bids.
Executive Summary
Construction documents are complete for the Aviara Community Park -Phase II Construction Project
(Aviara Phase II) and the Poinsettia Community Park -Phase Ill Construction Project (Poinsettia Phase
Ill). The Aviara Phase II project includes a large passive outdoor community gathering space with a
small stage, group picnic shelter -with restrooms and a catering support room, and individual picnic
areas. The Poinsettia Phase Ill project includes a dog park -with separate areas for large and small
dogs, a multi-sports arena field, a new larger playground -with equipment for both younger and older
children, and six pickleball courts. The City Council recently approved funding to design and construct
the pickleball courts at Poinsettia Community Park. A concept plan for the courts has been prepared
and is included in the subject documents as a basis for bidding.
Discussion
On December 9, 2014 the City Council approved the Parks & Recreation Department's updated
Master Plans for the Aviara and Poinsettia Community Parks to ensure future park amenities are
consistent with the community's vision -as identified in the 2013 Parks & Recreation Needs
Assessment. The updated master plans for the parks focus primarily on those areas of the parks that
have yet to be constructed.
The Aviara Phase II project is the final component for build out of the park. The site of the proposed
improvements is near the northwest corner of the park on a previously graded, vacant pad of about
one acre in size. The project consists of a large passive outdoor community gathering space which
includes turf area surrounded by a perimeter walkway; a small stage with a custom-designed shade
structure; a large covered group picnic area with an outdoor fireplace; a catering support room and
restrooms; individual covered and uncovered picnic areas; and a dual port EV charging station. The

improvements will result in a new venue for recreation programs and private rentals for weddings
and other special events. The catering support room and restrooms are desirable amenities for
visitors to the park, particularly during events and activities.
The Poinsettia Phase Ill project includes a multi-sports arena field, a dog park, and a new larger
playground. The multi-sport arena is an enclosed oval-shaped 80' x 180' synthetic turf field that will
be used for sports such as high-speed soccer, field hockey, and lacrosse. Additional amenities include
covered bleachers, two warm-up areas, storage lockers, picnic tables, and seating areas. The off leash
dog park will be located in a currently underutilized area near the center of the park. Areas for large
and small dogs will each be separated, and are designed to comply with ADA accessibility
requirements. Each side of the dog park will contain similar features such as dog agility equipment,
drinking fountains, and seating areas. The new playground component replaces the smaller outdated
playground with a unique design theme that incorporates three to five foot tall mounds of either
synthetic turf or rubberized play surface; a nature-themed line of equipment for younger children;
and structures for older children that incorporate a similar color palette. The equipment/structures
have been selected to encourage socialization and inclusive group play for all levels of ability. The
final component of the Poinsettia Phase Ill project is six lighted and fenced pickleball courts. The
courts are a recent addition to the proposed improvements, and their construction documents will
be incorporated into the approved plans when complete. Including the pickleball courts as an
additive alternate to this bid is expected to result in cost savings over bidding and constructing the
courts separately.
Fiscal Analysis
Staff is recommending bidding the Aviara Phase II and Poinsettia Phase Ill projects together in order
to achieve economies of scale, operational efficiencies and synergies related to construction of the
various park components. The table below provides the engineer's estimate and the available funding
for each of the park projects. Funding for the Aviara Phase II and Poinsettia Phase Ill projects was
approved FY 2015/16 to implement the Master Plan Updates for the respective parks. Funding in the
amount of$ 447,000 for the pickleball courts was approved in the FY 2016/17 Capital Improvement
Program Budget and is included in the total available funding for Poinsettia Phase Ill shown below.

Next Steps
Upon the City Council's approval of the plans and specifications for the project, staff will release
contract documents, plans and specifications for soliciting bids. The bid due date for the project will
be in November, allowing for a 30 day bid phase. Staff will evaluate the responsive bids received and
return to City Council with a recommendation to award the construction contract in December 2016.
Construction activities are expected to begin in January 2017. The construction phase is estimated
to be completed in one year.

