual basis to keep pace at least with cost inflation. For all fees and charges, the City could use either a Consumer Price Index adjustment or a percentage of Labor Cost increase, and that practice would be well applied to the new fee schedule. Conducting a comprehensive user fee study is not an annual requirement; it becomes worthwhile only over time as significant shifts in organization, local practices, legislative values, or legal requirements change. In NBS' experience, a comprehensive analysis such as this should be performed every three to five years. It should be noted that when an automatic adjustment is applied annually, the City is free to use its discretion in applying the adjustment; not all fees need to be adjusted, especially when there are good policy reasons for an alternate course. The full cost of service is the City's only limit in setting its fees. As a final note in this study, it is worth acknowledging the path that fees in general have taken in California. The public demands ever more precise and equitable accounting of the basis for governmental fees and a greater say in when and how they are imposed. It is inevitable in the not too distant future that user fees and regulatory fees will demand an even greater level of analysis and supporting data to meet the public's evolving expectations. Technology systems will play an increased and significant role in an agency's ability to accomplish this. Continuous improvement and refinement of time tracking abilities will greatly enhance the City's ability to set fees for service and identify unfunded activities in years to come. In preparing this report and the opinions and recommendations included herein, NBS has relied on a number of principal assumptions and considerations with regard to financial matters, conditions and events that may occur in the future. This information and assumptions, including the City's budgets, time estimate data, and workload information from City staff, were provided by sources we believe to be reliable; however, NBS has not independently verified such information and assumptions. While we believe NBS' use of such information and assumptions is reasonable for the purpose of this report, some assumptions will invariably not materialize as stated herein and may vary significantly due to unanticipated events and circumstances. Therefore, the actual results can be expected to vary from those projected to the extent that actual future conditions differ from those assumed by us or provided to us by others.
