Recommended Action Adopt a Resolution authorizing settlement of the Workers' Compensation claim of Gregory Fried for $144,202. Executive Summary The claimant was a Police Officer. Mr. Fried sustained a work related injury in the course of employment resulting in permanent disabilities. Discussion The terms and conditions of the proposed settlement are set forth in Request For Settlement Authority (on file in the Human Resources Department). The terms and conditions were agreed upon by the claimant and the city, and have been recommended by Keenan & Associates, the city's third party administrator. Fiscal Analysis The cost ofthe settlement is $144,202. There are sufficient funds available in the Workers' Compensation Self-Insurance Fund to cover the cost ofthis settlement. Environmental Evaluation (CEQA) Pursuant to Public Resources Code section 21065, this action does not constitute a "project" within the meaning of CEQA in that it has no potential to cause either a direct physical change in the environment, or a reasonable foreseeable indirect physical change in the environment; and therefore, does not require environmental review. EXHIBIT 1 RESOLUTION NO. 2016-246 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING SETTLEMENT OF THE WORKERS' COMPENSATION CLAIM OF GREGORY FRIED WHEREAS,Keenan &Associates,the city's third party administrator,has recommended a settlement of the Workers' Compensation claim of Gregory Fried; and WHEREAS;all parties have agreed to settle this claim before the Workers'Compensation Appeals Board. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Carlsbad, California,as follows: 1.That the above recitations are true and correct. 2.That the expenditure of $144,202 from the Workers' Compensation Self-Insurance Fund is authorized for the settlement of said claim. 3.That the City Council approves the Request for Settlement Authority on file in the Human Resources Department. PASSED,APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 13th day of December, 2016, by the following vote, to wit: AYES:Hall, Wood, Schumacher, Blackburn, Packard.