Environmental Evaluation (CEQA)
On October 7, 1992, the Planning Commission approved a Conditional Use Permit (CUP 92-5) and
adopted a Mitigated Negative Declaration (MND) and a Mitigation Monitoring and Reporting
Program (MMRP) for the Poinsettia Community (Alta Mira) Park. On Aug. 6, 2002, the City Council
approved a Conditional Use Permit (CUP 01-22) and adopted a Mitigated Negative Declaration (MND)
and a Mitigation Monitoring and Reporting Program (MMRP) for the Aviara Community (Zone 19)
Park. Both projects are within the scope of the prior environmental documents for the respective
parks and no further environmental documentation is required per CEQA Guidelines Section 15162.
All applicable mitigation measures contained in the prior environmental document have either been
satisfied previously or have been incorporated into the new construction documents.
Public Notification
Community outreach has occurred throughout the projects, beginning with stakeholder interviews
and open public meetings for each park. This input contributed to the development of the Aviara
Community Park & Poinsettia Community Park Master Plan Updates (adopted by the City Council in
December 2014). On December 10, 2015 staff provided the City Council with an informational report
on the implementation of these projects. In addition, monthly Parks & Recreation Commission
meetings have included departmental reports -highlighting the progress of these projects.

WHEREAS, the City Council of the City of Carlsbad, California has determined that the contract
documents, plans and specifications for the Aviara Community Park -Phase II Construction and the
Poinsettia Community Park -Phase Ill Construction (CIP Project Nos. 4604 and 4605) have been
prepared, are on file in the Parks & Recreation Administration Office, and are incorporated by reference
herein; and
WHEREAS, construction of the proposed park improvements is desirable and in the public
interest of providing park amenities that are consistent with the community's vision as identified in the
2013 City of Carlsbad Parks and Recreation Needs Assessment; and
WHEREAS, the projects are consistent with the 2014 City Council adopted Parks & Recreation
Department's Updated Master Plans for the Aviara and Poinsettia Community Parks, and consistent

WHEREAS, sufficient funds are available in the amount of $2,522,127 in the Capital

My name is Elizabeth Payumo and I have been a Carlsbad home owner for 15 years living in Harbor
Pointe. I am writing today regarding the development projects at Poinsettia Park. Let me first begin
with the fact that I am in favor of adding new amenities to the park in order to bring those who have
not taken advantage of it already. My concern and displeasure relates to the placement of the dog
park. This is not about having a dog park or not, because I like dogs and think there should be an
area for them as well. What is very bothersome is the location proposed for the dog park.
This space is and has been a sacred space for the kids. They love rolling and running down the
slopes, playing pretend in the "rock stream," playing chase, having picnics under the trees, and just
being kids. I know people think that there are so many other places for the kids to play, but there
isn't. The playground is really for the toddlers, and the green space next to the play ground frequently
has people playing some type of game involving kicking or throwing a ball or parties. Truly the only
space is the bowl, which they cherish very much.
I understand that there has been a lot of time put into this project, and I respect that. What seems
unacceptable is the fact that the proposed location of each new amenity was not brought to the
communities attention sooner and the fact that the people wanting the dog park are not even happy
with the location. So why take away from those who want the space and give it to those who don't
want the space, that is beyond illogical. Lets not take away a child's right to be a kid and learn the
pleasures of rolling down a hill and using their imagination. Too much of what children do these days
is the opposite of unstructured play which is unfortunate, and this little piece of real estate provides
just such the opportunity to just be a kid.
This proposal must be discussed further before proceeding with the tearing out of the green
space. Give the community a voice, give the children a voice they are the ones who will be affected
and will remember the day their playtime came to a halt!

