Recommended Action
Receive a presentation from Richard Schneck regarding Carlsbad Municipal Code Chapter 5.60-
Short-Term Vacation Rentals.
Executive Summary/Discussion
The City Council provides an opportunity for citizens and organizations to have an item placed
on a City Council Agenda by submitting a request to the City Manager. Attached is a request
from Richard Schneck (Exhibit 1) requesting that the City Council receive a presentation
regarding Carlsbad Municipal Code Chapter 5.60-Short-Term Vacation Rentals.
Fiscal Analysis
None.
Environmental Evaluation
Pursuant to Public Resources Code Section 21065, this action does not constitute a "project"
within the meaning of CEQA in that it has no potential to cause either a direct physical change
in the environment, or a reasonably forseeable indirect physical change in the environment,
and therefore does not require environmental review.

The purpose of this correspondence is reserve the allotted 10 minute time for a presentation during
the September 13, 2016 city council meeting.
My topic will be abolishing the invented vacation rental municipal code based on constitutional and
economic rationale. City bureaucrats have been contacted and demonstrated their ability to repeat
the current municipal code. I seek to have the city council abolish the invented municipal code in it's
entirety.

My name is Dewey Lederer and I reside at 7912 Calle Oliva, 92009. I use my primary residence as a vacation rental when
my wife and I travel to help support my retirement income. Since the ruling last year and I am on the east side of the
dividing line I have complied with the new policy of a 31 day minimum rental. Obviously the ruling has severely affected
to amount of bookings and my income. At the meeting on September 13 a group of residents in the same situation will
be attending the meeting but I am out of town and will not be able to attend.
The purpose of this email is to let you know that I feel the ordinance is unfair for the following reasons:
1. The ordinance should apply to the entire city and not be divided by an arbitrary line.
2. The ruling decreases my property value as it could be sold as an investment property
3. You have already made an exception for La Costa Resort properties to the line, why them and not us?
4. The city loses revenue due to my loss of business that I was paying the 10% TOT on.
I have no issues with the requirements such as a city permit, posting of my contact info, listing of a local person to deal
with any issues, etc. and as a matter of fact I agree with them.
Thank you for your consideration and I hope you feel that this issue is worth putting official agenda at a future meeting.
