Subject:Introduce Ordinance amending Title 10, Chapter 10.44, Section 680 of the
Carlsbad Municipal Code to reduce the length of the 40 mile per hour
(mph) speed zone on Black Rail Road,that currently extends from Sapphire
Drive to Aviara Parkway, to include only the area from Poinsettia Lane to
Aviara Parkway
Recommended Action
Introduce Ordinance amending Title 10,Chapter 10.44, Section 680 of the Carlsbad Municipal
Code to reduce the length of the 40 mile per hour (mph) speed zone on Black Rail Road that
currently extends from Sapphire Drive to Aviara Parkway to include only the area from Poinsettia
Lane to Aviara Parkway.
Executive Summary
Based on a resident request for speed limit signage on Black Rail Road north of Poinsettia Lane,
staff have determined that the northernmost portion of Black Rail Road should be posted at 25
mph due to the presence of single-family homes.Therefore, staff is proposing to reduce the
length of the existing 40 mph speed zone on Black Rail Road that currently extends from Sapphire
Drive to Aviara Parkway, to new boundaries that would extend from Poinsettia Lane to Aviara
Parkway and remove the portion of Black Rail Road north of Poinsettia Lane.Upon approval of
this proposed change, staff would issue work orders to install 25 mph signs on Black Rail Road
north of Poinsettia Lane.
Discussion
The portion of Black Rail Road between Sapphire Drive and Poinsettia Lane is approximately
1,100 feet in length and 40' wide, curb to curb.*The presence of single family homes on the
northernmost portion of Black Rail Road between Sapphire Drive and Poinsettia Lane
differentiates it from other portions of Black Rail Road.The California Vehicle Code allows the
establishment of a 25 mph prima facie speed limit on roadways that meet the definition of
"residential district".The northernmost portion of Black Rail Road between Sapphire Drive and
Poinsettia Lane meets this requirement and can be posted at 25 mph.
The Traffic Safety Commission, at their meeting of Sept.12,2016, unanimously recommended
that the northerly extent of the 40 mph speed zone on Black Rail Road be modified and terminate
at Poinsettia Lane due to the single-family residences north of Poinsettia Lane.The section of
Black Rail Road north of Poinsettia Lane will be posted at 25 mph and this action does not require
an Engineering and Traffic Survey per the "Residence District" definition in the California Vehicle
Code.
Fiscal Analysis
The installation of two new 25 mph signs will cost approximately $400.Sufficient funds are
available in the Streets Maintenance budget.
Next Steps
After the Ordinance to modify the existing 40 mph speed zone on Black Rail Road is introduced
and adopted,a work order will be issued to install two 25 mph signs on Black Rail Road, north of
Poinsettia Lane.
Environmental Evaluation (CECIA1
The project is exempt from the California Environmental Quality Act (CEQA)per State CEQA
Guidelines Section 15301(c)—minor alteration of existing facilities, including streets, sidewalks,
gutters, and similar facilities involving negligible or no expansion.
Public Notification
The City Clerk will have the Ordinance published in a newspaper of general circulation within 15
days of adoption.

INTRODUCE ORDINANCE AMENDING TITLE 10,CHAPTER 10.44,SECTION
680 OF THE CARLSBAD MUNICIPAL CODE TO REDUCE THE LENGTH OF THE
40 MILE PER HOUR (MPH)SPEED ZONE ON BLACK RAIL ROAD THAT
CURRENTLY EXTENDS FROM SAPPHIRE DRIVE TO AVIARA PARKWAY TO
INCLUDE ONLY THE AREA FROM POINSETTIA LANE TO AVIARA PARKWAY.
WHEREAS,staff has determined that the appropriate speed limit on the northernmost portion
of Black Rail Road between Sapphire Drive and Poinsettia Lane,per the provisions found in the
California Vehicle Code and the California Manual on Uniform Traffic Control Devices,is 25 miles per
hour; and
WHEREAS,the Traffic Safety Commission,at their meeting of Sept.12,2016,unanimously
recommended that the northerly extent of the 40 mph speed zone on Black Rail Road be modified and
terminate at Poinsettia Lane.
NOW,THEREFORE,BE IT RESOLVED,by the City Council of the City of Carlsbad,California,
ordains as follows that:
1.The above recitations are true and correct.
2.Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the revision of
Section 10.44.680 to read as follows:
"Upon Black Rail Road from Aviara Parkway to its intersection with Poinsettia
Lane,the prima facie speed limit shall be 40 miles per hour."
EFFECTIVE DATE:This ordinance shall be effective 30 days after its adoption; and the City Clerk
shall certify the adoption of this Ordinance and cause the full text of the Ordinance or a summary of
the Ordinance prepared by the City Attorney to be published at least once in a newspaper of general
circulation in the City of Carlsbad within 15 days after its adoption.
INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on the day
of ,2016, and thereafter,
PASSED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the