I'm a Carlsbad, CA resident that lives near the Poinsettia Community Park. I'm presently out of town for work this week,
otherwise I would most certainly be there in person for the voting of the dog park location at Poinsettia Park.
We are so fortunate to have such a beautiful park so close to our home. I'm a dog owner and I truly urge you to
reconsider the location. This is not the right place. There is so much bad in the world and I can tell you when you walk by
that part of the park, you see families together and kids laughing. Why do we take away such a beautiful thing?
Personally I have so many fond memories of my kids rolling down the hill and picnics as a family. This is a really bad idea
and so many people I see in the park agree! EVEN people who own a dog.
I do hope you make the best decision. I think it would be a real shame.

I hear that a group of moms is protesting the dog park at the location posted at the park.
Remember that over 600 signatures got this dog park set to happen. If the location in the park has to change,
just make sure the dog park still happens.
What about in the back section where the sign is posted for a multi use field? Or up in the front ofthe park
where there is easy access without disturbing the children's play area.
Please resolve this without jeopardizing our dog park.

save our proposed dog park!
I would like you to save our proposed dog park scheduled for Poinsettia Park. Mary Le Blanc and hundreds
more have worked hard to have a place for our dogs to safely exercise and not disturb others. The other dog
park is inconvenient for many of us who live right here near Poinsettia park. There are plenty of locations for
small children to play in Carlsbad and not many for dogs to play off leash in South/West Carlsbad.

It has been brought to my attention that there is a group who is opposing the proposed location of the previously
approved off leash dog park at Poinsettia Park at this late date. Those of us in SW Carlsbad who supported the original
effort to add a dog park-and who assisted in making the approval happen are very concerned that a small group like
this could further delay this project which has been needed for decades. Every park in the city is dedicated to tot lits and
youth sports. For a city this size to only have two off leash parks-and none in the SW area is a travesty. It is time to
approve the plan and begin the building of the dog park as the highest priority for the plan you will be approving at the
council meeting next week. As far as I am Aware there is no evidence to support the concerns of this small group-and
this last minute effort to stall the building of the dog park should be over-ruled.
Thank you for listening to the 600+ residents who made their concerns known when it was appropriate, and who now
expect no further delays in the bidding and construction process.

It has been brought to our attention that a small group of mothers have pulled together a petition about the
location of the proposed dog park in Poinsettia Park. A couple of years ago I appeared before Council with a
petition compiled of 600 signatures pleading for a dog park for those of us in SW Carlsbad who have no place
to take our dogs off leash. We were so happy when Council voted to have a dog park included.
At the time of our initial petition we had requested the upper parcels at the main entry to the park since the
parcels were adjacent to the parking area and would eliminate people walking their dogs down through the park.
After speaking with Barbara Kennedy at Parks & Rec I understand that those parcels are now dedicated to the
community center and pickle bailers. Our dog park is next to the tot lot which is upsetting the mothers.
We do not want to lose this dog park. Is the lower lot that now just stores a dumpster available as an alternate
site to make everyone happy? If we don't have an alternate site, then let the 600 signatures prevail and allow us
a place for our doggies. As you well know the SW quadrant has an abundance of condos and zero lot line
homes. Our only option right now is to drive to Encinitas. People who live near the Alga Norte dog park are not
exactly the most welcoming group of people and is also a 4-5 mile drive. Even when you get there you are
lucky to find any parking. Most of us could walk to Poinsettia Park!

I am in whole hearted agreement with keeping the grassy bowl area open and NOT converting it to a dog park,
and am very glad that someone started this petition to protect our neighborhood's communal space. I think a dog
park is much better suited on the periphery of this lovely park.
I am also disappointed that the city has decided to develop all of the open space in the park, designating it for
some kind of specific activity rather than just the enjoyment of natural and open area. I think it will make the
environment feel contested and too structured.
I have been a homeowner in this neighborhood for 16+ years, and do not remember anyone from the City
asking us our opinion on the development of our neighborhood park. When and how were these decisions
made? It makes a bad feeling in the community when others make the decision for those who live here .. please
don't do this in our wonderful town of Carlsbad.

Dog park at Poinsettia Park
I am writing to ask for your help in reconsidering the placement of the dog park at Poinsettia Park. I am very excited that
the park will be re-done and appreciate your involvement to better our community.
The proposed placement of the park is in a location where children love to play and a fun open area for them. It would
be sad for them and families to lose this special area. In addition, the proposed space is not near a parking lot ... So
people will bring their dogs through the entire park (making the whole park essentially open to dog use). Instead, please
consider moving the park to a location near the parking areas, such as to the east of the basketball courts. I think this
area would be more convenient for both dog owners and also other members ofthe community ... who would like to
enjoy some other areas of the park without dogs.

Please please *please* consider moving the dog park to another area of Pointsettia Park. The green area that
you are going to build it on has long been an important open space for children in our community. Also, putting
the dog park at the back ofthe park and right next to the playground is only going to cause problems. It's hard
on the dogs and it's hard on the children. Please don't take away our children's green space and please don't
make the dogs suffer because they have to be in the middle of loud children.

Dear City Council members, Lorraine Wood, Keith Blackburn, Matt Hall, Michael Schumacher and Mark
Packard,
I would like to request time at the upcoming City Council meeting on September 27, 2016 to discuss the
Poinsettia Park proposed dog park location and an alternative location for the dog park.
This area in Poinsettia Park is an open grass space that my children love. It is an area where they run openly,
roll down the hill, play tag, have Nerf contests, and locate bugs with their friends. It is a sizable enough area
that it can fit a lot of children of all ages who just want to play and run without structure, poop or organized
sports. It is a safe location, away from cars, and is a great location for parents to keep a close eye on their kids.
The houses in this area are close together and have little yard for kids to run around. We have very few open
grass places. School playgrounds are locked when school isn't in session and when it is, preschoolers get a safe,
open space of their own at this location. I've used it countless times with my own children and their friends. I
would like to ensure that this location is preserved for years to come.
Based on feedback from dog owners, it seems that both sides are in agreement that this isn't the ideal place for
the park, but from the dog owners' point of view, it's better than not having it at all.
Please consider adding this item to your agenda to determine if we can fmd a viable alternative for the dog park
without losing the current open space.

We and many of our friends love the open bowl area at Poinsettia Park and don't want it to be taken away. The
proposed park plans look great, but we are concerned about our kids favorite area being made into a dog park. The fact
that it is in the center/back ofthe park is not the best location for a dog park. The dog park should be at the perimeter of
the park. We love dogs and think a park for them is a great idea, just don't love the proposed location.

I am writing to request that a review of the placement of the dog park in the renovation plans be added to the
agenda for the September 27, 2016 City Council meeting. I believe the City Council will finalize the plans for
the dog park at this meeting so a discussion of the topic needs to happen at that meeting. Many of the people
living around Poinsettia Park are upset about losing the open space to the dog park and would like the City to
consider another place for the dog park.

I am a Carlsbad community member who signed the petition for the dog park to be relocated from the planned area. My
2 boys (4 & 6 years old) have enjoyed running and exploring that area for years. It has provided an open space for them
to be creative and have room to just be boys. I would like for the council to consider another location for the dog park so
generations of children will have the opportunity to enjoy it as much as we have.

Recent Action by Commission
•On September 19, 2016, the Parks & Recreation Commission acted to:
Accept a report on the Aviara Community Park Improvements (Phase II
Construction) and the Poinsettia Community Park Improvements (Phase III
Construction), and advise staff to seek City Council approval of the projects’
plans/specifications, and authorization to advertise the projects for public bids.

Request Council’s award of contract to construction contractor: December
Issue Notice to proceed on construction of the project: January
Recommended Action
•Approval of a Resolution approving contract documents, plans and

Construction and the Poinsettia Community Park -Phase III
Construction (CIP Project Nos. 4604 and 4605), and authorizing the
city clerk to advertise the projects for public bids.
